The regular meeting of the President and Board of Trustctes of the Village
of Deerfield was called to order in the Council Chambers of the Village Hall on
Monday, October 7, 1963 at 8:45 p.m. The clerk called the roll and reported
the following were
Present: Ira K. Hearn, Jr.
John A. S. Lindemann
James E. Mandler
George P. Schleicher
Absent: David C. Whitney, President
Ellis W. Smith
James M. Wetzel
and that a quorum was present and in attendance at the meeting. Also present
were Messrs. Seymour Axelrodd, representing the Village Attorney, and Norris
Stilphen, manager
Moved by Trustee Mandler, seconded by Trustee Lindemann, that Trustee
Hearn be appointed President pro ten. Motion carried unanimously.
Trustee Schleicher moved, seconded by Trustee Lindemann, that minutes
of the adjourned meeting held September 23, 1963 be approved as submitted.

Ordinance -Abate Municipal Trustee Schleicher moved, seconded by
Bldg. Bond Levy (0- 63 -48) Trustee Mandler, that the ordinance
be adopted directing the County
Clerks of Lakd and Cook Countyes to abate the levy of the tax of $13,225 for
Municipal Building Bonds. Adopted by the following vote:
Ayes: Hearn, Lindemann, Mandler, Schleicher (4)
Nays: None (0)
The President pro tem signed the ordinance indicating his approval thereof.
Ordinance - Abate $15,000 Trustee Schleicher moved, seconded
Sewer Improvement Bond Levy by Trustee Mandler, that the ordinance
0 -63 -49 be adopted directing the County Clerks
of Lake and Cook Counties to abate the
levy of the tax of $15,000 for the payment of the principal for Sewer Improve-
ment Bonds, Series of 1960. Adopted by the following vote:

& Lakeland Const. $573+.22 Fuel Tax projects 15 TL CS - traffic-
lights at Waukegan and Deerfield
Roads and 17 CS - Deerfield Road under pass improvements. The engineer
recommended contracts be awarded to the low bidders as follows:
15 TL CS Aldridge Electic, Inc. $9,095.00
17 CS Lakeland Construction 5,734.22
Trustee Mandler moved the bids of the low bidders be accepted, subject to
approval by the State, and the President be authorized to sign the contracts.

down and various items referred to the Plan Commission, the manager and

for a "Think Session" and he felt a date should be set as soon as possible

The attorney reported annexation petitions for North Shore Gas, R.C.A.,
Public Service Co. and Soil Testing Laboratories had been sent -J to the
attorneys. The zoning classification of these properties was discussed, and
both Trustee Schleicher and Mr. Robert Demichelis stated it might be well to
hold another public hearing due to the lapse of time since hearings were
concluded in March, 1963. Mr. Axelrood stated the passage of time would
not invalidate the hearings. He was requested to prepare the zoning
amendments for these properties.
Mr. Axelrood reported he had contacted the attorney for the Illinois
Commerce Commission in connection with the installation of crossing gates,
and would have a report for the Board at the next meeting.
The attorney reported objections had been filed mn the Greenwood inter-
ceptor Storm Sewer Special Assessment No. 101, and the matter was set for
October 25, 1963. He stated a default order had been entered against those
not entering objections. He further reported October 25, 1963 had been set
as the return date for written objections mm the Cedar, Spruce, Arbor Vitae,
Pine Special Assessment project, No. 102.

Petition for County Aid Trustee Lindemann moved, seconded by
Cedar St. Bridge Trustee Schleicher that the President
pro tem be authorized to sign a petition
to the Board of Supervisors of Lake County, requesting aid and an appropriation
from County Funds to ppy one -half the cost of construction of a bridge over the
West Fork of the North Branch of the Chicago River on Cedar Street, the total
cost estimated to be $30,000.
Motion carried unanimously.
Pending Law Suits
Mr. Axelrood reported the following cases
were pending:
Special Assessment No. 101 (Greenwood Sewer) set for October 25, 1963.
Special Assessment No. 102 (Cedar, Pine, Spruce) set for October 25, 1963.
Wilson - Weigle vs. Deerfield - pending under advisement by the Court.
Hunter vs. Deerfield - water connection - put under trial call. ' '
1st National Bank of Evanston vs. Deerfield (Shepard suit) briefs filed.
Deerfield vs. Theil - traffic appeal.
A report was received from the Building Commissioner regarding uses in the
B -1 and B -2 Districts. The matter was tabled until the Plan Commission report is
received.
Deny Variation - Rice Reports were received from the Board of
442 Cumnor Ct. Zoning Appeals recommending denial of
the petition of Mr. Herbert Rice, Jr.
442 Cumnor Court, for a variation from the terms of the Zoning Ordinance to
permit the construction of a 2 car detached garage within 2 ft. of the side lot
lines and 6 ft. of the residence. Aletter dated October 6, 1963 from Mr. Robert
Demichelis, attorney for the petitioner, was received, giving additional reasons
substantiating a hardship to his client if the variation is not granted.
Trustee Wetzel entered the meeting at 9 :45 p.m. and was present thereafter.
After a lengthy discussion of the petitioner's problems in location of the
proposed 2 car garage on the lot whereon a swimming pool has been constructed
under a permit from the Village, Trustee Mandler moved, seconded by Trustee
Hearn, that the report of the Building Board of Appeals be accepted, and the
petition be denied. Adopted by the following vote:
Ayes: Hearn, Lindemann, Mandler, Schleicher, Wetzel (5)
Nays: None (0)
Approve We -Go Park Sub. A report was received from the Plan
Commission recommending approval of the
plat of We -Go Park Subdivision. The Building Commissioner also recommended
approval, subject to review of improvements, payment of fees and posting bond
or escrow for improvements. Trustee Mandler moved, seconded by Trustee Schleicher,
that the Subdivision plat be approved. Motion carried unanimously.
Discussion was had on the request of Fire Chief Elmer Krase that Village
employees be permitted to join the Fire Department, since there are some problems
in getthng a sufficient number of members to respond to fire calls during the•
day. He pointed out it was to the advantage of the Village to have as strong
a fire department as possible. Trustee Schleicher suggested the Public Works
Superintendent be asked how many men can be spared for fire calls. President
pro -tem Hearn proposed the matter be handled by the manager as an administrative
function.

The manager reported a letter had been received from Mr. Joseph Koss,
243 Wilmot Road, suggesting the Village'jack up the sidewalk in front of his
house, and install proper fill. He stated the engineer doubted this could be
done.
