Ordinance No. 81 -34 authorizes the Village of Deerfield to grant
telecommunication franchises. Chicago Fiber Optic Corporation d/b /a Metropolitan
Fiber Systems of Chicago, Inc. ( "MFS ") applied to the Village of Deerfield for a
telecommunications franchise. MFS and the Village of Deerfield negotiated a proposed
telecommunications franchise agreement (the "Franchise Agreement ").
A proposed draft of the Franchise Agreement, in a form prepared by the Village
Attorney, was reviewed by, and was determined to be acceptable to, staff and the
Corporate Authorities.
NOW, THEREFORE, BE IT RESOLVED by the President and Board of Trustees
of the Village of Deerfield, Lake and Cook Counties and State of Illinois, as follows:
Section 1 .
A non - exclusive, revocable franchise shall be and is hereby granted to MFS to
operate a telecommunications system pursuant to Ordinance No. 81 -34 within the Village
and pursuant to the Franchise Agreement.
Section 2.
The Mayor and Village Clerk are hereby authorized and directed to execute the
Franchise Agreement with MFS in substantially the form prepared by the Village
Attorney and attached hereto, upon receipt of at least two copies thereof fully executed by
MFS.
Section 3.
The Corporate Authorities agree to grant an easement to MFS to be executed by
the Mayor and Village Clerk, in a form acceptable to the Village Attorney, granting an
easement to MFS for the installation of an underground fiber optics line on Village
property, at such locations as will not interfere with the Village's use of the property. The
Village Clerk is directed to record this easement following execution thereof with the
office of the Lake County Recorder of Deeds.
