05/17/19652 17' May 17, 1965 The regular meeting of the President and Board of Trustees of the Village of Deerfield was called to order by the President in the Council Chambers of the Village Hall on Monday, May 17, 1965 at 8 :30 p.m. The clerk called the roll and reported the following were Present: H. Ross Finney, President Raymond L. Craig Bernard Forrest Charles H. Raff George P. Schleicher Ellis W. Smith James M. Wetzel Absent: None and that a quorum was present and in attendance at the meeting. Also present were Messrs. Byron Matthews, Village attorney, and Norris Stilphen, manager. Moved by Trustee Smith, seconded by Trustee Raff, that minutes of the,regular meeting held May 3, 1965 be approved as submitted. Motion carried unanimously. Bids - Police Cruisers Sealed bids for four Police cruisers were opened and read as follows: BIDDER BID TRADE -IN NET BID ALT. BID Shoreland Ford $ 9,145.40 $ 1,050.00 $ 8,095.40 $ 8,489.20 Evanston Dodge 8,893.82 1,000.00 7,893.82 8,244.82 * Alternate bids include power steering and special brakes Accept Bid Evanston Dodge TrusteeSchieicher moved, seconded by Trustee Forrest, that the low bid of Evanston Dodge be accepted at the bid price of $7,893.82 for four Police cruisers. Adopted by the following vote: Ayes: Craig, Forrest, Raff, Schleicher, Smith, Wetzel (6) Nays: None (0) Ordinance - Variation 6 Apts. The ordinance was read granting a variation Mokrasch (0- 65 -13) from the requirements of the Zoning Ordinance to permit the construction of six dwelling units on Lot 11, Duffy's Subdivision (Mokrasch property), with a side yard on Elder Lane of 25 ft. Trustee Smith moved, seconded by Trustee Craig,-,that the said ordinance be adopted. Upon roll call the ordinance was passed by the following vote: Ayes: Craig, Forrest,.Raff, Smith, Wetzel (5) . Nays: Schleicher (1) The President signed the ordinance indicating his approval thereof. Ordinance - 2 Hour Trustee Schleicher moved, seconded by Trustee Parking - Waukegan Rd. Smith, that the ordinance be adopted making it 0 -65 -14 unlawful to park any vehicle for more than two hours on either side of Waukegan Road between the north line of Osterman Avenue and a point 405 feet north thereof. Adopted by the following vote: Ayes: Craig, Forrest, Raff, Schleicher, Smith, Wetzel (6) Nays: None (0) The President signed the ordinance indicating his approval thereof. 218 Ordinance - Zoning Amendment The ordinance was read amending Petersen Tract to R -1 -A the Zoning Ordinance by classifying 0 -65 -15 the Petersen tract located on the east side of Waukegan Road between the High School and North Avenue as an R -1 -A District except that part lying south of North Avenue, which will remain in the R -1 District. At the suggestion of Trustees Schleicher and Raff, an addition was made to the ordinance, to specify Nbrth-,Avenue as shown on the preliminary plat of subdivision dated April 28, 1965. A lengthy discussion was had on the proposed rezoning. The re= location of North Avenue in relation to the County's grade separation at Waukegan Road and North Avenue was mentioned. Trustee Schleicher recommended that no action bfU ken on the petition at this time, since sewerage facilities are presently overloaded during periods of storm water flow, as shown in the Baxter and Woodman report dated June 11, 1964. He urged that a target date be established for completion of the downspout disconnection program and separation of sewers in the business district before any properties are rezoned to increase the intensity of land use, and add to flooding problems. Expressions of opinion, pro and con, were voiced by residents. Mr. Karl Berning, Rosemary Terrace, spoke of his problem of basement flooding, and stated the Board's responsibility was to the residents of the Village rather than to a developer. Trustee Wetzel urged that the devel'oper's agreement with the Park District to contribute $25,000 in lieu of land for public use, be set aside 'and that amount be used to increase'lot sizes. The developers and their attorney state approxi- mately $100,000 would be expended in excess of normal subdivision costs, including school and park demands, a ]aft station, an 80 ft. street dedication, and a large storm sewer to divert storm water originating on other properties. They also stated funds contributed to the Park District were not earmarked for any particular project, but it had been indicated by the President of the Park District that trucks and tractors would be purchased for use in the improvement of other park lands. Trustee Raff then moved, seconded by Trustee Smith, that the ordinance be adopted rezoning the Petersen tract to the R -1 -A District except that portion lying south of the relocated right -of -way of North Avenue. Adopted by the following vote: Ayes: Craig, Forrest, Raff, Smith, Wetzel (5) Nays: Schleicher (1) in voting Aye, Trustee Wetzel again urged that the $25,000 to be given to the Park