09/20/1965September 20, 1965 The regular meeting of the President and Board of Trustees of the Village of Deerfield was called to order by the President in the Council Chambers of the Village Hall on Monday, September 20, 1965 at 8 :10 p.m. The clerk called th a roll and reported the following were Present: H. Ross Finney, President Bernard Forrest George P. Schleicher Ellis W. Smith James M. Wetzel and that a quorum was present and in attendance at the meeting. Also present were Messrs. Richard Houpt, Village attorney, and Robert Bowen, Building Commissioner, acting as Village manager, Moved by Trustee Smith, seconded by Trustee Schleicher, that minutes of the regular meeting held September 7, 1965 be approved as submitted. Motion carried unanimously. Winer 385.00 Zep Manufacturing 8.41 Trustee Wetzel moved, seconded by Trustee Schleicher, that the payroll for the month of August be approved, and the bills as listed above be approved for payment. Adopted by the following vote: Ayes: Forrest, Schleicher, Smith, Wetzel (4) Nays: None (0) Approve Definition. Discussion was had on the definition " 1 /2 Story" of '?one-half story", an amendment to the Zoning Ordinance recommended by the Plan Commission. Trustee Schleicher moved, seconded by Trustee - Forrest, that the Board accept the recommendation of the Plan Commission and the Village attorney be directed to prepare the amending ordinance. Motion carried unanimously. Re: Hovland Improvements President Finney reported he and Trustees Schleicher, Wetzel, Smith and Raff had met with Hovland residents to discuss the proposed im- provements for Hovland Subdivision by special assessments. In the fruitful discussion, it was evident that the people now realize it is not any easy problem to resolve, but the Board has their welfare in mind. Trustee Schleicher asked the Building Commissioner to prepare a map for each Board member, showing the proposed improvements and the amounts assessed against each property, since it was the opinion of the residents that there were inequities in the assessments. Approve Sewer Extension A letter was received from Mr. James Coleman - 343 Fairview Coleman requesting permission to install a sanitary sewer to serve his property at 343 Fairview Avenue, his neighbor having agreed to this installation on a cash basis. Discussion was had on the request, and it was pointed out.that the size of the sewer must be adequate to permit future extensions. The Village attorney stated the sewer ex- tension would not adversely affect the proposed Hovland Special Assess- ment project. Trustee Smith moved, seconded by Trustee Forrest, that the engineer be authorized to prepare plans and specifications for the sewer extension requested by Mr. Coleman. Motion carried unanimously. Annexation Ordinance Trustee Forrest moved, seconded by Zartler -1454 Wilmot Trustee Smith, that the ordinance be 0 -65-38 adopted annexing the Zartler property, 1454 Wilmot Road, described as follows: The North 210 feet of the East 623 feet of the South 15 Acres of the Northeast Quarter of the Northeast Quarter of Section 30, Township 43 North, Range 12, East of the Third Principal Meridian. 1 1 1 271 Adopted by the following vote: Ayes: Forrest, Schleicher, Smith, Wetzel, Finney (5) Nays: None (0) The President signed the ordinance indicating his approval thereof. Ordinance - No Parking Zone Trustee Waukeqan at Orchard (0- 65-39) Trustee adopted Municipal Code to prohibit parking on the a point 64 feet south of the center line to the intersection of Waukegan Road and the following vote: Ayes: Forrest, Schleicher, Smith, Wetzel Nays: None (0) Schleicher moved,,seconded by Smith, that an ordinance be amending Section 20.501 of the east side of Waukegan Road from of Orchard Street northward Orchard Street. Adopted by (4) The President signed the ordinance indicating his approval thereof. Approve Scatterwood West The Scatterwood West Subdivision plat 'Subdivision Plat was presented for approval. Discussion was had on the maintenance of the ease- ment providing access to the Furo property. Mr. Kennedy assured the Board that gravel would be spread as soon as the weather permits, to afford a passable surface, and the easement would be paved next spring. Trustee Schleicher then moved, seconded by Trustee Smith, that the plat be approved and execution authorized. Adopted by the following vote: Ayes: For.rest:r,�SShleicher, Smith, Wetzel (4) Nays;. None (0) Approve BZA Report Vetter Variation seven dwelling units on Waukegan Road and Hazel parking or the cons.truc property. The report of the Board of Zoning Appeals was read, recommending that a variation be granted to permit the construction of the Vetter property at the wouthwest corner of Avenue, and a covenant be obtained to preclude tion of any structure on the west 