10/14/1959`206 October 14, 1959 The regular meeting-,of the Board of Trustees of the Village of Deerfield was called to order in the Council Chambers of the Village Hall on Wednesday, October 14, 1959 at 8:00 P.M. The Clerk called the roll and reported the following were Present: John F. Aberson Petty Cash Joseph W. Koss 60.00 Harold L. Peterson Am erican Public Works Association Maurice C. Mr. Thomas Matthews, Village Attorney, and Mr. Norris Stilphen, Village Manager, were also present. On motion by Trustee Petesch, seconded by Trustee Wehle, and carried unani.mAusly, Trustee Koss was appointed President pro tem. Moved by Trustee Aberson, seconded by Trustee Peterson, to dispense with reading of minutes, and approve as submitted. Motion carried unanimously. Trustee Porter moved, seconded by Trustee ( Goodpasture) Aberson, that the Goodpasture Resubdivision of, Good Acres Subdivision be approved,.and execution of the plat of subidivision be authorized. Motion carried unan.imously. Approve Linari Variation The Board of Zoning Appeals report recommended a variation be granted to permit the construction of a fourth building on the premises known as 1177 Waukegan Road, as petitioned by Mr. Corinto Linari. Trustee Aberson moved, seconded by Trustee Peterson that the Board concur in the recommendation of the Board.of Zoning Appeals, and an ordinance be.prepared granting said variation. Adopted by the following vote: Ayes: Aberson, Koss, Peterson, Petesch, Wehle (5) Nays: Porter (1) , Mr. STilphen., Village Manager, was directed to write Mr. Linari recommending that he follow through with a proposed subdivision of the above mentioned property.. Approve Kleinschmid.t Trustee Aberson moved, seconded by Trustee Peterson, Building Permit that the application of Kleinschmidt Division of Smith Corona Marchant Inc. for a building permit for an addition the .approved, and the issuance of.said permit be authorized, as recommended by the .Building Commissioner. Adopted by the following vote: Ayes: Aberson, Koss, Peterson, Petesch, Porter, Wehle (6) Nays: None (0) Approve Special Permit The report -of the Board of Zoning Appeals Parking - Dahlquist recommended that a special permit be approved as a variation, to permit the construction of a parking lot on the residential lot adjoining the Shoppers' Court parking lot, at the south end of Todd Court. After a lengthy discussion, Trustee Porter moved, seconded by Trustee Peterson, that the special permit be granted as a variation for the parking lot, as requested by Mr. Clarence Dahlquist, subject to the following conditions: (1) No access for vehicles to Todd Court; and .(2) a fence of( similar structure be built along the boundaries abutting on residential property as a.shield and to preclude cars going through to Todd Court. Adopted by the following vote: Ayes: Aberson, Koss, Peterson, Petesch, Porter (5) Nays: Wehle (1) Deny Rezoning - Lot 28 The report of the Plan Commission recommended O.B. Von Linde's Sub. denial of Mr. Fred Breitling's petition to rezone Lot 28, O.B. Von Lindel's Subdivision, from R -2 to B-2 Business District. Trustee Porter moved, seconded by Trustee Petesch, that the Board concur in the recommendation of the Plan Commission, and the rezoning be.denied. Authorize Redesign Trustee Aberson moved, seconded by Trustee Peterson, Plans - Wilmot Road that plans and psecifications for the improvement of Wilmot Road with 24 ft. pavement and storm sewer be authorized to be prepared. Adopted by the following vote: Ayes: Aberson, Koss, Peterson, Petesch, Porter, Wehle (6) Nays: None (0) Authorize Greengard Plans - Wilmot Road such service to be negotiated vote: Trustee Aberson moved, seconded by Trustee Peterson, that Charles Greengard Assocaiates be authorized to re- design Wilmot Road improvements, the cost of by the Village Manager. Adopted by the following Ayes: Aberson, Koss, Peterson, Petesch, Porter, Wehle (6) Nays: None (0) Resolution - Hackberry Trustee Aberson moved, seconded by Trustee Petesch, Bridge that a resolution be adopted requesting the County Board of Supervisors to participate in the cost of constructing a bridge across the West Fork of the North Branch 'of the Chicago River at Hackberry Avenue. Motion carried unanimously. Authorize Expenditures Trustee Porter moved, seconded by Trustee Petesch, $7,332.47 Sales Tax that expenditures of $7,332.47 previously