District be used to increase lot sizes. The President signed the ordinance indicating his approval thereof. The meeting was recessed at 9:45 p.m. and reconvened at 9:50, all members present. Authorize Condemnation Broege Property their property at 802 Deerfield Trustee Smith, that the Village condemnation proceedings for th, by the following vote: The manager reported Mr. and Mrs. Robert Broege - had rejected the Village's offer of $45,000 for Road. Trustee Craig moved, seconded by attorney be authorized to institute acquisition of the property. Adopted Ayes: Craig, Schleicher, Smith, Wetzel (4) Nays: Forrest, Raff (2) Approve Preliminary Plat The preliminary plat of Dempster Dempster Home Devel. Sub. Home Development Subdivision was reviewed, all lots meeting the 9,000 sq. ft. area requirement, exclusive of the 25 ft. easement pro- vided for access. Following discussion of improvements, Trustee Raff moved, seconded by Trustee Wetzel, that the preliminary plat bf Dempster., Home Development Subdivision be approved with the understanding that the 219 easement will be improved with a street meeting Village standards, except for width, and no sidewalks would be required. Adopted by the following vote: Ayes: Craig, Forrest, Raff, Schleicher, Smith, Wetzel (6) Nays: None (0) Resolution Opposing H.B. 1374 Trustee Schleicher presented and read (R -65 -12 ) a resolution opposing House Bill 1374 authorizing the creation of Refuse Disposal Commission, and which, in conjunction with House Bill 1385 and Senate Bill 800, would permit the operation of a land fill on the National Brick Company property. He then moved, seconded by Trustee Wetzel, that the said resolution be adopted and the Village Clerk file a copy with the Municipalities Committee in Springfield at the hearing scheduled for the following day, May 18. Motion carried unanimously. President Finney stated that as a result of the meeting with the Human Relations Commission, a statement of policy had been prepared, as follows: STATEMENT OF POLICY "all people should have equal access to all housing in all communities without regard to race, color, creed or national origin." While there is no legal requirement that any citizen open his home or provide information to the representatives of the Project, we are confident that the community will treat such representatives with courtesy and respect. Report - Downspout Disconnections The manager reported that, of the 155 homes found to be contributing storm water to the sanitary sewer system, 63 owners had disconnected, 18 had signed releases, 3 had agreed to sign releases, 25 had been notified with- in the last six weeks, 8 had disconnected except for one downspout, 3. would do the work themselves, one will be re- tested, one has started to disconnect, 3 had certain problems, and two were set for court hearing on May 24, 1965. BZA Report - Presbyterian Sign A report was received from the Board of Zoning Appeals recommending that a variation be granted to permit a church identification sign with the letter area of 20 sq. ft. to be mounted on an existing wall 3 ft. in height, as requested by the Presbyterian Cburch. Trustee Schleicher moved, seconded by Trustee Forrest, that the Board accept and approve the recommendation of the Board of Zoning Appeals. Rehearing on Townhouse Devel. The report was received from the Wilson - Weigle Property Plan Commission on the proposed townhouse development on the Wilson - Weigle property. On advice of the.Village attorney, the Plan Commission will be requested to re- advertise and hold a second public hearing. 1st Presentation - Ordinance Congregational Church Conditional Use religious purposes on Lots 147, 148, of Lot 150, J. S. Hovland's Addition the Congregational Church. 1st Presentation - Ordinance Municipal Code Amendment Re: Board of Zoning Appeals Board of Zoning Appeals. The first presentation was made of an ordinance granting a Con- ditional Use for the construction of a church and buildings for part of Lot 149, and the East 1/2 to Deerfield, as petitioned by YThe first presentation was made of an ordinance .amending the Municipal Code of Deerfield of 1963, Section 8.1002, relating to meetings of the Annexation Petition The manager reported he had received an annexation petition from Mr. Erick J. Beisswenger, 1232 Wilmot Road, and stated that additional petitions were expected shortly. The petitions result from last year's Court decision which will permit the Village to discontinue water service to premises outside the Village. The Village attorney was requested to prepare an annexation ordinance for the Beisswenger property and any other properties for which annexation petitions are received. Resolution - Prevailing Trustee Smith moved, seconded by Wages (R- 65 -13) Trustee Forrest, that the resolution be adopted establishing prevailing wages to be paid for public work construction in the Village of Deerfield coming under the jurisdiction of the President and Board of Trustees. Motion carried unanimously. Accept N.S. Uti 1 i ti.es. Bi:d Air Conditioner Repair $886.70 Crown Temperature North Shore Utilities Two bids were received for air conditioner repairs, as follows: Parts S labor $ 890.00 Parts.