02/06/1967185 ` February 6, 1967 The regular meeting of the President and Board of Trustees of the Village of Deerfield was called to order by the President in the Council Chambers of the Village Hall.on Monday, February 6, 1967 at 8 :15 p.m. The clerk called the roll and reported that the following were Present: H. Ross Finney, President Raymond L. Craig Bernard Forrest Charles H. Raff George P. Schleicher James M. Wetzel Absent: None and that a quorum was present and in attendance at the meeting: Also present were Messrs. Richard Houpt, Village attorney, and Norris Stilphen, manager. Minutes of the regular meeting held January 16, 1967 were approved as 1fJ submitted on motion by Trustee Craig, seconded by Trustee Raff, and carried d� unanimously. W The manager repotted that a representative of the North Shore Gas Company had advised him that the company was not ready to revise the rate schedule, and that cost figures prepared by the Village on gas and electric lights were correct and showed savings with electric street lights. The manager further reported that he had written to North Shore Gas asking that the maintenance contract be cancelled. Ordinance - Zoning Amendment Trustee Raff moved, seconded by Trustee Craig, Re: 20000 Sq.Ft. Limitation that the ordinance be adopted amending B -1 Dist. (0 -67 -5) Section XIII.D.6 of the Zoning Ordinance to provide that the 20,000 sqaure foot limitation for one use in the B -1 Neighorhood Business District shall not be-Applicable to a unified shopping center having an area of four or more acres. Adopted by the following vote: Ayes: Craig, Forrest, Raff, Schleicher, Wetzel (5) Nays: None (0) The President signed the ordinance indicating his approval thereof. Trustee Raff moved, seconded by Trustee Forrest, that the ordinance be published in pamphlet form. Motion carried unanimously. Ordinance - Variation Trustee Raff moved, seconded by Trustee Craig, H -D Elect. 760 Isterman that the ordinance be adopted granting 0 -67 -6 variations from the front yard, side yard and corner front yard requirements of the Zoning Ordinance with respect to the premises known as 760 Osterman Avenue, as petitioned by H -D Electric Company. Adopted by the following vote: Ayes: Craig, Forrest, Raff, Schleicher, Wetzel (5) Nays: None (0) The President signed the ordinance indicating his approval thereof. Ordinance -Sign Variations Trustee Forrest moved, seconded by Trustee LakeEleanot Sub. Raff, that the ordinance be adopted granting 0-67 -7 variations from the provisions of the Zoning Ordinance to permit the erection of three permanent entrance gate signs on Lots 34, 35 and 62 in the Lake Eleanor Sub- division, as petitioned by Peter J. Waytula & Son. Adopted by the following vote: Ayes: Craig, Forrest, Raff, Schleicher, Wetzel Nays: None (0) The Pr(osj dent signed the ordinance indicating h i s approval thereof. r'fy Mr. Andrew Ebert, President of the Deerfield Homeowners' Association, stated Oat signs advertising the Lake Eleanor Subdivision had been erected at the Northwest corner of Deerfield and Wilmot Roads, and that since the Association has gone on record as opposing the indiscriminate placing of signs, the directors has asked that the matter be brought to the attention of the Board. The building commissioner reported the signs were in violation of the Zoning Ordinance, and thr owner had been notified to remove them. Approve Preliminary Plat A report from the Plan Commission Gauntlett Subd. Subject to recommended approval of the Gauntlett Covenant Subdivision of two lots at 260 Deer- field Road, with front and side yard variations for existing buildings on Lot 2, said approval conditioned upon a covenent restricting the development of Lot 1 to R -1 Single family District. use. Trustee Schleicher moved, seconded by Trustee Forrest, that the report of the Plan Commission be accepted. Motion carried unanimously. Trustee Craig moved, seconded by Trustee Raff, that the preliminary plat of the Gauntlett Subdivision be approved subject to the limitation that Lot 1 be developed as R -1 Residential, and a covenent be prepared for this purpose. Adopted by the following vote: Ayes: Craig, Forrest, Raff, Schleicher, Wetzel (5) Nays: None (0) Deny Request for Funds A letter from the Community Relations "Know Your Town" Book Commission recommended that the Village not subsidize the publication of the "Know Your Town" booklet prepared by the League of Women Voters, since it is a duplication of the booklet to be published by the Chamber of Commerce in March. Trustee Raff moved, seconded by Trustee Craig, that the request of the League of Women Voters for financial support for the "Know Your Town" booklet be denied. Motion carried unanimously. The manager stated the former booklet of the League had been sold in the Village Hall, and asked if there would be any;,objection to the purchase of booklets by the Village for re -sale at the purchase price. Trustee Raff objected. Trustee Craig stated that, while he was not in favor of a subsidy, he would approve the sale of the booklets at the Village Hall as an aid in distribution. The manager was directed to write to the League, stating that the Board had denied their request for funds for their publication, and pointing out that the Board had failed to subsidize Deerfield Family Day. Trustee Schleicher stated that unless the Board is willing to subsidize all groups, it would be unwise to Set a precedent. Remove No Parking Signs - Longfellow In connection with letters of complaint Refer Kipling to S.C.