04/01/1963257 Apri 1 1, 1963 The regular meeting of the President and Board of Trustees of the Village of Deerfield was called to order by the President in the Council Chambers of the Village Hall on Monday, April 1, 1963 at 9:05 p.m. The clerk called the roll and reported the following were Present: David C. Whitney, President John F. Aberson Ira K. Hearn, Jr. James E. Mandler Maurice C. eetesch Winston S. Porter Absent: John A. S. Lindemann and that a quorum was present and in attendance at the meeting. Also present were Messrs. Seymour Axelrood, representing the Village attorney, and Norris Stilphen, manager. Moved by Trustee Porter, seconded by Trustee Aberson, that minutes of the regular meeting held March 18, 1963 be approved as submitted.- Motion carried unanimously. Ordinance - Excess Facility The ordinance establishing excess facility rates Rates (0- 63 -10) for water and sewer services was presented and read in full. Two changes were made in the ordinance to clarify the meaning. Trustee Aberson then moved, seconded by Trustee Mandler, that the ordinance.be adopted as corrected. Adopted by the following vote: Ayes: Aberson, Hearn, Mandler, Petesch, Porter (5) Nays: None (0) The President signed the ordinance indicating his approval thereof. Ordinance - Zoning Amendment An ordinance was presented amending Sections XI, Re:.R -6 & R -7, Parking, R.R. XII, XVI, XXIII - B, and V -1 of the Zoning Right -of -Way zoning, Conditional Ordinance, relating to R -6 and R -7 Districts, Uses (0- 63 -11). Off- Street Parking and Loading, Conditional Uses, and zoning classification for railroad right -of- ways. Mr. Peter Weinert, Chairman of the Plan Commission, reviewed the ordinance, pointing out revisions that had been made to the present ordinance. A letter was received from Mr. J. Howard Wolf objecting to the proposed ordinance. Mr. Ray Meyer requested the ordinance be tabled for further study. Trustee Porter commented on these objections. Trustee Porter moved, seconded by Trustee Aberson, that.the ordinance be adopted, and the said ordinance be published in pamphlet form. Adopted by the following vote: Ayes: Aberson Hearn, Mandler, Petesch, Porter (5) Nays: None (0) The President signed the ordinance indicating his approval thereof. Ordinance - Zoning Amendment The ordinance was presented amending Section V, Clavey Tract Zoned R -1 and R -2 paragraph 14 of the Zoning Ordinance to provide Upon Annexation (0- 63 -12) that if the tract of land known as the Clavey Nursery property Of approximately 77 acres at Wilmot and Deerfield Road is annexed to the Village it will automatically be classified as an R -1 and R -2 Single - family District. Receipt was acknowledged of the following documents requested by the Bca rd and submitted by Mr. Valenti: 1. Petition for annexation and plat of annexation. 2. Option between Sauganash Towers, Inc. and School District 110 for .part of Block 3 of the proposed Subdivision. .3. Option between Sauganash Towers Inc. and School District 110 for the tract of approximately 4.67 acres at:.Wilmot and Deerfield Road. 4. Plat of Subdivision. 5. Letter agreeing to sequence of construction, starting at the south- east part of the subdivision. 6. Annexation ordinance. 258 Mr. Valenti agreed to provide a certification of the proposed plat that the lots iw the entire development will be the equivalent of not less.than twelve thousand square feet per lot. Trustee Petesch moved, seconded by Trustee Mandler, that the said ordinance be adopted. Upon roll call the ordinance was passed by the following vote: Ayes: Aberson, Hearn, Nays: None (0) The President W Annexation Ordinance - Valenti Tract (0 -63 -13 Mandler, Petesch, Porter (5) uhheld his signature. .Clavey The ordinance was presented annexing the following described property to the Village of Deerfield (Clavey Nursery): The East Half of the Northeast Quarter of Section 31, Township 43 North, Range 12, East.of the 3rd P.M. (except those parts thereof taken for highway purposes (Toll Road) be deeds recorded under Document Nos. 971548, 971550 and 971551 in Lake County, Illinois. Trustee Petesch moved, seconded by Trustee Mandler, that the said ordinance be adopted. A lengthy discussion was had regarding annexation and zoning of the tract. Mrs. Jack Eisinger objected to the