04/15/1963tea Apr-i l- 15, 1963 The regular meeting of the President and Board of Trustees of the Village of Deerfield was called to order by the President in the Council Chambers of the Village Hall on Monday, April 15, 1963 at 8 :20 p.m. The clerk called the roll and reported the following were Present: David C. Whitney, President John F. Aberson Ira K. !learn, Jr. John A. S. Lindemann James E. Mandler Maurice C. Petesch Winston S. Porter Absent: None and that a quorum was present and in attendance at the meeting. Also present were Messrs. Seymour Axelrood, representing the Village attorney, and Norris Stilphen, manager. The President reported he had signed the ordinance zoning the Valenti tract, the annexation ordinance and the ordinance amending the jurisdictional area map which were passed by the Board at the April 1st meeting. He stated Mr. Valenti had fulfilled all conditions set by the Board for annexation and zoning. Trustee Hearn moved, seconded by Trustee Aberson, that minutes of the regular meeting held April 1, 1963 be approved. Motion carried unanimously. Accept Plan Commission Report The report was received from the Plan Commission Re: Zoning on Annexation- P.S.Co. recommending that the Zoning Ordinance be NOrthShore Gas, RCA & Soil Testing amended to provide automatic zoning classi- fications upon annexation for properties in Cook County as follows: Lot 10, Downey's Cook County Addition to Deerfield Subdivision - Public Service Company: R -1 Single - family Residence District with a Conditional Use to permit operation and additions to an electric sub - station; North Shore Gas Company - M- Manufacturing District with a Conditional Use to permit outside storage of materials and equipment and loading and unloading of vehicles; RCA and Soil Testing Laboratories - M- Manufacturing District with a Conditional Use for outside storage of materials and equipment. Motion carried unanimously. The North Shore Gas Company's attorney asked that no action be taken until the ordinance has been reviewed. Safety Council Report A report was received from the Safety Council Re: Street Lighting stating they were unable to determine whether any accidents were caused by lack of street lighting, and.they could not evaluate the present street lighting due to lack of expert knowledge of standards. The manager was directed to contact several illumination engineers regarding costs of a street lighting survey, as well as the County Engineer, and State Highway Department. The manager reported the Public ServiceCompany was making a study of Woodland Park lighting. The manager reported 80% of the shelter space in the Village has been marked. Approve Variation - The Board of Zoning Appeals recommended a Thomas King, 833 Rosemary variation from the terms of the Zoning Ordinance to permit the construction of a garage at 833 - Rosemary Terrace with a sideyard of 3 ft. as requested by Mr. Thomas King. Trustee Hearn moved, seconded by Trustee Mandler, that the report of the Board of Zoning Appeals be approved and the attorney be requested to prepare the necessary.ordinance. Motion carried unanimously. Approve Variation -66 ft. Lot The Board of Zoning Appeals recommended that 912Chestnut -Deny Sideyard a variation be granted to permit the construc- tion of a. two - family residence at 912 Chestnut Street on a lot with a width of 66.ft. instead of the 75 ft. width required by the Zoning Ordinance, as requested by Mr. Henry Zander, representing Mr. I.C. Rassmussen. They recommended denial of the request for a variation from the sideyard requirements. Trustee Lindemann moved, seconded by Trustee Petesch, that the report of the Board of Zoning Appeals be accepted, and the attorney be requested to prepare the necessary ordinance. The clerk explained that the first complainant had voted by absentee ballot when the clerk was notified by the Police Department of,•the request for absentee ballots, and in the second instance, Saturday, three days prior to the election, was the last day to apply.in person for absentee ballots, and therefore, a request on Monday for absentee ballots could not be granted. The President stated $1000 had been budgeted for clerical help for the clerk. Police Sergeant Vacancy Trustee Petesch moved, seconded by Trustee Mandler, that the Board of Police Commissioners be notified that a vacancy exists in the position of Police Sergeant, as provided in the 1963 -64 Budget, and