- against the erection of "No Parking" Authorize Ord. No Parking 20' W of signs on Longfellow Avenue, President Kipling -S. Side Longfellow Finney stated he had been out of town, and therefore had received them upon his return. He stated the manager had caused the signs to be posted tempor- arily without Board action at the request of School District #109 in the interests of child safety, sincetthe Board would not meet for four weeks. The manager read the letter from the School District asking that parking be prohibited on Kipling Place because of hazards to school children created by trucks used in the construction of additions to Kipling School. A sub- sequent letter was read approving the Village's proposal that parking be prohibited on both Kipling and Longfellow. A large group of residents of Longfellow were present to protest against the no parking restriction. It was stated that cars were parked in the street to slow down traffic using the Longfellow- Kipling route as a by- pass to avoid the traffic signals at the Waukegan - Deerfield Road intersection. Petitions were presented signed by 100 percent of the residents of Longfellow objecting to no parking on Longfellow. President Finney stated the parking restrictions could not be enforced since no ordinance had been passed to implement enforcement. A lengthy discussion was had on the traffic and safety problems of the 187 area :including specific problems caused by the construction at the school. The manager pointed out that school bus drivers had difficulty in turning from Kipling onto Longfellow when cars are parked on the south side of the street. Residents approved the suggestion that no parking be permitted on the south side of Longfellow within 30 feet of Kipling Place, but urged the Board to permit parking on the remainder, to slow down traffic, protect the residential character of the neighborhood, and to precude the use of these streets as a by- pass by cars and large trucks such as Jewel and Sara Lee. The Village attorney advised the Board that a load limit could be established which would eliminate heavy truck traffic except those trucks making pick ups or deliveries on the streets. The village attorney was instructed to prepare an ordinance prhibiting parking on the south side of Longfellow Avenue from a point 30 feet west of Kipling Place easterly through the Kipling intersection. . Trustee Schleicher moved, seconded by Trustee Forrest, that the manager be instructed to "remove no.parking signs on Longfellow Avenue. Adopted by the following vote: Ayes: Craig, Forrest, Raff, Schleicher, Wetzel (5) M Nays: None (0) in Dr. Fenelon, Superintendent of SchoolDistrict #109,'asked that it be W clearly understood that the school had asked only for no parking on Kipling Place during school construction, and that no parking on Longfellow had originated with the Village, the School District merely approving what was recognized to be the Village's function and responsibility. Discussion was had on the problems of traffic and child safety on Kipling Place, including no parking during construction, loading and unloading of school busses, etc. Trustee Raff moved, seconded by Trustee Wetzel, that the questions on parking restructions and traffic on Kipling Place be referred to the Safety Council for study and recommendation, and the present "No Parking" signs be removed temporarily. Motion carried unanimously. On--behalf of the Longfellow residents, Mr. Craig Shaw expressed their appreciation for the Board's cooperation and consideration. The meeting was adjourned at 9:50 p.m. and reconvened at 10 :05 p.m., all members present. Authorize Ordinance -No Residents -of the Walnut - Forest area were present Parking on Walnut . to object to parking on the north side of Refer Walnut- Forest Walnut Street by commuters. A petition signed to Safety Council by the residents was presented by Mr. Robert McCulla, 905 Forest Avenue, asking that parking be prohibited. He stated that commuters find it more convenient to park in the street, but more cars could be parked in the station parking lot. He pointed out that child safety was involved, that leaf pickup was impossible last fall, and that snowplowing was difficult due to the parked cars. Trustee Craig mentioned the limited parking area at the station, and asked if some means could be found to provide a more efficient parking arrange- ment. The manager suggested that the Railroad might pave and mark its parking area if the Village paved and marked the area leased by the Village. Trustee Raff pointed out there was no problem of waste space on the area along the street which is leased by the Village, the problem of helter - skelter parking was on the Railroad parking lot. He suggested that time limit parking would eliminate the all day parking by commuters. Trustee Raff rpoved, seconded by Trustee Craig,..that the attorney prepare an ordinance to prohibit parking on the north side of Walnut Street, hours to be determined after consultation with the Chief of Police regarding ease of enforcement, and the parking and traffic problems of the Walnut- Forest area be referred to the Safety Council. Motion carried unanimously. P.C. Report - No Hearing on A report was received from the Plan Commission Juris. Map Amendment stating that it was the opinion of the Commission and its consultant that no useful purpose would 18 6, be served by changing the jurisdictional map for the area west of Wilmot Road and north of county Line Road from the OL R Classification to a residential designation; however, if the Board so directed, a public hearing would be held by the Plan Commission. The present classification is 0 S R under the County Zoning Ordinance. Discussion was had on the advisability of amending the jurisdictional area map to show a residential classification, and whether the Village should ask the County Board to change the existing 0 t R zoning on the property. It was pointed out that the 0 S R classification resulted from the requests of School District x`110 who sought relief from financial problems by a zoning classification which would be non -child producing. Trustee Schleicher pointed out that 0 & R property across from Hovland