RESOLUTION APPROVING A RATE ORDER TO OMNICOM
CABLEVISION OF ILLINOIS, D /B /A POST NEWSWEEK CABLE
WHEREAS, the Village of Deerfield has become a Certified
Franchising Authority pursuant to the Cable Television Consumer
Protection and Competition Act of 1992 (the "Act "), and the
subsequent Federal Communications Commission's regulations
related thereto (the "Regulations "); and
WHEREAS, a Certified Franchising Authority has the authority
under the Act and the Regulations to review, regulate and, if
warranted, order refunds of unreasonable rates of Cable Companies
with a franchise in their jurisdiction; and
WHEREAS, the Village of Deerfield has notified Omnicom
Cablevision of Illinois, Inc. d /b /a Post Newsweek Company ( "Post
Newsweek ") of its status as a Certified Franchising Authority and
has requested that Post - Newsweek submit certain information
regarding its rates; and
WHEREAS, Post Newsweek having submitted their rates for
review to the Village of Deerfield, and having complied with
subsequent requests for additional information made of them; and
WHEREAS, Following the review of the requested information,
Post Newsweek was found to be within their designated benchmark
range(s), as set forth by the Regulations, and a finding of
compliance has been made approving those rates instituted on
September 1, 1993.
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND THE
BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK
COUNTIES, ILLINOIS AS FOLLOWS:
SECTION That the.Corporate Authorities of the Village of
ONE: Deerfield hereby issue the following rate order to
Post Newsweek:
Post Newsweek is hereby informed by the
Village of Deerfield as a Certified
Franchising Authority that its proposed
rates, having complied with their benchmark
requirements pursuant to FCC form 393, are
approved for the period(s) of September 1,
1993 through May 14th, 1994.
SECTION That this resolution should be in full force and
TWO effect from and after its adoption and passage in
the manner provided by law.
SECTION That the Village Clerk is directed.to prepare a
RESOLUTION NO. R -94 -08
THREE certified copy of this resolution and to forward
the same to Post Newsweek.
