03/15/1971March 15, 1971 A meeting of the Board of Local Improvements of the Village of Deerfield was called to.order by the President.in the-Council Chambers of the Village Hall on Monday, March 15, 1971 at 8:15 p.m. The secretary called the roll and reported that the following were Present: Bernard Forrest, President Charles R. Bootz George Kelm George P. Schleicher Stephen M. Slavin M. Jay Turner, Jr. Absent: None and that a-quorum was present and in.attendance.at the meeting. Also present were Messrs. Richard Houpt, Village attorney, and .Norris Stilphen, manager. Hearing S/A #110 Mr. Henry-Uteg, Deputy Commissioner of Assess - Wilmot & Berkley Sidewalk, ments,,filed.with the secretary the Affidavit Curb & Gutter, Drainage of Mailing the notice of the public hearing on a proposed:local.improvement consisting of curb and gutter, sidewalks and a storm drainage'-system on the west side of'Wilmot Raod from Greenwood Avenue to Berkeley Co.urt.and on the south side of Berkeley Court a distance of 300 feet west from Wilmot Road, to be designated..Special Assessment No. 110. Mr. Uteg explained the spread of the assessment which is based on lineal footage. He stated the cost of storm water drainage and improvements to intersections is not charged to the property owners, but will..be.paid by the Village as a public benefit. On corner lots, the owner will pay the.full cost for frontage improvements and one - third the cost of sideyard improvements, the remainder being paid by the Village. He estimated the cost for a lot with frontage of 100 feet to be $1,254.28. Among those who objected to the improvement were Mrs. Raymond Baumann, 1218 Wilmot Road, Mr. and Mrs. Kenneth Moore, 1200 Wilmot Road, Wallace Peterson, 1340 Wilmot and Lyle Peterson, 1650 Lake Eleanor Court. All questioned the need for the improvement. President.Forredt.stated the Safety Council and Woodland Park PTA had recommended the installation of the sidewalk for the safety of the school children, and it was the Board's decision that Wilmot Road improvements should be completed by the construction of curb and gutter and storm drainage. Mr. John Bure, attorney for the Misses Herrmann and Mr. Maver Rossett, stated his clients took no position on the improvement, Mr. Rossett having agreed to pay for certain items when the property was subdivided. He asked that the water main on the east side of Wilmot Road be tapped and a stub installed at the owner's expense when the improvements are constructed, to serve his clients' property on the west side of Wilmot Road. The Village attorney explained that the improvements specified are one assess- ment, and therefore individual property owners cannot install sidewalks as is permitted under the special sidewalk assessment procedure; however, if the owners of adjacent properties in one block or more wish to install -the improvements on a cash basis, plus engineering costs, these properties can be dropped from the assessment roll, although a limited time is specified for this action. Several discrepancies in the amounts to be assessed were pointed out. Mr. Uteg stated the amounts given were preliminary figures, and if decision is made to proceed with the improvement, the final assessment roll will be prepared. The Village attorney stated a Court hearing on the assessment must be held, each owner being notified of the date and time of the.hearing.and the amount of his assessment. At this Court hearing, any owner may objec.t..to 'the amount of his assessment. 1Ir. Kenneth Moore asked why curb and gutter was not extended the full length of Berkeley Court. The manager stated there was a sidewalk on property west of the proposed curb construction, and therefore it had not been included in the assessment. Mr. Uteg stated that if the cost of the additional construction did not exceed 20 per cent of the estimated..cos.t, it could be added to the assess- ment. Several members stated it was their.opinion this should be done if possible. Mr. Slavin moved, seconded by Mr. Bootz, that debate be limited. Adopted by the following vote: Ayes: Bootz, Slavin, Turner (3) Nays: Kelm, Schleicher (2) Adhering Resolution moved the adoption of the resolution. following vote: The resolution adhering to the estimate and cost of.the.improvement was read. Mr. Slavin Seconded by Mr. Bootz, and adopted by the Ayes: Bootz, Kelm, Schleicher, Slavin, Turner (5) .Nays: None (0) The President and members of the Board of Local Improvements then signed the resolution. Recommend Ordinance Mr. .Turner moved, seconded by Mr. Slavin, S/A #110 that the.B.oard of Local Improvements submit and recommend passage of an ordinance to pro- vide for the construction of curb and gutter, sidewalk and installation of a storm drainage system on portions of Will-mot Road and Berkeley Court. Adopted by the following vote: Ayes: Bootz, Kelm, Schleicher, Slavin, Turner (5) Nays: None (0) The President and members of the Board of Local Improvements then signed the Recommendation.
