Trustee Wetzel stated he felt the referral to the Plan Commission was a good idea since any action to upgrade the zoning might defer action on the part of land developers until Baxter Laboratories have started their building program. Public Convenience A hearing was held on the application & Necessity -Able Airport Service of Mr. Joseph Sylvester, 1260 Warrington (Sylvester -1260 Wartington) Road, Deerfield, dba Able Airport Service, on a Certificate of Convenience and Necessity for a livery service. Mr. Sylvester stated the Able Airport Service will provide a 24 hour per day answering service and 7 days per week limousine service with three limousines and three drivers. One limousine, 4 which he will drive, is garaged at his home; the other two drivers own their vehicles and garage them at their place of residence. All vehicles will be inspected at any location designated by the Board. Mr. Sylvester stated he had checked with the Village Building Department before he started the service,regarding the business telephone and the garaging of the limousine -';at his residence, and had been told these uses were not in violation of the Zoning Ordinance. Trustee Wetzel moved, seconded by Trustee Schleicher, that the manager be authorized to issue a Certificate of Public Convenience and Necessity for the Able Ai;rpor.t.Seruice, subject to a favorable report on inspections and investigations by the Chief of Police and compliance with all other requirements of the ordinance pertaining to livery services. Public Convenience The applicant for Certificates of Public Con - S Necessity- Taxicab Livery venience and Necessity for livery and taxicab E. Eggan services, Mr. Edward Eggan, 836 Everett Road, Lake Forest, stated that he was now licensed in Lake Forest as the Midway Limousine Service, Inc.; the Deerfield service �+ would be separate from the Lake Forest operation; he plans to rent office and W garage space in the Village, and will comply fully with all Ordinance require - ments. The companies will be known as the Deerfield Livery Service, Inc. and the Deerfield Black and White Cab Company, although these names may be changed by his attorney, who is out of town. Four taxicabs will be licensed if he can obtain reliable drivers. He submitted letters 6f recommendation from the Chief of Police of Lake Forest, and Mr. Earl Paul, forner Municipal Justice. Motion carried unanimously. 96 Appropriation Ordinance Trustee Smith moved, seconded by 0 -66 -27 Trustee Schleicher, that the Appro- priation Ordinance for the year May 1, 1966 -April 30, 1967 be aodpted. The ordinance includes the appro- priations for the library. A letter was received from Mr. Keith Nickoley, Pr.esi'dent of the West Deerfield Township Library Board, stating that the Township library appropriation and levy would be abated. The Ordinance was adopted by the following vote Ayes: Craig, Forrest, Raff, Schleicher, Smith, Wetzel (�) Nays: None (0) The President signed the ordinance indicating his approval thereof. Report - Governmental Center Trustee Raff reported that he and Trustee Craig had met with representa- tives of taxing bodies to discuss the governmental center proposal. He stated the Fire District planned to enlarge their present quarters and are not interested, and the School Districts felt they should maintain their own identity. Only the Library Board and Park District expressed interest, although the Library Board's need is for space for audio- visual programs and a children's library, and the Park District needs recreational facilities. It was suggested that the matter be referred to the Planning Consultant to determine if a Civic Center is needed, and what are possible locations. Trustee Raff proposed-that a meeting be arranged after the Planner's report is received if the Park and Library Boards officially express interest. Trustee Craig moved, seconded by Trustee Raff, that the matter be referred to the Planning Consultant. Motion carried unanimously. Downspout Disconnections A map was prepared showing the locations where testing and disconnection of downspouts had been completed, and locations tested but not disconnected. The manager stated the Woodland Park area was being smoke tested and about 20 per cent were found to be defective. Trustee Smith suggested that a higher priority be given to the areas discharging into the east side sewer main, due to the surcharging of this main when it rains. Safety Council Report A letter was received from the Safety Council, stating it was their opinion the greatest traffic problem was the Waukegan- Deerfield Road intersection, and urging that everything possible be done to find and implement a solution. President Finney pointed out the Village was acquiring the Broege property to provide a by -pass of the lights, and to implement the off - street parking plan. The manager was directed to check with the Division of Highways with reference to how far parking must be prohibited from the corners, and the traffic count required before split phase lights and left turn only signals will be approved. Approve Preliminary Plat The Plan Commission recommended approval Herrmann's First Add. to Deerfield of the preliminary plat of Herrmann's First'Addition to Deerfield, a sub- division of four lots at Wilmot and Berkeley Court. They recommended a waiver of street, curb and gutter improvements for the four lots; sanitary sewer and water to be installed to the east side of Lot 3; and a covenant be required to provide that no subdivision of Lot 4 shall'be made unless sidewalk, curb and gutter are installed on Wilmot Road, a sidewalk constructed on'Berekley Court from Wilmot Road to the east edge of Lot 3; water main extension from Wilmot Road to the east edge of Lot 3; and that the said lot 4 not be sub- divided into more than two lots of not less than 29,000 sq. ft. each. Mr!.