Adopted by the following vote: Ayes: Lindemann, Mandler, Schleicher, Wetzel (4) Nays: Nond (0) Re: Annexation Agreement Proposed agreements between the Village Soil Testing Tract of Deerfield and LaSalle National Bank, as-Trustee under Trust No. 29897, and Chicago Title and Trust Company, as Trustee under Trust No. 43970, (Soil Testing) were presented and discussed briefly. The attorney was requested to review the agreements and report to-the Board at its next meeting. Report- Downspout Disconnections The manager reported that, of the 125 homes found to be contributing storm water to the sanitary sewer system, 48 had disconnected downspouts. He stated that all owners had been called at least 6 times, in addition to letters sent. As a result of these calls, some owners have asked for more information, some asked for an extension of time in which to dis- connect, but some have refused to take any action. He stated 95 more homes had been smoke tested and 19 found to be contributing storm water,' however, these were not included in the report since sufficient time had not elapsed since notification. He added there were a few cases where hardship would result from disconnection of all downspouts, since water would flow into the building. Trustee Lindemann stated that he felt it was unfair to other taxpayers to permit 6 or 7 calls to be made by the Superintendent of Public Works or other Village employees. Mr. Matthews advised the Board that persons refusing to disconnect could be taken to court. Trustee Wetzel suggested the 48 persons who have cooperated with the Village be commended by publishing names and addresses, and felt this might have -a beneficial effect in securing the compliance of those who have taken no action. President Hearn pointed out the matter of flooding was a serious health problem, and suggested that the Board give considera- tion to authorize Village employees to disconnect downspouts provided the homeowner signs a release to be prepared by the attorney, absolving the Village'f rom any claim resulting from the performance of this work. Discussion was had on the President's proposal, and it was the consensus 1 1 1 157 of the Board that the homeowner should pay a reasonable charge for material and labor, in fairness to those who had done the work themselves. The manager was directed to prepare schedule of charges for disconnection. Trustee Schleicher moved, seconded by Trustee Mandler, that a report be made to the public on the progress of the downspout dis- connection program, listing those who have complied as well as those who have refused.. The President signed the resolution indicating his approval thereof. North Shore Gas Agreement An agreement between the Village and Gas Street Light Maintenance North Shore Gas Company was read in full, providing for maintenance of gas street lights by the company at a cost of $.85 per lamp per month, and setting forth the gas rate applicable for street lighting service. Trustee Wetzel moved, seconded by Trustee Lindemann, that execution of the agree- ment with North Shore Gas be authorized. Adopted by the following vote: Ayes: Lindemann, Mandler, Schleicher, Wetzel (4) Nays: None (0) The President signed the agreement. Approve Specs. Gas Specifications for gas yard lights Yard and Street Lights to apply only to Colony Point Subdivi- sion, and specifications for gas street lights applicable throughout the Village were presented. Trustee Mandler moved, seconded by Trustee Schleicher, that the specifications be approved as presented. Motion carried unanimously. Ordinance - Footing Drain Trustee Mandler moved, seconded by Connections (0-64-51) Trustee Schleicher, that the ordinance be adopted amending Section 24.409 of the Municipal Code of 1963 to permit the discharge pipe from a sump pump connected to footing drains to be connected to storm sewers. The ordinance was adopted by the following vote: Ayes: Lindemann, Mandler, Sch.}eicher, Wetzel (4) Nays: None (0) The President signed the ordinance indicating his approval thereof. Motion carried unanimously. A letter was received from Mrs. Wayne Cole of the Water Resources Committee of the League of Women Voters, requesting that the accompanying leaflets on Clean Water be made available to the public at the lobby c counter. The President directed the manager to acknowledge Mrs.-Cole's letter, expressing appreciation for the leaflets. Zoning Amendment - "M" The ordinance amending the Manufactur- Regulations (0- 64 -50) ing District regulations of the Zoning Ordinance was read in full. After review of the changes by the Building Commissioner, Trustee Mandler ?j moved, seconded by Trustee Wetzel, that the said ordinance be adopted. The Plan Commission Chairman stated the Commission felt such signs were undesirable, and therefore were prohibited. The attorney was requested to prepare an additional paragraph to permit temporary non - commercial signs and banners for the United Fund and similar agencies. Trustee Mandler suggested the cooperation of all gas stations be sought to eliminate the display of streamers. Ordinance - Sideyard Variation Trustee Mandler moved, seconded by 1705 Cranshire (0- 64 -52) Trustee Lindemann, that an ordinance be adopted granting a variation from the terms of the Zoning Ordinance to permit a side yard of six feet eight inches at 1705 Cranshire Court, in accordance with the recommendation of the Board of Zoning Appeals. Ordinance - Discharge of Trustee Mandler moved, seconded by Firearms (0- 64-53) Trustee Wetzel, that the ordinance be adopted amending Section 28.018 of the Municipal Code of 1963, pertaining to the discharge of firearms'in the Village. Deny Elm St. Rezoning The report of the Plan Commission was . read, recommending denial of the petition of Elm Street residents for rezoning to the R -6 two family or R -7 multiple family district. The Planning Consultant's recommendations accompanied the report. The Commission recommended that the Board under- take a program of neighborhood improvement to justify continuation as a single family residence district as follows: 1. Village arrange with vacant property owners on east-side of Elm Street for the Village to clean up and maintain this property in a pleasant and presentable condition. 