06/18/1962166 June 18, 1962 The regular meeting of the Board of Trustees of the Village of Deerfield was called to order in the Council Chambers of the Village Hall on Monday, June 18, 1962 at 8 :30 p.m., Trustee Winston Porter presiding. The c16rk'called the roll and reported the following were Preeent: John F. Aberson Ira K. Hearn, Jr. John A. S. Lindemann James E. Mandler Maurice C. Petesch • Winston S. Porter Absent: David C. Whitney, President and that a quorum was present and in attendance at the meeting. Also present were Messrs. Byron Matthews, attorney, and Norris Stilphen, manager. Trustee Hearn moved, seconded by Trustee Aberson, that Trustee Porter be appointed President pro tem. Motion carried unanimously. Onebid was received for a police patrol car. Discussion was had on the metter of re- advertising for bids, the manager reporting that, in addition to the legal notice to bidders, invitations to bidders had been sent to approxi- mately 30 dealers. Trustee Hearn moved, seconded by Trustee Aberson, that the one sealed bid be held over to the next meeting, and the manager contact possible bidders in an attempt to secure more bids. Motion carried unanimously. Adopted by the following vote: Ayes: Aberson, Hearn, Lindemann, Mandler, Petesch, Porter (61 Nays: None (0) 1st Presentation - Ordinance The first presentation was made of the ordinance Fire Limits establishing fire limits for the Vi 1 lage, and the proposed ordinance was discussed briefly with respect ::to interpretation of the provisions relating to 50. damage .to structures within the fire limits. lJ 2nd Presentation - Ordinance The second presentation was made of the ordinance setting vehicle weight limits for Village streets Vehicle Weight Limits Trustee Aberson mentioned the Evanston ordin- ance regulating load limits, and stated it was hie opinion the minimum fine was too low.. The attorney was requested to investigate these matters. Ordinance - Zoning Variation Trustee Hearn moved, seconded by Trustee 504 Princeton (0- 6.2 -19) Aberson, that the ordinance be adopted granting a variation from the terms of the Zoning Ordin- ance to permit the construction of a garage within three feet of the north property line at 504 Princeton Lane, in accordance with the recommendation of the Board of Zoning Appeals. Adopted by the following vote: Ayes: Aberson, Hearn, Lindemann, Mandler, Petesch, Porter (6) Nays: None (0) The President pro tem signed the ordinance indicating his approval thereof. Ordinance - Zoning Variation Trustee Mandler moved, seconded by Trustee 959 Apple Tree (0- 62 -20) Aberson, that an ordinance be adopted §ranting a variation from the requirements of the Zoning Ordinance to permit the construction of a carport within three feet of the south property line at 959 Apple Tree Lane, as recommended by the Board of Zoning Appeals. Adopted by the following vote: Ayes: Aberson, Hearn, Lindemann, Mandler, Petesch, Porter (6) Nays: None (0) The President pro tem signed the ordinance indicating his approval thereof. Accept Plan Commission Reports Recommendations were received from the Plan Re: Volkswagen & B.A.R.E. Commission on the petitions of Volkswagen and B.A.R.E. for annexation and zoning. Trf;stee Aberson moved, seconded by Trustee Petesch, that the report -:on Volkswagen be accepted. Adopted by the following vote: Ayes: Aberson, Handler, Lindemann,. Petesch, Porter (5) Nays: Hearn (1) i69 Trustee Mandler moved, seconded by Trustee Aberson, that the report of the Plan Commission on B.A.R.E. be accepted. Adopted by the following vote: Ayes: Aberson, Lindemann, Mandler, Petesch, Porter (5) Nays: Hearn (1) Deny B.A.R.E. Petition A lengthy discussion was had by members of the Board of Trustees, residents and members of tie Board of Education of School District 110 on the advisability of annexing B.A.R.E. with an 0 & R classification. Trustee Hearn stated it was imperative that the Village control the area south of County Line Road, rather than permit Cook County to control development under County zoning regulations. He also cited tax relief as a reason for annexation and rezoning. Trustee Petesch stressed school consolidation as a partial answer to school revenue problems. Residents of the area were opposed, stating their property vlues would be depreciated by rezoning of adjacent trats to non - residential uses. The recommendation of the hook County Zoning Board of Appeals was discussed, with reference to their statement that the rezoning of the Volkswagen tract would not set a precedent for the rezoning of adjoining.properties. The annexation of Volkswagen being contingent upon the annexation of B.A.R.E., Trustee Hearn moved, seconded by Trustee Petesch, that B.A.R.E. be invited to annex as an R -1 -A single - family residence district in order to annex the Volkswagen tract with an 0 & R classification at the front and M- Manufacturing at the rear. Motion carried unanimously. Representatives of B.A.R.E. indicated they were unwilling to seek annexation with an R -1 -A classification. Trustee Aberson moved,thatothedpeti ti-on`of B. *.R.E. for annexation with an 0 & R classification be granted. Motion failed for lack of a second. Trustee Petesch moved, seconded by Trustee Mandler, that the petition of B.A.R.E. for annexation and 0 & R zoning be denied. Adopted by