RESOLUTION NO. R-02-15
A RESOLUTION ESTABLISHING THE POLICY OF THE
VILLAGE OF DEERFIELD CONCERNING NON - COMMERCIAL
DISPLAYS OF THE DEERFIELD VILLAGE LOGO
WHEREAS, the Village of Deerfield owns and uses a certain image of a deer on a field
of green (the "Logo "); and,
WHEREAS, the Logo is an image that the Village uses in connection with the
governmental goods and services offered by the Village of Deerfield and to promote the Village
of Deerfield, its institutions and merchants within the general community; and,
WHEREAS, the Village of Deerfield prohibits the commercial use of the Logo without
the express written permission of the Village; and,
WHEREAS, the First Amendment of the United States Constitution provides protections
for persons who desire to use public property for expressive purposes, including purposes that
are not endorsed by or may be objectionable to the government; and,
WHEREAS, the corporate authorities of the Village of Deerfield desire to protect the
Village's property rights in the Logo, consistent with the Village's commitment to free speech
and to the open and truthful exchange of views on matters of public importance; and,
WHEREAS, the corporate authorities of the Village of Deerfield are concerned that
persons that use or display the Logo for political or other First Amendment expressive purposes
may confuse or mislead the public into believing that the Village of Deerfield endorses or
supports the opinions or views of any person so using the Logo for such First Amendment
purposes; and
WHEREAS, the corporate authorities of the Village of Deerfield have determined that
any non - commercial use of the Logo within the corporate limits of the Village of Deerfield for
political or other First Amendment expressive purposes should be accompanied by an express
disclaimer of any connection with, endorsement or support of the Village of Deerfield and
otherwise comply with the policies of the Village contained herein concerning the time, place
and manner in which the Logo may be so used or displayed;
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, in the exercise of its home rule powers, as follows:
SECTION 1: That the policy of the Village of Deerfield with respect to any use or
display of the Village Logo by person(s), firms or entities engaged in non - commercial partisan
political or other expressive First Amendment activities within the Village of Deerfield shall be
as follows:
A. That the Village of Deerfield does not engage in, endorse or lend support to any
partisan political activities, or to any other expressive First Amendment activities
that do not pertain directly to the government and affairs of the Village of
Deerfield, and does not authorize or license any use or display of the Logo for
partisan political activities or any other expressive First Amendment activities.
B. Any use or display of the Logo for partisan political activities or any other
expressive First Amendment activities has not been authorized by the Village, is
not connected with, endorsed or supported by the Village of Deerfield, and shall
not be construed as any endorsement or support by the Village of the person(s),
firm or entity using or displaying the Logo for such purposes, or of any opinions
or views expressed by such persons.
C. The Logo shall not be used by any person(s), firm or entity in a manner as to
falsely state, suggest or imply any endorsement or support by the Village of
Deerfield for the person(s), firm or entity using or displaying the Logo for such
purposes.
D. Any use or display of the Logo by third parties shall be accompanied by a
disclaimer disavowing any connection with or endorsement by the Village of
Deerfield, and stating that the views or opinions expressed by such person(s), firm
or entity using or displaying the Logo are the views and opinions of such
person(s), firm or entity only, and shall not be considered as the opinions or views
of the Village of Deerfield.
E. Any fraudulent or defamatory use or display of the Logo is prohibited.
F. The Village of Deerfield expressly retains discretion to modify or repeal this
policy at any time.
SECTION 2: That this Resolution shall be in full force and effect from and after its
passage and approval as provided by law.