2. The Village should institute a program of education for employ- ees so as to reduce the adverse effects of the.heavy traffic of Village vehicles. 3. Village should discontinue storage of sewage sludge at the Village garage. 4. Village should redouble its efforts to control any adverse odors created at the sewage treatment plant. 5. Village should take steps to improve the condition of the streets and sidewalks at Village expense. 6. Village should contact the Milwaukee Railroad to see what can be done to minimize or eliminate the adverse effects created by the constant operation of the railroad engines parked at the siding opposite Elm Street. 1 1 1 Trustee Mandler moved, seconded by Trustee Lindemann,•that• the Plan Commission's report be approved and the petition for rezoning be denied.- Motion carried unanimously. Discussion was had on what could be done to carry out the Plan Commission's recommendations for upgrading the Elm STreet area. The manager stated Elm Street provided the only means of access to the Village garage, and little could be done to remove this traffic; storage of sewage sludge at the garage had been discontinued, and the Board had already authorized action to reduce:or eliminate sewage plant odors. He proposed that sidewalk repairs or replacement be accomplished under the'50 /50 sidewalk program, and added that Elm Street had been oiled during the, past summer. The abandoned residence will be burned by the Fire Department. The manager was directed to write to the Milwaukee Railroad asking their cooperation in reducing noise, which will improve the appearance of the neighborhood. President Hearn proposed the Elm Street area be made .the subject of a workshop meeting. Report - Sara Lee Sewage The manager read a letter from Kitchens of Sara Lee thanking Village employees for their cooperation in working with the company on its sewage problems, and assuring the Board that the company had entered on a crash V• program to reduce the BOD of sewage to Village standards. V The President's letter to Kitchens of Sara Lee was, then read, review- ing the events leading up to the position the Board must now take, I.E., as of January 1, 1965, the Village Board will fine the Kitchens of Sara Lee $500 per day for each day the company's sewage exceeds the BOD of 300 ppm. Approve Permit South Park Trustee Schleicher moved, seconded School Addition by Trustee Wetzel, that the Board ratify . the issuance of the Building Permit for the South Park School addition, as requested by the Building Commissioner. Motion carried unanimously. Accept Underground Improvements Trustee Wetzel moved, seconded by We -Go -Park Subdivision Trustee Schleicher, that the under- ground improvements in We -Go -Park Subdivision be accepted, subject to a one year maintenance guarantee, as recommended by the Building Commissioner. Motion carried unanimously. Authorize Application County Line Road Sidewalks permit for construction of the Motion carried unanimously. Trustee Wetzel moved, seconded by Trustee Schleicher, that the Board authorize the execution of the Highway sidewalk on County Line Road. 1.59 The manager reported that it appeared the efforts of Sara Lee to reduce BOB content were proving effective, however no definitive reports were available. The President asked that the Board be kept informed of current progress. Bd. Of Zoning Appeals Report The report of the Board of Zoning Mokrasch Variations Appeals was read, recommending that a variation be granted to permit the 69 foot lot at the southeast corner of Waukegan Road and Elder Lane to be used for a multiple family dwelling, and further recommending denial of variations from sideyard and lot area per dwelling unit requirements, as requested by Dr. Frederick Mokrasch. A letter was received from Mr. Richard Ross, attorney for Dr. Mokrasch, setting forth his client's case, add requesting the Board withold action at this time. Mr. Ross stated he would have sketches prepared showing proposed construction. Decision was made that action on the matter be deferred until the Board has reviewed develop- ment plans for the property. -The Building ommissioner was asked to prepare a rough sketch showing possible layouts of buildings on the site. Approve Permit South Park Trustee Schleicher moved, seconded School Addition by Trustee Wetzel, that the Board ratify . the issuance of the Building Permit for the South Park School addition, as requested by the Building Commissioner. Motion carried unanimously. Authorize Attorney to Defend A letter was received from &he Village Liebling Appeal attorney stating that Mr. Arnold Liebling had filed a notice--of appeal from the decision of the Supreme Court in his case against the Village, in which he contends the Village was,prevented from passing the ordinance rezoning his property. Trustee Schleicher moved, seconded by Trustee Wetzel, that the Board authorize the Village attorney to def ned this appeal. Adopted by the following vote: Ayes: Lindemann, Mandler, Schleicher, Wetzel (4), Nays: None (0) The manager reported the Plan Commission and Park Board had discussed construction of an access road to the Liebling property through Park District property by an exchange of lands, and if this were to be accomplished, the