the following vote: Ayes: Hearn, Mandler., Lindemann, Petesch, Porter (5) Nays: Aberson (1) Trustee Mandler then moved, seconded by Trustee Petesch, that, on the basis of the vote with respect to the B.A.R.E. petition and denial of annexation, the annexation and zoning petitioned by Volkswagen also be denied, since the area would not be contiguous to the Village. Adopted by the following vote: Ayes: Aberson, Hearn, Lindemann, Mandler, Petesch, Porter (6) Nays: None (0) Trustee Petesch moved, seconded by Trustee Hearn, teat the Cook County Board of Commissioners be notified of the Village's action with respect to Volkswagen. Motion carried unanimously. Trustee Petesch questioned the attorney's leaving the meeting prior to its conclusion, and stated he felt it to be important that the attorney be present to give needed legal counsel during the entire meeting. Trustee Petesch left the meeting at 11:35 p.m. Approve Fragassi Variation radio tower as requested by moved, seconded by Trustee Board of Zoning Appeals and Motion carried unanimously. The Board o a variation Mel Fragassi , at 4berson, that the the ordinance be F Zoning Appeals recommended approval of to permit the construction of an 85 ft. 803 Deerfield Road. Trustee Lindemann Board accept the recommendation of the prepared granting the said variation. Oppose Lake County Rezoning A notice of hearing was received from the Lake Edw. Meyer to B District County Toning Board of Appeals on the petition of Edward Meyers to rezone property adjacent;to the Toll Road, south of Deerfield Road to the B classification to permit construction of apartments. The Plan Commission recommended the Board object to the proposed rezoning. Trustee Mandler moved, seconded by Trustee Aberson, that a resolution b e adopted opposing and objecting to the petitioned rezoning, and a copy of the resolution be filed with the County Clerk. Motion carried unanimously. 170 A notice of hearing was received from the Lake County Board of Zoning Appeals on the petition of North Suburban Radio for a special permit for the construction and operation of radio transmitter.towers on the National Brick Company propert. The Plan Commission recommended the Board file an objection to the granting of the special permit. Trustee Lindemann moved that a resolution be adopted opposing the granting of the special permit in accord- ance with the recommendation of the Plan Commission. Motion failed for lack of a second. The manager was requested to attend the hearing on July 2, 1962 and report to the Board. 1st Presentation - Appropriation First presentation was made of.the Appro- Ordinance priation ordinance for the fiscal year beginning May 1, 1962 and ehdi ng April 30, 1963. Accept Deed - Lot 32 A deed for Lot 32, Westview Subdivision, was Westview Sub. ( Gooder) received from Mr. Stith Gooder, said lot to be used for street purposes. Trustee Hearn moved, seconded by Trustee Aberson, that the Deed be accepted, recorded and steps taken to remove the property from the tax rolls. Motion carried unanimously. Annexation Petition The manager reported a petition for annexation Christ Methodist Church had':been received from Christ Methodist Church. Trustee Mandler moved, seconded by Trustee Aberson, that the petition be accepted and turned over to the attorney for preparation of the.annexation ordinance. Motion carried unanimously. Approve Fireworks Displa for July 4th seconded �y Trustee Mandler, that provided it is held on July 4th. Motion carried unanimously. Scavenger Rate Increase Denied A request was received from the Deerfield Commons for a permit for a fireworks di splay in the Commons on June 29th. Trustee Hearn moved, the Board approve the fireworks display Trustee Lindemann reported a request had been made by Deerfield Disposal Service (Gene Kieft) for permission to increase rates for scavenger service to $3.70 per month. It was the consensus of the Board that no increase be permitted unless proof is submitted that such an increase is justified. The manager reported Leakfinder Survey Company had offered a 6% discount if the Village prepaid the contract price for one year's service by the company, in a lump sum. Trustee Hearn stated, and the Board approved, that no perpayment should be made. Invest $85000 Old S/A Funds The manager reported the Village auditor had suggested, and the Attorney had approved, that $85,000 held in the 6;1.d­- Sp &cI 6l- ..Assessment account be invested in long term Government securities, the interest earned from such investments to be held in a special.account. After discussion of the matter, Trustee Hearn moved, seconded by Trustee Aberson, that $85,000 of old Special Assessment Funds be invested in short term Government notes, final disposition to be made after pending legislation-is resolved. Adopted by the following vote: Ayes: Aberson, Hearn, Lindemann, Mandler, Porter (5) Nays: None (0) Transfer Vehicle Tax Trustee Aberson moved, seconded by Trustee Funds Rpsolutton Lindemann, that a resoluta;on be adopted directing the Treasurer to transfer 35% of the monies received from the sale of vehicle licenses to the General Fund to be utilized for payment of salaries and wages of policemen.engaged in the regulation of traffic, said resolution be remain in effect until the Board of Trustees directs otherwise.
