08/03/1970 (2)ff a August 3, 1970 The regular meeting of the President and Board of Trustees of the Village of Deerfield was called to order by the President in the Council Chambers of the Village Hall on Monday, August 3, 1970 at 8:22 p.m. The clerk called the roll and reported that the following were Present: Bernard Forrest, President George Kelm George P. Schleicher Stephen M. Slavin M. Jay Turner, Jr. Absent: Charles R. Bootz and that a quorum was present and in attendance at the meeting. Also present were Messrs. Richard Houpt, Village attorney, and Norris Stilphen, manager. Trustee Slavin moved, seconded by Trustee Turner, that the minutes of the regular meeting held July 20, 1970 be approvdd as submitted. Motion carried un- animously. BZA Report- 1`;efb`ack Variations A report from the Board of Zoning Appeals Library - Prepare Ordinance recommended that variations from the pro- visions of the Zoning Ordinance be granted to permit the construction of a library building within 18� feet of the south lot line, and parking within 2� feet of the west and north property lines. It was pointed out that the south row of parking spaces shown on the site plan encroached on the present Town Hall parking lot. Trustee Schleicher moved, seconded by Trustee Turner, that the recommenda- tion of the Board of Zoning Appeals, and the Village attorney be directed..to pre- pare an ordinance granting variations as recommended. Motion carried unanimously. Report- Meeting with The manager reported that he and Trustees Fire District Schleicher and Slavin had met with members of the Deerfield- Bannockburn Fire Protection District to discuss matters of mutual interest. He stated the Fire District is making improvements which will be completed by next spring. It was suggested that the Village and Fire District conduct flow tests from hydrants, starting with the business district, schools and churches and eventually, all hydrants. A system of color coding for hydrant caps will be devised to show flow per-100 gallons per minute. Trustee Schleicher stated that planned and proposed improvements should result in a 2 point reduction in the fire rating by the Inspection Bureau next year, which would affect insurance rates for residences. He stated it might not be timely to request an inspection at this time, but rather wait for the regularly scheduled inspection next year. Trustee Slavin concurred. Decision was made that no inspection be requested at this time. Report - Glenview Meeting The manager reported that Director of Public on Drainage Works Ed Klasinski and Drainage Committee Chairman William Healy had attended the Glenveiw meeting on drainage on July 30, 1970. A committee on drainage is being organized to conduct special studies on'flooding. Flood water retention basins are recommended, and the Metorpolitan Sanitary District will provide guidance at a minimum fee. Each municipality was asked to appoint a representative, and other municipalities are urged to join. President Forrest asked Mr. Klasinski fo attend as Deerfield's representative. Report - Maplewood School The manager reported that work is progressing Sewer Connections on the disconnection of Maplewood School roof drains from the sanitary sewer and connection to the storm sewer, and the wokk should be completed shortly. The matter will be kept on the agenda for further progress reports. Approve Van Der Molen Scavenger The Village attorney stated the Agreement with Contract with Changes Van Der Molen for scavenger service was based on specifications on which bids were submitted. He had met with Mr. Van Der Molen and his attorney who had requested an addition to paragraph 7 to provide that, in the event the company notice shall be given of such failure, and if correct the contract shall be terminated. Mr. Van Der if these provisions were not 619, Discussion was had on the Agreement and the following changes were approved: Paragraph 9 - Deerfield telephone number; Paragraph 12 - to provide that if there are changes in specifications which would significantly affect the cost of providing service, and there is failure to agree on rate changes, the matter shall be submitted to binding arbitration.(Mr. Van Der Molen agreed to this condition provided the bonding company would approve); Paragraph 18 - deleted. Trustee Slavin moved, seconded by Trustee Turner, that execution of the contract be authorized subject to changes made at this meeting. President Forrest suggested that the contract be approved at the next meeting. He pointed out that the agreement must be re- typed, the public has not had an oppor- tunity to see it, and the contract date is September 1, 1970. Trustee Kelm concurred and moved that the motion be admend to approve the contract in principal subject to the final draft. The motion failed for lack of a second. Mr. Van Der Molen urged approval at this time since he would otherwise run into a problem with the State licensing date of August 15. The Village attorney suggested that the corrected draft be available for the next distribution, and upon approval thereof the contract -could be executed prior to the next regular meeting. z.i The motion to authorize execution was adopted by the following vote: Ayes: RnHlx� Kelm,-Schleicher, Slavin, Turner (4) Nays: None (0) The release of escrow funds for Kennedy Construction Company in connection with Hovland improvements, Special Assessment No. 107, will be taken from the agenda until such time as all pertinent matters have been resolved. The Village attorney's report on the Milwaukee Road's proposed Project Transi- Plan.is not finished and the matter will be on the agenda for the next meeting. Complaints - Flooding Problems Mr. Richard Buerger, 216 Forestway Drive, stated Forestway & Warrington Areas that his basement had been flooded several