& labor 886.70 Discussion was had on the advisability of repairing the present unit or installation of a new air conditioner. Mr. Richard Gilbert, Central Avenue, stated the parts listed in both bids were made by reputable companies, but suggested the contractors be checked. Trustee Schleicher then moved, seconded by Trustee Wetzel, that the low bid of North Shore Utilities be accepted at the bid price of $886.70, subject to the discovery of adverse information. Adopted by the following vote: Ayes: Craig, Forrest, Raff, Schleicher, Smith, Wetzel (6) Nays: None (0)' Approve Sewer Application Trustee Smith moved, seconded by Broms Subdivision Trustee Raff, that the President and Clerk be authorized to sign the application to-the:State Sanitary Water Board for a permit for the extension of the sanitary sewer to serve the Broms Subdivision. Motion carried unanimously. 1st Presentation - Ordinance The first presentation was made Broms Recapture Agreement of an ordinance establishing special connection charges to be collected by the Village and paid to Bremco Builders, Inc.'(Broms) for connection to sewer and water mains installed by the said builders to serve the Broms Subdivision. J 1 221 Resolution Accepting Easement Trustee Smith moved, seconded by Trustee Broms Subdivision (R- 65 -14) Craig,.that a resolution be adopted accepting easements granted by the Zion Evangelical Lutheran Church, David and Catherine Dover, and Shirley and John Derby, for the installation of a sanitary sewer line to serve the Broms Subdivision. Adopted by the following vote: Ayes: Craig, Forrest, Raff, Schleicher, Smith, Wetzel (6) Nays: None (0) Sewer Charges H. P. Residents A lengthy discussion was had on the question of sewer service charged billed to Highland Park residences served by the Deerfield sewage treatment plant. The Highland Parkers object to the rate which is three and one half times the charge to Deerfield residents. Trustee Schleicher moved, seconded by Trustee Forrest, that the billings be continued at the rate established by ordinance, and the manager continue to negotiate with Highland Park for an amicable settlement of the problem. Motion carried unanimously. ,..:� The Village attorney reported the trial would begin on May 24, 1965 in the case Sheridan vs. Village of Deerfield, a suit for a declaratory judgment U to permit the construction of a gas station at the northwest corner of Deerfield V and Wilmot Roads. Receipt was acknow4dged of the annual report of the Police Pension Fund. Communications A letter was received from Mr. Richard Houpt, special counsel for the Village of Riverwoods in the Freeden Buiten case, requesting the Village of Deerfield to urge the State's Attorney to appeal the Court's decision with respect to the one mile limitation on dumping garbage by sanitary land fill. Trustee Wetzel moved, seconded by Trustee Raff, that the Village attorney contact the State's Attorney requesting an appeal in the Freeden Buiten case. Motion carried unanimously. A letter was received thanking the Village for trucks sent to Island Lake to assist in the cleanup after the tornado. President Finney reported he had received letters from Senator Robert Coulson, and Representatives Daniel Pierce and Howard Slater regarding bills introduced in the General Assembly which are opposed by the Village. The President asked the Village attorney, who will be in Springfield on May 18th, to attend the hearing on House Bills 1374 and 1375, and speak in opposition to these bills relating to refuse disposal commissions and County acquisition of refuse disposal sites. The manager reported a letter had been received from the North Shore Gas Company, offering a five cent (50 per capita allowance if the franchise is extended to 1993. A projection of population and allowances was included. Trustee Raff suggested the allowance be adjusted on the basis of census reports. The attorney stated a question had arisen in connection with the bond for a hour moving permit, and suggested the Board could approve the permit subject to the Village attorney's approval of bond or certificate of insurance. Trustee Schleicher proposed that the insurance agent for the Village be requested to give his opinion on the,;matter, and if both'the agent and attorney were satisfied, the Building Commissioner -be authorized to issue the permit for moving the house. Trustee Schleicher asked that the Board direct the Village manager to get toggether all pertinent background informati.on on sewer separation in the Central Business District, since it is important that the Board take positive action to relieve overloading at the sewage treatment plant.