paid from Sales Tax Funds, as shown in the addit of Wolf and Company, be authorized and approved. Municipal RetCrement that Mr. Norris Stilphen, Village Manager, be appointed authorized agent for the Village of Deerfield in connection with Illinois Municipal Retirement matters. Motion carried unanimously. Police Captain Exam Trustee Petesch moved, seconded by Trustee Aberson, that the Village Manager be directed to notify the Board of Police Commissioners to hold an examination for the position of Police Captain. Motion carried unanimously. Bids - Police Car Trustee Petesch moved, seconded by Trustee Aberson, htat action taken by the Manager in advertising for bids for a police car be ratified. Motion carried' unanimously. Treasurer Not Appointed Trustee Porter moved, seconded by Trustee Petesch, that John E. Kea] be appointed Treasurer and Director of Finance for the Village of Deerfield. Upon roll call, the following vote was recorded: Ayes: Porter, Petesch, Wehle (3) Nays: Aberson, loss, Peterson (3) Motion failed for lack of a majority. The Village Manager was requested to notify Mr. John Howard Wolf that he must continue to act as Village Treasurer until such time as an appointment is made. Ordinance - Manager Salary Trustee Petesch moved, seconded by Trustee Wehle, (0- 59_591 that an ordinance be adopted amending the Salary Ordinance ( #200) by establishing the salary of the Village Manager at $10,000 per year. Rossett Billboard Denied Trustee Porter moved, seconded by Trustee Wehle, that action taken by the Building Commissioner be ratified in denying the renewal of the billboard permit for Mr. Maver Rossett. Motion carried unanimously. Approve Hugh Building Permit Trustee Aberson moved, seconded by Trustee Peterson, that Mr. Joe Hugh's application for a building permit be approved, with face brick at the entrance, and the Building Commissioner be authorized to issue said permit. Motion carried unaimously. Appointments - Board Trustee Koss moved, seconded by Trustee Peterson, of Zoning Appeals that Mr. Edward Gillen be appointed to the Board of Zoning Appeals for a five year term. Upon roll call, the following vote was recorded: Ayes: Aberson, Koss, Peterson (3) Nays: Petesch, Porter, Wehle (3) Mr. Edward Gillen's appointment failed for lack of a majority. .Trustee Koss moved, seconded by Trustee Aberson, that Mr. Richard Gilbert be appointed to the Board of Zoning Appeals for a five year term. Adopted by the following vote: Ayes: Aberson, Kossi;l Peterson, Petesch, Porter, Wehle (6) Nays: None-(0) There being a vacancy on the Board of Zoning Appeals, Trustee Petesch moved, seconded by Trustee Aberson, that Mrs. Willard Loarie be appointed to the Boa d. Mrs. Loarie stated that she appreciated this nomination, but felt she best served the Village as an interested private citizen without an officibl position. Deny Rezoning - Lots 42, Trustee Koss moved, seconded by Trustee Petesch, 43, 78, 79 - Hovland's that Lots 42, 43, 78 and 79, Hovland's First Addition to Deerfield, be rezoned to ,the R -2 classification from the R -3 classification, as petitioned by Mr. E. Sumner Walker. Upon statement by Trustee Porter that the Plan Commission did not recommend this rezoning, Trustee Petesch withdrew his second and moved that the matter be tabled. Seconded by Trustee Porter, Upon.roll call, the following vote was recorded: Ayes:- Petesch,Porter, Wehle (3) Nays: Aberson, Peterson, Koss (3) The motion failed for lack of a majority. Trustee Aberson moved, seconded by Trustee Peterson, that the rezoning of the four lots above mentioned be approved. Authorize Defense Suit - Gaston vs. Deerfield suit filed by Miss Agnes J. have been received in a fal the follow.r.ng vote: Trustee W6hle moved, seconded by Trustee Peterson, that the Village Attorney be authorized to repre- sent and defend the Village of Deerfield in the Gaston against the Village for injuries alleged to on the sidewalk on Deerfield Road. Adopted by Ayes: Aberson, Koss, Peterson, Petesch, Porter, Wehle (6) Nays: None (0) Mr. Sanford, Attorney for B.A.R.E. asked for consideration of their petition for rezoning and annexation at the next Board meeting. Authorize Bids - Maple Trustee Aberson moved, seconded by Trustee Court Water Main Peterson, that advertisement for bids be approved for the Maple Court Water main, said bids to be returnable November 6, 1959 at 4:00 P.M.