times in recent months, and the Director of Public Works had not been aware-of any flooding problems in that area. He had circulated a petition in the neighborhood and.found that 14 residences had the same problem. The petition was filed with the clerk. He asked that some type of organized activity be undertaken to see what can be done to eliminate flooding from both storm and sanitary sewers. The manager stated that extraordinary flows in the County Line Road - Forestway sanitary sewers during periods of rainfall had been investigated and it had been discovered that roof drains from the Kleinschmidt plant had inadvertently been connected to the sanitary.sewer a plating water discharge had been connected about three years ago. He stated-that the-disconnection of this roof drainage and that from the Tractomotive loading docks would do much to alleviate the flooding problems in the Forestway Drive area: He explained smoke testing procedures to eliminate storm water from the.sanitary sewers. Trustee Slavin stated the Warrington Road area also had flooding problems. A groups of residents from the Warrington area described the frequency of flooded basements and streets, and questioned the adequacy of the storm sewer to take care of storm water drainage. Trustee Slavin was excused and left the meeting at 9:25 p.m. The manager explained the sizes of storm sewers in Warrington Road and stated the capacity was adequate,*but pointdd out they were old sewers and there was in- filtration. He also stated that iifooting tiles were connected to sanitary sewers in many cases and could cause backup of sanitary sewage into basements. He recommended the installation of sump pumps to eliminate basement flooding. He proposed the con struction of two additional inlets to alleviate the flooding of the street in the 1300 block of.Warrington Road where drainage from the Walden School site causes flooding. Flood retention basins were proposed by homeowners as one means of resolving the problem ,;and.President -Fo.rres.t pointed out. -that if the Village could acquire the bribk.yards the clay pit would-be used for storm water retention. A program of sump pump inspections was discussed but several residents expressed doubt this would eliminate the problem. ILJ The manager explained to Mr. Sherman Kieser, 312 Birchwood, the installa- tion of a sump pump for sanitary sewage and splashblocking roof drainage which will flow into street inlets. Mr. Kieser also stated that the grade of his drive- way which was constructed as part of the Hovland improvements was so steep the bottom of his car hit each time he went in or out, and further, the sidewalk across the driveway was not 6 inches thick as specified. The manager stated Mr. Klasinski would investigate these complaints. The manager described the program which has been underway for several years to alleviate flooding problems, and stated the problem was a long time in the making and could take a long time to solve. He assured the residents that,the Village will continue these programs which have proved to be helpful in allevi- ating flooding. Complaints - Solicitors Two residents of Mallard Lane complained about the frequency and conduct of solicitors, and asked that something be done to stop this nuisance. The Village attorney stated that until the last session of the legislature there was no way to regu late solicitors, but the passage of a recent bill would, in effect, permit a municipality to provide some relief. Trustee Slavin re- entered the meeting at 10:00 p.m. and was present thereafter. The attorney stated that the Illinois Municipal League had suggested an ordinance which would make the homeowner responsible for posting his property. The sign, which would be furnished by the Village, could prohibit all solicitors, or could prohibit only those solicitors who are not registered with the Village. Discussion was had on the signing of complaints for violations which must be done by the homeowner unless a member of the Police Department observes the violation. It was pointed out that the passage of an ordinance such as described would tend to discourpge solicitation. - ' Trustee Schleicher moved, seconded by Trustee Turner, that the Village attorney be directed to prepare the ordinance as discussed. Motion carried unanimously. The meeting was recessed at 10:25 p.m. and re- convened at 10:35 p.m. 1st Presentation Ordinance The first presentation was made of an Air Pollution ordinance on air pollution control. Dis- cussion was had on enforcement. A member of Y.E.S. stated the City of Chicago has a three day training program for the licensing of LinspectoYs who would then qualify as an expert on smoke emission. The manager was directed to send copies of the ordinance to the major manufact- uring;; companies in the Village for their comments before passage. Lst Presentation- Ordinances Scavengers & Garbage scavengers. The ordinance has been The first presentation was made of an ordinance amending Article VII of Chapter 17 of the Municipal Code pertaining to posted on the bulletin Board in the lobby. The first presentation was made of an ordinance amending Section 18.203 of the Municipal Code pertaining to residential garbage container specifications. This ordinance has also beenposted. A discussion of speed limits on Longfellow Avenue will be on the agenda for the next meeting when it is hoped'the report from the Safety Council will have been received. The proposal for inspection of gasoline storage tanks will be considered after the recommendation from the Fire District is received. The letter from the Metropolitan Sanitary District will be turned over to the Drainage Committee. Re: Sump Pump Inspections Consideration of a proposal for sump pump inspections was deferred at Trustee Slavin's request. He stated adequate notice had 'not been given to the public and recom- mended that no action be taken until the next meeting. He asked that the proposal be posted on the bulletin board. Trustee Turner asked the cooperation of the news- papers in informing the public of the proposed program. T-11 I \ 1st Presentation -Tax Levy Ordinance The first presentation was made of the ordinance levying-taxes for the year 1970 -71. The ordinance has been posted on the bulletin board. 