appeal would be disposed of. 1st Presentation - Bldg. Code Amendment fore adopted by reference as the code except one or two family dwellings. The first presentation was made of an ordinance amending Section'402.39 of the National Building Code, hereto - for construction of all building Safety Council Report A report was received from the Safety Re: Waukegan - Deerfield Council recommending that the Chief Intersection of Police be instructed to enforce the law pertaining to pedestrian right -of -way at the Deerfield - Waukegan Road intersection, bnd,proposing that warning tickets or non - moving (parking) violations tickets be issued to drivers who fail to yield right -of -way to pedestrians. The Council also stated that ultimately parking must be prohibited within 300 ft. of the intersection to promote better traffic flow. The manager was directed to discuss the Council's recommendation with the Chief of Police. Re: Legal Publication and taxpayer, asked why the Board savings which would result from p Star, the Village attorney having ments for such publication. Mr. Frank Duffy, 1715 Garand Drive, who identified himself as a resident had not taken advantage of the 45 percent iblication of legal notices in the Deerfield reported the Star met statutory require- A lengthy discussion ensued in which Mr. Norman Hirsch, publisher of the Star, pointed out the Star was delivered to every home in Deerfield, thus insuring that legal notices would reach more people than the Deerfield Review. He presented brochures to Board members giving data on paid circulation and national experience on 'controlled circulation' vs. ABC publications. Mr. John Brunner, of the Lerner Community Newspapers, spoke on the circulation of their group of Chicago area newspapers, which included several ABC papers now behng changed to "controlled circulation'!. It was pointed out by President Hearn that one consideration given by the Board in awarding publication of legal notices to the Deerfield Review was the fact that local business men used the Review for advertising. Messrs. Robert Lipson and John Foster, both local residents and both in the advertising field, stated that in the matter of legal notices, the Board was not dealing with advertising efficiency, and that with adequate circu- lation in the community, cost should be the determining factor. Trustee Schleicher stated the purpose of legal publications was to put the public on notice, and that, as a member of the Finance Committee, he was unequivocally in favor of competitive bids for material and services. He proposed that the Board consider draw up specifications for publications to run for the next fiscal year. Trustee Wetzel stated the Board's decision was not made on the basis of cost, but on the basis that the Review, i,n the opinion of the Board, had greater acceptance by Village residents, and there was an obligation on the part of the Board to publish notices in a paper that had wider constant circulation. 1 1 161 President Hearn stated that, although he was paying the monthly charge for the Star, delivery was not regular and he often had to purchase a copy in one of the Village stores. Mr. Duffy re- stated his original question, and President Hearn asked if any Trustee wished to move that the Board reverse its decision that notices be published in the Review. There being no motion, President Hearn stated he felt the subject had been adequately discussed. A letter was received from the Lake County Safety Commission stating they were pleased that all members of the Deerfield Police Department had completed the special training program. Authorize Labor Costs The manager reported the #110 School South Park School Drainage Board plans to improve the parking lot at South Park School with swaled drainage, and the Building Commissiore r had suggested that drain tile be installed to carry surface water to the storm sewer on Hackberry Road. He suggested that if the School bought the pipe, Village employees could install the pipe as a joint project, if the Hovland Special Assessment project was not underway in time to permit connection to the new storm drainage system. Trustee Wetzel moved, seconded by Trustee Lindemann, that the Board authorize Village Ln employees to install pipe as a joint School - Village projecr,'i'f necessary. Hazel Ave. Improvement Greengard Associates, recommending the final payment of $18,810.€30 to E. A. Meyer Construction Co. for Hazel Avenue improvements. Trustee Mandler moved, seconded by Trustee Lindemann, that the payout of $18,810.80 from escrow funds be authorized to E. A. Meyer Construction Co., as recommended by the engineer for the project. Adopted by the following vote: Ayes: Lindemann, Mandler, Schleicher, Wetzel (4) Nays: None (0) Insurance Coverage Mr. Herbert Byard, who is the agent Sewage Treatment Plant for Village insurance, stated the broker was of the opinion the coverage on the sewage treatment plant and lift stations was not adequate, and recommended that a competent sanitary engineer be employed to appraise the installations. After a discussion of rates and other pertinent data, Trustee Schleicher suggested that Baxter and Woodman be requested to give an estimate of the cost of the plant in writing for appraisal purposes. Decision was made that after the report is received from Baxter and Woodman, the Board will discuss ithat amount of coverage should be carried. The matter of the outside sale of Christmas trees was referred to the Village attorney who was requested to prepare a suitable ordinance to permit the sale of trees. The manager reported.;he_had' ordered the installation of 3 mercury lights'at the rear of the Presbyterian Church, and the Church will reimburse the Village for any costs.
