RESOLUTION APPROVING SETTLEMENT OF LITIGATION
WHEREAS, the Village of Deerfield is an Illinois Home Rule municipality
exercising home rule powers pursuant to the Illinois Constitution of 1970; and
WHEREAS, pursuant to Ordinance 0 -97 -37 adopted September 2, 1997, the
Corporate Authorities of Deerfield authorized the acquisition of property at 761 -765 Waukegan
Road through condemnation or otherwise; and
WHEREAS, pursuant to said Ordinance 0- 97 -37, the case known as 97 ED 11 was
filed and is now pending in the Circuit Court of Lake County,- Illinois; (the "Litigation "); and
WHEREAS, all in at issue in the Litigation' have 'been resolved between the
parties, and the Corporate Authorities of the Village of Deerfield desire to approve a settlement.
NOW, THEREFORE, BE IT' RESOLVED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD:
SECTION That the' Village of Deerfield will pay $1,587,500 as just compensation
ONE: for fee simple title of the property at 761 -765 Waukegan Road and
will also pay the 1997 taxes for said property estimated to be
approximately $27,000.
SECTION That the Special Counsel for the Village of Deerfield is hereby
TWO: authorized and directed to obtain a Final Judgment Order in the
Litigation consistent with said terms.
SECTION That the Village Manager and Special Counsel be authorized and
THREE: directed to take such other action as may be required to fully
effectuate the terms of conditions of the settlement of said Litigation.