1st Presentation - Ordinance The first presentation was made of the ordinance Abating Mun. Bldg. Bond Levy, abating the levy of the tax for payment of principal and interest on Municipal Building Bonds. The ordinance has been posted on the bulletin board. Re: North Ave. Widening President Forrest stated that the engineer's estimate of cost for the widening of North Avenue was $19,000 on a cash basis, and although several people had asked to be heard on this matter, none were present. Trustee Slavin stated that a petition was being circulated and asked that the matter be held over to the next meeting. The manager was directed to notify the Trinity United Church of Christ action will be taken at the next meeting. Resolution - Thahks for Trustee Schleicher moved, seconded by Trustee Family Dad Turner, that the resolution be adopted expressing (R- 70 -13) appreciation to the FAmily Day Committee and sponsoring organizations for the very successful Family Day celebration on July 4th. Motion carried unanimously. Refer R.R. Parking Lot The manager reported that a representative would Proposal to Plan Commission meet with the Board at any convenient time to discuss the proposal on the station parking Q lot. The proposal was referred to the Plan Commission for comments. Trustee Schleicher suggested that the Boy Scouts be requested to survey cars in the parking lot to determine what percentage are owned by Deerfield residents, and how many from Lincolnshire, Riverwoods and other areas. It was his opinion the Scouts would welcome this opportunity to perform a civic service. Authorize Appraisal- Favelli, ._ _ The manager reported that the agent for the owner Property, 859 Deerfield Rd. of the Favelli property at 859 Deerfield Road had offered the property to the Village for $69,629.00. After a brief discussion on the potential use of the property, Trustee Slavin moved, seconded by Trustee Turner, that the Village secure an appraisal. Adopted by the following vote: Ayes: Kelm, Schleicher, Slavin, Turner (4) Nays: None (0) Reports - Communications The manager reported that the Briarwoods Home- owners Association had invited the President and Board to a meeting at the Briaroods School on Tuesday, August 4, at 8:00 P.M. There will be a dicussion of the Blietz property and County Line Road improvements. The manager reported that a letter had been sent to the Toll Highway Commission regarding the parking lot at the Wilmot Junior High School and a request that the drainage ditches be cleared and deepened. The Commission answered that the ditches would be cleared but it would be impossible to deepen them. In connection with agreements for petitions for disconnection of the Deer - brook Addition from the Cook County School District and annexation to School Districts 109 and 113, the Village attorney stated that in addition to approval of such disconnection and annexation by both County Boards of School Trustees, approval by the voters is required in the district from which the disconnection will be made. A letter from the Building Commissioner regarding accessory uses and side yard areas was referred to the Plan Commission on motion by Trustee Turner, seconded by Trustee Schleicher, and carried unanimously. The manager reported that work is proceeding on the Lake Eleanor bridge;larid Ut should be finished within a week or two. Baxter & Woodman have sent the plans for the additional sludge pumps and invitation to bid will be advertised. In connection with the denial of the parking variation requested by the Deerfield State Bank and the Board of Zoning Appeals' recommendation that the matter be studied by the Plan Commission, Plan Commission Dan Stiehr stated the Commissinn had not considered this a directive, and since the expenditure of several hundred dollars was involved the study had not been made. Discussion was road on parking in the north- east quadrant and lack of prafrfstofilifnr the orderly and convenient flow of traffic in the area. Trustee Slavin then moved, seconded by Trustee Turner, that the matter TV be referred to the Plln Commission for study with particular reference to ingress and egress to WAukggan Road. Motion carried-unanimously. . Trustee Schleicher stated no report had been received from the Plan Commission regarding membership in NorthEast Illinois Planning Commission. He then moved, seconded by Trustee Kelm, that membership in the Northeast Illinois Plan Commission and payment of the funds requested to referred to the Plan Commission to be decided at their discretion, and if decided affirmatively, payment of the fee shall be from the Plan Commission's budget. Motion carried unanimously. Resolution Re: Navy Trustee Slavin stated that he and-.other Stunt Flying residents were becoming increasingly concerned (R- 70 -14) about the close formation and stunt flying of planes from the Glenview Naval Air Station over.residentiil areas. He stated this-type of flying is not regulated by the F.A.A. as he had assumed. He then moved, seconded by Trustee Turner, that a resolution be adopted urging the navy to conduct such stunt flying over Lake Michi- gan or nearby undeveloped land that the Commandant of the Air Station, Senators Percy and Smith and Representatives McClory and Crane be notified of this action. Adopted by the following vote: Ayes: Kelm, Slavin, Turner (3) ...