that an appointment be made to fill said vacancy. Adopted by the following vote' Ayes: Aberson', Hearn, Mandler, Lindemann, Petesch, Porter (6) Nays: None (0) T5ble Plan Commission Report The revised 0 & R regulations recommended by Re: 0 & R Regulations the.Plan Commission were discussed, the attorney stating more time was required to study certain provisions of the proposed amendment, such as performance standards,, lot size and percentage of lot coverage. Trustee Hearn moved, seconded by Trustee 263 Lindemann, that the report be tabled, and the attorney be requested to prepare an ordinance incorporating the changes suggested. Trustee Petesch moved, seconded by Trustee Lindemann, that the specifications be approved and the President be authorized to sign said specifications. Adopted by the following vote: Ayes: Aberson, Hearn, Lindemann, Mandler, Petesch,Porter (6) Nays: None (0) Trustee Petesch left the meeting at 9 :30 p.m. Approve Hovland S/A Engineering Contract - Authorize Execution and i t s execution be authorized, Ayes: Aberson, Hearn, Lindemann Nays: None (0) Trustee Hearn moved, seconded by Trustee Mandler, that the Board approve the engineering contract for Hovland improvements by speciel assessments, Adopted by the following vote: Mandler, Porter (5) Oppose S.B. 401- Refuse Disposal A letter was received from the Village of Glenview requesting Deerfield's support in opposing Senate Bill No. 401 relating to the dumping of refuse. Trustee Hearn moved, seconded by Trustee Mandler, that the Village officially oppose this bill, and go on record as strongly urging that no change be made in the present law which prohibits dumping within on a mile of a municipality. Motion carried unanimously. The manager asked for an interpretation of the ordinance establishing excess facility rates for sewer and water. It was the consensus of the Board that the manager use his discretion in enforcing the ordinance. The manager reported on the possible annexation of the Import Motors tract (Volkswagen) to Northbrook. He stated the cost for extension of sewer and water from Northbrook would be much greater than if these services were supplied by Deerfield. He stated letters had been sent to the Toll Road Commission and bvernor Kerner, asking that annexation across and extension of water and sewer lines under the Toll Road not be allowed. He suggested that the Village consider paying part of the cost of extending sewer and water lines to serve the Import Motors property. President Whitney proposed a committee be appointed to discuss these matters with the company. Decision was made that action on this matter be tabled until after the election, and the new Board can decide what should be done. Trustee Petesch re- entered the meeting at 9 :40 and was present thereafter. Deny Temporary Sewer Connection A request was received from Nixon Enterprises for permission to make a temporary connection to existing sanitary sewer lines until the second unit of their subdivision is completed. It was the consensus of the Board that no temporary permit be approved until plats for the subdivision have been submitted and reviewed. Notice to Contractors MFT Trustee Aberson moved, seconded by Trustee Mandler, Set May 6 for Bids that the Notice to Contractors for the railroad underpass and the Pine, Kipling and Osterman �v Avenue improvements Motor Fuel Tax projects be approved and execution authorized, and May 6, 1963 be set for the return of bids on these projects. Adopted by the following vote: Ayes: Aberson, Hearn, Lindemann, Mandler, Petesch, Porter (6) Nays: None (0) A request from Mr. Hal Bergdahl. for a changle in zohi;ng on three lots on Central Avenue was referred to the Plan Commission. A Safety Council report listing eight items for Board consideration was taken under advisement. The President signed the Proclamation for Baby Week. The President requested the attorney to prepare any., annexation ordinance. for the property at the northwest corner of Wilmot and Deerfield Roads which is now surrounded by the Village. Trustee Petesch asked that the P61ice Department be instructed to carry on a concerted drive on pines and speeding, and to check cars at apartment buildings for compliance with the ordinance requiring vehicle tags. President Whitney suggested that the Police Chief consider assigning one sergeant to full time juvenile duty. The manager will check.this suggestion with the Chief.