Subdivision might give cause for higher intensities of land use for that subdivision, and that the 0 t R property could be developed under County zoning with no Village control whatsoever. Mr. Andrew Ebert, Homeowners' Association President, stated that bills had been introduced in the General Assembly which would permit a munici- pality to zone property within the jurisdic•ti :onal area. The manager.stated that from the standpoint of Village utilities, the Village would be better off if the property were not annexed. After further discussion, Trustee Raff moved, seconded by Trustee Schleicher, that the Plan Commission be instructed to hold a public hearing on an amendment to the jurisdictional area map to show a residential classi- fication for the 0 i R zoned territory west of Wilmot Road. The-motion failed to pass by the following vote: Ayes: Forrest, Schleicher (2) Nays: Craig, Raff, Wetzel (3) lst Presentation- Ordinance The first presentation was made of Mun. Code Amend. Min. Charges an ordinance amending the Municipal for 6" t 8" Water Meters Code to establish minimum monthly charges for 6 inch and 8 inch water meters. The ordinance was read in full. Trustee Raff suggested that an addition be made to the ordinance to provide t-lrat minimum monthly charges for water met, prs� larger than 8 inch e o f Resolution - Commend Vlg. Employees Trustee Raff moved, seconded by for Snow Removal R -67 -4 during the recent storm, and thanking for their assistance. Motion carried unanimously. Trustee Schleicher, that a Resolution be adopted commending Village employees for the excellent work in snow removal the Park District and Allis Chalmers Reports - Communications President Finney reported he had received a letter from Dr. Fenelon, School District #109, thanking the Village for snow removal around the schools. He stated he had received many letters from residents about the excellent job done by the Village. P.C. Report - R -1 -13 District A report from the Plan Commission Hovland Sub. recommended that adoption of an • 9 amendment to the Zoning Ordinance to establish an R -1 -13 cilassification for the Hovland area, but that no- special assessment be undertaken at this time since it would remove the flexibility of the provisions and concept of the R -1 -9 classification. The Commission further recommended that since some provision for public lands should be made in the area, the Board contact the Park Board for this purpose. Trustee Forrest moved, seconded by Trustee Schleicher, that the Plan Commi ssi :on be accepted. Motion carried unanimously. Since it had been the thinking of the Board that construction of improvements by special assessments would be undertaken upon the rezoning of Hovland Subdivision, decision was made that the Board discuss the matter with the Planning Consultant, the Chairman of the Plan Commission and the Village attorney. The manger was directed to arrange such a meeting, February 27th at 8 :00 p.m, being suggested as the date for the meeting. He stated that he had met with representatives from Sara Lee to discuss the sewage treatment. contract. The company is developing procedures to reduce the suspended solids problem. • The manager's attendance at the Leadership Council on Housing at Elmhurst College on February 17th was approved. Safety Council Report A report was received from the Safety Council Sidewalks near Schools recommending that sidewalks be constructed on Oakley, Sheridan, Woodward, Grove, Jonquil and Central, all streets being used by school children. The manager recommended that property owners be notified as soon as possible in order that they might move any shrubs. Trustee Raff stated he did not agree with the recommendation on the Central. Avenue sidewalk. The matter w 11 be discussed at the February 27th workshop meeting, and no letters will be sent until the Board reaches a decision. The manager reported that the Illinois Municipal League had advised the Village of the hearing in Springfield on bills to increase sales taxes and other revenues for municipalities. After a brief discussion, Trustee Schleicher moved, seconded by Trustee Forrest, that the Village support legislation which would permit municipalities to increase sales and service tax revenues. The motion failed to pass by the following vote- Aye s: Raff; IL, Schleicher (2) Nays: Craig, Forrest, Wetzel (3) The manager reported thvt March 6, 1967 had been set for the acceptance of bids on the heat exchanger. An invitation was received from Mayor Daley to attend the dedication of the Alcoholic Treatment Center inChicago. A letter from the Civil Defense Director, Mr. Stephen Feller, stated a Civil Defense meeting would be held on March 18, 1967 at 2 p.m. Two letters were received expressing approval of the electric street light at Kenton and Warwick. President Finney stated i,t had been recommended that three sergeants be appointed in the Police Department. Trustee Forrest moved, seconded by Trustee Schleicher, that the Village attorney prepare an ordinance to establish positions for three sergeants. Motion carried unanimot,s ly. The manager reported that the Police Department was one patrolman over - strength, one lieutenant short, and another dispatcher needed. The matter will be taken up in budget discussions. Mrs..Marge David submitted her resignation from the Manpower Commission. The „Commission will be asked to suggest a replacement. President Finney reported that Mr. Edward Gourley, Chairman of the Parking Committee, was having difficulty in arranging a meeting with merchants to discuss parking problems. Trustee Raff suggested that the President attend the next meeting of the Chamber of Commerce to discuss the matter. The-manager reported that consideration of the contract with Sara Lee for sewage treatment had been postponed, but the contract would be retroactive to Febru3 ry- 1 , 1967.
