A meeting of the Board of Local Improvements of the Village of Deerfield was
called to order by the President in the Council Chambers of the Village Hall on
Monday, May 24, 1976 at 8:05 p.m. The secretary called the roll and reported the
following were

and that a quorum was present and in attendance at the meeting. Also present were
Messrs. Davin Newman, representing the Village attorney, James Soyka, Village engineer,
Henry Uteg, Commissioner of Special Assessments, and Mrs. Marjorie Emery, assistant
manager.

The President stated the purpose of the public hearing
was to explain the proposed improvement and the

Mr. Newman stated all owners of property to be assessed for the proposed improve-
ment have been notified of the hearing by the Board of Local Improvements. He ex-
plained special assessment procedures. He stressed the fact that, in addition to
this public hearing, if the Board determines to proceed with the improvement, an
owner may file an objection which will be heard by a Judge of the Circuit Court.
Mr. Seidman entered the meeting and was present thereafter.
Mr. Newman explained that the Court has authority to make any changes as shown
by the evidence, and then confirms the assessment roll. After confirmation, the
Board of Local Improvements awards the contract for construction to the lowest respon-
sible bidder, and vouchers are issued. The Village. will then receive a certified copy
of the assessment roll. The property owner then has 60 days in which to pay the
entire assessment without interest. Thereafter interest is charged at 6 per cent per
annum. There is a penalty of one per:cent.perjomo.nth for delinquent assessments. At
the end of the ten year period, excess funds are first used to reimburse the Village
corporate.fund, and any money left over is rebated to property owners.
Mr. Soyka he was directed by the Board to prepare plans for the proposed improve-
ment which consists of a sidewalk 2100 feet in, length extending from a point 450 feet
north of Greenwood Avenue to a point north of Hunters Court. Many properties have
septic systems or raw sewage going into a ditch north of Anthony's Beef Inn, and
therefore a sanitary sewer will be installed. Properties served by a sanitary sewer
will not pay for the sanitary sewer. The entire cost of the storm sewer will be paid
by the Village. Plans are available for inspection.
Mrs. Lillian Marshall, 1422 Waukegan Road, asked why a sidewalk should be con -.:uc
structed on the west side of Waukegan Road which would not be used, and suggested the
Village improve the sidewalk on the west side of Waukegan Road between Greenwood and
Journal Court which is in very poor condition. Mr. Soyka stated the sidewalk was
recommended by the Safety Council.
Mr. Uteg explained how assessments are spread and stated only those properties
benefited by the installation of a sanitary sewer will pay for the sewer. The
storm sewer will be paid for by the Village. The cost of the sidewalk and sanitary
sewer with tap in is $4,200 for a 60 foot lot, which can be paid over a ten year
period. The total cost of the improvement is $116,688 and the Village will pay
approximately 20 per cent as a public benefit.
Mr. Konsler, owner of property at 1438 Waukegan Road, stated the previous owner
had a sanitary sewer installed by a plumber which was connected to the sanitary sewer
west of the railroad tracks. Mr. Soyka stated connection had been made to the storm
sewer. Mr. Uteg said owners on the east side of Waukegan Road will have to tunnel
under Waukegan Road but will not be charged for the tap by this special assessment.
Mr. Frank Ganger, 1329 Waukegan Road, was told the sanitary sewer would be 8 to 10
feet deep, but he pointed out his property slopes to the rear and questinned whether
the depth was adequate. Mr. Uteg said the first question asked by a purchaser is
whether sewer and water were available. Mr. Soy.ka stated many properties were in
violation of Village ordinances.
Letters from owners opposed to the assessment were read by Mrs. Emery. It was
the consensus of these owners that the value of the property would not be increased
by the cost of the assessment.
Mrs. Lillian Marshall stated owners of property on the east side of Waukegan
Road did not pay for the sidewalk. She said she could not understand why a sidewalk
which would not be used was required on the west side and why property owners should
pay for the installation. She pointed out the assessments would be a real hardship
to some who could not afford to pay for the proposed improvements.
The pastor of the Baptist Church at 1250 Waukegan Road stated he had been told
by the engineer that if 51 per cent of the owners objected, the project would be
dropped. Mr. Newman stated this was true only in the City of Chicago.
The President stated the matter would be on the agenda for the meeting on
June 8th.
