09/17/1962 (2)September 17, 1962 Pursuant to notice thereof, the public hearing by the Board of Local Improvements of the Village of Deerfield on the improvement of Hemlock Street, Cedar Lane, Cedar Street, Juniper Terrace, Arbor Vitae Road, Pine Street and Spruce Street was called to order by the President in the Council Chambers of the Village Hall on Monday, September 17, 1962 at 8 :00 p.m. The secretary called the roll and reported the following were Present: David C. Whitney, President John F. Aberson Ira K. Hearn, Jr. John A. S. Lindemann James E. Mandler Winston S. P,orter..- Absent: Maurice C. Petesch and that a- quorum was present and -in attendance at the meeting. Also present were Messrs. Thomas Matthews, Village attorney; Norris Stilphen, manager; Robert Bowen, Building Commissioner; and Paul Spies, engineer for Ciorba, Spies and Gustafson. The manager explained the background of the improvements, stating that when the project was originally proposed in 1953-54, construction costs were lower, but the same percentages were used for engineering and costs of spreading the assessment. He described the scope of the improvement,,and stated the estimated cost was $88,371-54. Witnesses were sworn. Speaking against the proposed improvement were: John L. Viemeister, 941 Cedar Street; Ted Johnson, 826 Pine Street; James Reagan, 827 Pine Street; Warren Darling, 925 Hemlock; James Morrow, 804 Pine Street; and Joseph Cayman, 930 Hemlock Street. Objections were based primarily on the cost of the project, storm drainage which was stated to be satisfactory at the present time with- out additional sewer installation, and the fact the streets had been paved, it being stated the Village had permitted existling pavement to deteriorate. Mr. Matthews and Mr. Spies answered questions regarding the project, Mr. Matthews pointing out that a Court hearing must be held, and objections as to cost and necessity of the improvement could be made at that time. Approve Proceeding With Mr. Aberson moved, seconded by Mr. Hemlock, Cedar, etc. Improvts. Hearn, that the Board of Local improve- ments proceed with the-improvement of Hemlock, Cedar and other streets by special assessment as planned. Adopted by the following vote: Ayes: Aberson, Hearn, Lindemann, Mandler, Porter (5). Nays: None (0) 1 Fj 1 Approve Certificate of Cost t A letter was received from the Village Completion S/A 96 Central Ave. attorney regarding a defi'ci®ncy.of- $417.48 from St. t Bridge $417.48 in the final costs of the Central Avenue Special Assessment No. 96. Mr. Hearn moved, seconded by Mr. Aberson, that the deficiency of-$417.48 be paid from Street and Bridge Funds, and the Certificate of Cost'and Com- pletion on Special Assessment No. 96 be approved. Adopted by the following vote: Ayes: Aberson, Hearn, Lindemann, Mandler, Porter (5) Nays: None (0) Approve Voucher 4 - S/A 99 Mr. Mandler moved, seconded by Mr. Aberson, Thomas A. Matthews - $762.93 that the Board approve and authorize the issuance of Voucher No.4 in the amount of $762.93 to Thomas A. Matthews for legal services in connection with Special Assessment No. 99, Wilmot Road sidewalks. Adopted by the following vote: Ayes: Aberson, Hearn, Lindemann, Mandler,.Porter (5) Nays: None (b) There being no further business to come before the Board of Local Improvements, the meeting was adjourned.