30 ft. of the A lengthy discussion followed, in which it was pointed out that the seven units appeared to be a reasonable compromise in granting relief from the requirements of the Present ordinance, and was in conformance with the Mokrasch variation to permit the construction of six units on a lot approximately 12,000 sq. ft. in area, or 2,000 sq. ft. of lot area per dwelling unit. Mr. Richard Ross, attorney for the petitioner, stated his client had petitioned for 1500 sq. ft. of lot area per dwelling unit, but was willing to accept 8 units, and would dedicate of give a covenant for the west 30 ft. as recommended by the Board of Zoning Appeals. He added that the Mokrasch variation had been graated on a petition for six units, and at no time had 2,000 sq. ft. of lot area ,per dwelling unit been mentioned. The meeting was recessed at 9:30 p.m., and re- convened at 9:40 p.m. Trustee Smith moved, seconded by Trustee Wetzel, that the Board concur in the recommendation of the Board of Zoning Appeals that a variation be granted to- permit construction of seven units on the Vetter property, with a covenant on the west 30 ft., and the attorney be directed to prepare the ordinance. Adopted by the following vote: Ayes: Forrest, Schleicher, Smith,. Wetzel (4) Nays: None (0) Time Limit on Variations In answer to Trustee Forrest's question, the Village attorney stated that a time limit could be set in an ordinance granting a variation, during which period an application for a building permit under the terms of the variation must be filed. An amendment to the Zoning Ordinance would be required. Trustee Forrest moved, seconded by Trustee Schleicher, that the attorney prepare the proposed amendment, to be referred to the Plan Commission for a public hearing. The President reported the Safety Council felt there was no need for is on the Greenwood Avenue ;traffic and pedestrian reviewing the Police survey and the manager's improvements and sidewalks were in the planning A letter from the Village attorney stated that the Village can establish speed limits of more or less than the 30 miles per hour set by the State on local streets without State approval, after a traffic study and engineering investigation. This provision does not apply to State roads, such as Waukegan Road. Other conditions, such as schools, number of houses and other factors are used in determining a proper speed limit, he said. The Building Commissioner stated the State furnishes forms to be used in making a traffic study, and agreed to summarize the informa- tion to be used in establishing speed limits, for review by the Board. He stated a traffic count was being made at Waukegan Road and Green- wood Avenue as a result of complaints from people who find it difficult to turn onto Waukegan Road due to the continuous flow of traffic. 1st Presentation - Ordinance The first presentation was made of Municipal Leasing Tax an ordinance establishing a 1/2% municipal leasing occupation tax. Authorize Issuance of A letter was received from Padden and Bonds - S/A #101 Company, Inc. the holders of Vouchers 5, 6 and 7, issued to the contractor for the construction of the Greenwood Interceptor Storm Sewer, Special Assessment No. 101, requesting that bonds be issued to replace said vouchers. Trustee Schleicher moved, seconded by Trustee Smith, that the issuance of bonds for Special Assessment No. 101 ne approved. Adopted by the following vote: Ayes: Forrest, Schleicher, Smith, Wetzel (4) . Nays: None (0) Approve Sale of Loader to A communication from the manager Park District - $1200 stated the Park Board had offered $1200 for the Village loader following an offer to sell for $1500. Trustee Schleicher moved, seconded by Trustee Forrest, that the Board authorize the sale of the loader to the Deerfield Park District for $1200. Adopted by the following vote: Ayes: Forrest, Schleicher, Smith, Wetzel (4) Nays: None (0) Concur in Contract Award A letter was received from the Lake Cedar St. Bridge County Highway Department with a tabulation of bids for the construc- tion of the Cedar Street bridge, and stating the County Board of Supervisors had awarded the contract to Engelhart, Inc. of Libertyville, the low bidder, at the bid price of $31,754.90, subject to approval of the State Department of Highways, and the concurrence -of the Village Board. Trustee Schleicher moved, seconded by Trustee Smith, that the Board concur in the award of the contract to Engelhart, Inc. Adopted by the following vote: Ayes: Forrest, Schleicher, Smith, Wetzel (4) Nays: None (0) Approve Annexation Berkley Court Court between Wilnot and the installation requested to prepare missioner was direct, A letter was received from Mr. Theodore Pryst, Glenview, requesting the Village Board to annex Berkley Road and Carol Lane, for purposes of access of sewer and warer mains. The attorney was the annexation ordi nance,, and, the Building Com- ad to submit all pertinent date to Board members. 