10/13/1977October 13, 1977 A Public Hearing by the Board of Local Improvements of the Village of Deerfield was called to order by the secretary on October 13, 1977 at 8:00 p.m. in the Council Chambers of the Village Hall. The secretary called the roll and reported that the following were Present: Norma Gavin Jerold L. Heisler Cynthia J. Marty Vernon E. Swanson Absent: Bernard Forrest, President D. Jeffrey Blumenthal Edwin B. Seidman and that the following were present and in attendance at the meeting. Also present were Mr. David Newman, representing the Village attorney, and Norris Stilphen, manager. Mr. Swanson moved, seconded by Mr. Heisler, that Mrs. Marty be appointed President pro tem. Motion carried unanimously. Mrs. Marty said the purpose of the meeting was to consider the improvement of Kates Road, Special Assessment No. 114. Mr. Newman said Notices of Hearing had been sent to owners of property benefited by the improvement. He explained Special Assessment procedures and said the Board my adhere, modify or abandon the improvement. If approved, the ordinance is published, filed with the Court, appointment of the Commissioner approved by the Court and notices sent to each beneficiary. The Court will hear any objections and will rule of the assessments. It is then returned to the Village and advertisement for bids published. The bid is awarded to the lowest responsible bidder. The beneficiaries may take over the construction otherwise the bidder will proceed.Payment for construction, engineering, inspection and legal costs is made by vouchers and therefore the estimated cost must allow for these added costs. Payment of the Special Assessments may be made without interest if immediate, otherwise installments are due January 2 and may be spread over 10 years. Interest is at 6 per cent. The Village Engineer described the scope of the assessment, to consist of portland concrete cement pavement, curb and gutter, storm sewer, modification of the traffic lights on Waukegan Road at Kates Road, and incidental work. Mr. Phil Code, Commissioner of Special Assessments, was unable to be present because of illness, and therefore the Village Engineer gave the preliminary assessments as follows: Whitehall Nursing Home - 13 per cent of the total cost; Fiat Allis - 31 per cent; Sara Lee - 65 per cent; and the Village of Deerfield - 11 per cent. Mr. Mulder of Whitehall read the letter he had sent to the Village objecting to and stating he was unwilling to participate in the improvement. He has put in a second driveway off Kates Road for guests and employees. The road is heavily travelled by rucks and the improvement would be non - productive and neither needed or wahted. Mr. Richard Ross, attorney for Whitehall, said he will object to the Special Assessment at the Court hearing - not just the share of the cost to Whitehall, but the fact that the improvement of the roadway is detrimental to the Nursing home. A representative from Sara Lee said the north road had been closed at the request of the Village. Kates Road has heavy truck traffic and since Lake -Cook Road has been improved a cut has been made into Kates Road. All eastbound traffic from Fiat Allis exits on Kates Road and is used for the Sara Lee retail store. It will cost an additional $35,000 to move the utility poles which will be in the right -of -way. The road will be expensive to maintain by the Village but conforms to the Comprehensive Plan of the Village. There being no further testimony, on motion by Mr. Heisler and seconded by Mr. Swanson, the Hearing was adjourned at 8:30 p.m. 7 ^ SECRETARY APPROVED: 1 1 1