-,Warren Jackman,'attorney for the contract purchaser, stated the Misses Emma and Louise Herrmann, the owners, had no intention of subdividing Lot 4, since it is the old family home, and agreed the Village should have the protection afforded by the conditions listed by the Plan Commission. Trustee Wetzel moved, seconded by Trustee Craig, that the preliminary plat be approved together with the Plan Commission's recommendations. Adopted by the following vote: Ayes: Craig, Raff, Schleicher, Smith, Wetzel (5) Nays: Forrest (1) 97 Approve Kroger Mr. John Jursich requested the Board to Parking Variation approve a parking variation for the proposed ..Kroger -drug store building on South Waukegan Road, reducing the parking requirements from 137 parking spaces to 120 spaces, as heretofore petitioned and heard by the Board of Zoning Appeals. He stated the Planning Consultant's final recommendation on parking was one parking space for each 125 sq. ft. of sales area, and the 120 spaces he will provide are the equivalent of one space for each 114 sq. ft. of sales area. He pointed out that the President and four Trustees had agreed to approve a variation H the Planner recommended a reduction in parking requirements when he had discussed the matter with them at a workshop meeting. President Finney stated no report had been received from the Plan Commission. The Village attorney verified Mr. Jursich's report on the Planners recommendation of one space for each 125 sq. ft. of sales area. He stated the Plan Commission had directed that a notice of public hearing be published on the revised require- ments, and no report would be submitted until the hearing has been held. Discussion was had, and Trustees Forrest and Raff proposed that no action be taken until a report is received from the Plan Commission. M Trustee Craig moved, seconded by Trustee Wetzel, that a variation be granted for the Kroger property to permit a Deduction in parking requirements to 120 parking'spaces instead of the 137 spaces required by the present ordinance. W U Trustee Forrest moved, seconded by Trustee Raff, that the matter be tabled U until the next rre eting in order to get a report from the Plan Commission and Consultant. Accept P.C. Report The Plan Commission recommended approval mf the Park Crest Sub. preliminary plat of Glorioso's Park Crest Defer Action Subdivision of two lots at 2074 Deerfield Road, east of the east drainage ditch, subject to posting bond for the extension of the sanitary sewer and a covenant that there will be no resubdivision of the larger lot. Trustee Schleicher asked if the subdivider had notified adjoini,ng;property owners of the subdivision. The Village attorney stated he had prepared an affidavit form to be filed by the petitioner, stating that notice had been given to the listed persons. Trustee Schleicher moved, seconded by Trustee Forrest, that the Plan Commission's report be accepted. Motion carried unanimously. Trustee Schleicher then moved, seconded by Trustee Smith, that the matter be placed on the agenda for the next meeting, and the subdivider be notified that he must give notification to adjoinnng property owners that the matter is coming before the Board of Trustees. Motion carried unanimously. No Parking- Greenwood Ave. The manager reported that the State Highway Department will require the adoption of an ordinance to prohibit parking on Greenwood Avenue if Motor Fuel Tax Funds are used for the improvement, and asked that the Village attorney,be authorized to prepare the ordinance. Discussion was had on a hardship to some property owners who have been parking their cars on a gravelled area adjacent to the blacktop, since their lots are not large enough for parking. It was the consensus of the Board that the ordinance prohibitng parking on Greenwood Avenue should not become effective until the new street is cimpleted. The manager will write to the Hi §hway fpartment to ask if the.,c leferred effective date wi 1 1 be satisfactory. Resolution - Permit for Discussion was had on the request of the Deerfield Family DaX Deerfield Family Day Committee to block Parade Request (R-15) traffic on Deerfield and Waukegan Roads for the parade on July 4th and traffic con- trol. The manager reported that he had received a Letter from the State High- way Department stating that permission cannot be givento block off these streets unless the Village submits a request by the adoption of a Resolution; the State will assume no liability; and the Village must direct traffic during the period the streets are blocked. The detour routes were discussed and several changes made on the map prepared by the manager and Police Department. Trustee Smith asked the manager to check to make sure that this additional liability is covered by the Village's insurance. Trustee Craig moved, seconded by Trustee - Forrest, that a Resolution be adopted requesting permission from the Division of Highways to close parts of Deerfield and Waukegan Roads for the July 4th Family Day parade. Motion carried unanimously. Extra Police - Family Day Dr. William Burns, member of the Deerfield Family Day Committee, requested that all available off -duty policemen be assigned to work on July 4th to handle traffic and-maintain order, and employees of the Public Works Depart- ment work with the Park District