273 Decision was made that no action be taken, pending final inspection, on the request of Kennedy Development Company for Village acceptance of a maintenance bond for Units 2, 3 and 4, Colony Point Subdivision, to replace the 10% cash escrow retained by the Village. Waive $80 Inspection Fee Discussion was had on the waiver of ride Beth Or Fun Fair Rides inspection fees for the Beth Or Fun Fair. Trustee Schleicher suggested that a reasonable inspection of aircraft be made by Village personnel if helicopter rides are offered next year. President Finney asked that the Park District be advised that the Village should be hotified when similar rides have been approved by the Park Board, since theVillage may have some liability. Trustee Smith suggested the matter be checked with the insurance company. Trustee Schleicher moved, seconded by Trustee Smith, that the inspection fees for the Fun Fair rides be waived. Adopted by the following vote: A report was received from the Village manager, stating the Village had been named a part to the law suit filed by Bowler and Paoli vs Peter Waytula t Son, devil opers of the Lake Eleanor Subdivision. The matter was referred to the Village attorney. Approve Payment $25556.40 Trustee Wetzel moved, seconded by Trustee Clavnia Escrow Schleicher, that payment of $25,556.40 be approved from the Clavinia Subdivision Unit #2 escrow account to C.B. Construction Company for underground improve- ments constructed in said subdivision, as recommended by the engineer. Adopted by the follawi;gg vote: Ayes: Forrest, Schleicher, Smith, Wetzel (4) Nays: None (0) Reports - Communications The President reported a letter had been received from the Foundation for Freedom of Democracy in Residence, and asked that a copy be sent to the Chairman of the Human Relations Committee. President Finney reported he had learned that the Presbyterian Church cannot dedicate land for the proposed street to open up parking areas, but could grant an easement for that purpose. The attorney stated a perpetual easement would have ehe same effect as a dedication. Decision was made that the manager, attorney and church representatives meet to discuss the matter in the interest of expediting a decision as to whether to proceed with the condemnation of the Broege property. Ayes: Forrest, Schleicher, Smith, Wetzel (4) Nays: None (0) �l Complaints, Kenton Rd. Speeding Two letters were received from residents � =1 of Kenton Road, complaining of excessive speed and suggesting that 4 way stop signs be erected at Kenton and Margate, C;) to slow down traffic. The Police Department has checked accidents at this intersection, and reports one accident in 1960, two in 1962, one in 1964 and two in 1965. The Building Commissioner reported that he, the Chief of Police and the Superintendent of Public Works had been making a survey of the Village for purpose of traffic sign installations, with particular attention to areas near schools, and a report and recommendations would be submitted shortly. Trustee Schleicher urged the continuance of maximum Police Department patrolling for strict enforcement of speed laws. The letters were referred to the Safety Council, and the Building Commissioner was directed to write to the complainants telling them what is being done to improve traffic safety. Reports - CommunicatIons A letter was received from Charles W. Greengard Assoccates regarding Special Assessment No. 101 construction, and stating that all waivers and affidavits had been received. A report was received from the Village manager, stating the Village had been named a part to the law suit filed by Bowler and Paoli vs Peter Waytula t Son, devil opers of the Lake Eleanor Subdivision. The matter was referred to the Village attorney. Re: Lake County Zoning The clerk reported a copy of the Amendment proposed Comprehensive Amendment to the Lake County Zoning Ordinance had been received, and the provisions which had been objected to by Deerfield residents were unchanged. A final hearing on the proposed ordinance is scheduled for September 30, 1965. Discussion was had, and it was decided that the Building Commisstoner should obtain copies of the proposed amendment for review by the Plan Commission and Board members. Trustee Schleicher and the clerk will draft a resolution objecting to certain pro - visi-ons of the ordinance for consideration by the Board at an adjourned meeting. Trustee Forrest asked that a report on downspout disconnections be prepared for the next regular meeting. Trustee Forrest moved, seconded by Trustee Schleicher, that the meeting be adjourned to Monday, September 27, 1965-at 8 :00 p.m. Carried unanimously.