annexation, pointing to needs of the school district, and prices in.the options given by Mr. Valenti as being prohibitive to the school district if the land were to be acquired. Mrs. Rosemary Sassenoff and Mrs. Peggy McCabe also expressed opposition to the annexation at this time, and asked that the Park District hold a referendum on acquisition of this property. The petitions signed by 480 people asking for 0 & R zoning for the area were mentioned by Mr. Robert Cline. Speaking briefly in favor of the annexation were Mr. Joseph Koss, Mrs. William Marquardt and Mrs. Willard Loarie. The zoning of land south of County Line Road was also discussed, including the Volkswagen tract. Upon roll call the ordinance was adopted by the following vote: Ayes: Aberson, Hearn, Mandler, Petesch, Porter (5) Nays: None (0) The President withheld his signature. At Mr. Valenti's request, Trustee Hearn moved, seconded by Trustee Petesch, that.the record show that the two options had been given by Mr. Valenti to School District 110 in keeping with the terms outlined in the meeting of January 22, 1963. Motion carried unanimously. Ordinance - Jurisdictional Area A report was received from the Plan Commission Map Amendment (0- 63 -14) recommending that no 0 & R zoning be shown on the Jurisdictional Area Map, and that the entire area south of County Line Road between the Volkswagen property and Pfingsten Road be shown as R -2 zoning instead of R -1 -A and R -2 as is presently indicated. An ordinance was presented amending the jurisdictional area map by designating as 0 & R the area bounded by Wilmot Road, Hackberry Road extended, the Toll Road and County Line Road, and all that area south of County Line Road between the Toll Road, Edens Spur and Pfingsten Road not in the Village. Trustee Mandler moved, seconded by Trustee Petesch, that the ordinance be corrected to show, instead of Hackberry Road extended, the "south boundary of the Louis Klein property ". Adopted by the following vote: Ayes: Aberson, Hearn, Mandler, Petesch (4) Nays: Porter (1) Trustee Hearn th @n moved that the rules be suspended to permit action on the said ordinance at its first presentation. Upon roll call, the ordinance was passed by the following vote: Ayes: Aberson, Hearn, Mandler, Petesc,i, Whitney (5) Nays: Porter (1) Refer Zoning Amendment An ordinance was presented amending the Zoning for 0 & R on Annexation Ordinance, Section V, paragraph 14, to provide to Plan Commission that the areas shown on the jurisdictional area map to be zoned as 0 & R shall be automatically classified as 0 & R District upon annexation, Trustee Hearn moved, seconded by Trustee Petesch, that the proposed ordinance be referred to the Plan Commission for a public hearing. Trustee Aberson moved that the question of a public hearing by the Plan Commission on the proposed amendment to the zoning ordinance be-tabled. Motion failed for lack of a second. Mr. Robert Demichelis, a member of the Plan Commission, stated a public hearLng on the question of amending the zoning ordinance to provide automatic classification without a petition for such a hearing was contrary to Village policy. If such an amendment were adopted, no one would know what type of develop- ment would occur. The motion to refer the question to the Plan Commission for a public hearing was adopted by the following.vote: Ayes: Hearn, Mandler, Petesch, Whitney (4) Nays: Aberson, Porter (2) A resident objected to the conduct of the meeting by the President and his failure to sign ordinances passed by the Board. ie expressed concern about such indications of lack of concern about the welfare of the residents of the Village. Trustee.Mandler pointed out the necessary signatures could be procured. Bids -Elm Tree Spraying The manager opened sealed bids for elm tree spraying as follows: Nels Johnson, Evanston $ 2,359.50 Midwest.Tree Service, Waukesha, Wis. 2,250.00 A letter was received objecting to the spraying program as being detrimental to health of people, animals and wildlife, stated the spraying would not protect the trees, and urged a program of sanitation. Trustee Porter moved, seconded by Trustee Aberson, that the Board authori.ze the manager to execute a contract with the low bidder, Midwest Tree Service, for elm tree spraying at the bid price of $2,250.