employees on the clean -up. The manager stated the extra policemen will receive double time pay for holiday work, and questioned the need for all off -duty men. He pointed out that Village employees will clean up the parking lot and Park Avenue, leaving only Jewett Park for the Park District employees. President Finney proposed that it be left to the judgment of the Chief of Police as to the number of extra police needed to properly maintain order and handle traffic, the Board and Dr. Burns concurring. Trustee Schleicher asked the manager to keep a list of costs borne by the Village in connection with Family Day in order that the Village's total contribution may be known. Dr. Burns thanked the Board for its cooperation. The meeting was recessed at 10 :10 p.m. and re- convened at 10 :30 p.m., all members present. Discussion- Entrance Plan Mr. Joseph Jacobs, builder of the North Trail Subdivision North Trail Subdivision, present a drawing showing plans for the North Avenue entrance to the subdivision off Waukegan Road. He proposed to con- struct an illuminated identifying structure on the meridian strip and walls with lights on lots on the northeast and southeast corners. The walls will be on private property, will present no traffic hazard, being only 4 ft. in height, and illumination will be discontinued when building is completed. Discussion was had on Mr. Jacobs' proposal. Trustee Schleicher pointed out that, without doubt, the Village would be asked to maintain the lights after the developer has completed construction, and a precedent may be set if the request is approved. It was suggested that Mr. Jacobs install the standard street light on the meridian strip, tied into the street lighting system, or that electric service be installed for a mercury vapor light on the west side of Waukegan Road opposite the entrance to the subdivision. Vandalism of lights was mentioned as a possibility, with potential hazards to children. Mr. Jacobs asked the Board to accept the general concept of the entrance plan, and stated he would be willing to install service for a light on the west side of Waukegan Road if the installation is not too costly. After further discussion, the Board approved Trustee Raff's suggestion that the matter be tabled and taken up at the next meeting. Cert. of Correction A letter was received from the Easement Deere Park Sub. developer of the Deere Park Sub - division requesting approval of a Certificate of Correction to reduce the utility and drainage easement on the south line of Lot 2 in the said subdivision f rom O� I f. t . Uo 8 ft. The building commissioner stated the development of the three lot subdivision to the north had resulted in changes in drainage and utility construction and the easement was not used. Trustee Craig moved, seconded by Trustee Forrest, that the Certifi- cate of Correction be approved and execution authorized. Sewer that the Village had no record of any agreement providing for reimbursement of part of the cost of the Wilmot,.Road-lwater main extension from Deerfield Road to Central Avenue, and recommended that the ordinance providing for reimbursement of cost of the Wilmot Road Sanitary Sewer (Ordinance No. 0- 66 -23) be rescinded, connections to the said sewer and water mains to be permitted without payment of additional charges. Reports- Communications The manager repotted that Kitchens.of Sara Lee had paid charges of $76.80 for excess BOD content. At Dr. Sundin's suggestion, the Village sewage plant operator is taking samples and testing when it appears necessary. The Sara Lee sewage plant is now discharing only effluent while sludge beds are being built up. The manager reported that inspection of hydrants near Holy Cross School and Church showed the old type hydrants on Elder Lane and Rosemary Terrace. New hydrants have been purchased and will be installed this week. The Fire Chief has inspected hydrants at all schools and recommended that one be installed at the rear of the Alan Shepard School. The Village will install this hydrant with a connection to the Village water main. The manager reported tta t eight commendatory letters had been received from residenisof the Village and others for police services and other matters. The interim census will be started the latter part of July. Two complaints on loud music at the Pink Panther had been handled by the Police Department.. President Finney reported he had received a request.:for action to alleviate the traffic and parking problem on Pear Tree Road which has developed 100 in the last month, probably due to the Boys Baseball program. The manager reported that the Park Superintendent had stated they had no objection to a NO PARKING ordinance, and the Park District plans to construct additional parking space along Wilmot Road. An-,ordiinance prohibiting parking in Pear Tree will be prepared for the next meeting. Trustee Craig suggested the ordinance limit no parking to daylight hours. The manager was directed to notify the people in the area that the matter will be taken up at the next meeting. A complaint was received regarding a garbage truck double parked near the stop lights about 8:15 a.m. on June 4, 1966. The matter was referred to the Police Department. The Village attorney reported that the proposed amendment tc require the Plan Commission to list recommended variations was unnecessary, since Section 9.124 of the Municipal Code requires the Plan Commission to submit such recommendations for variations from the requirements of the Subdivision Ordinance in writing for con- sideration by the Board of Trustees.
