RESOLUTION NO. R -94 -01
RESOLUTION ISSUING AN ACCOUNTING ORDER TO OMNICOM
CABLEVISION OF ILLINOIS, INC D /B /A POST NEWSWEEK CABLE
WHEREAS, the Village of Deerfield has become a Certified
Franchising Authority pursuant to the Cable Television Consumer
Protection and Competition Act of 1992 (the "Act "), and the
subsequent Federal Communications Commission's regulations
related thereto (the "Regulations "); and
WHEREAS, a Certified Franchising Authority has the authority
under the Act and the Regulations to review, regulate and, if
warranted, order refunds of unreasonable rates of cable companies
with a franchise in their jurisdiction; and
WHEREAS, the Village of Deerfield has notified Omnicom
Cablevision of Illinois, Inc. d /b /a/ Post Newsweek Cable ( "Post
Newsweek ") of its status as a Certified Franchising Authority and
has requested that Post Newsweek submit certain information
regarding its rates; and
WHEREAS, Post Newsweek has previously submitted insufficient
information regarding its rates and the Village of Deerfield has
issued an order extending the effective date of its review period
to allow Post Newsweek to submit additional information; and
WHEREAS, the extension of the review period will expire on
March 10, 1994 and Post Newsweek has yet to submit the required
additional information; and
WHEREAS, the Village of Deerfield desires to insure that
following a review of the required information a subsequent
ruling by the Village on the rates of Post Newsweek will allow
the Village to order a rate reduction and refunds to subscribers
for any excess rates charged since September 1, 1993 if said
reduction and refund is suggested by the required information.
NOW, THEREFORE, BE
TRUSTEES OF THE VILLAGE
ILLINOIS, AS FOLLOWS:
SECTION That the

Newsweek:
IT RESOLVED BY THE PRESIDENT AND BOARD OF
OF DEERFIELD, LAKE AND COOK COUNTIES,
Corporate Authorities of the Village of
hereby issue the following order to Post
Post Newsweek is hereby directed by the
Village of Deerfield as a Certified
Franchising Authority to continue to maintain
an accurate accounting of all amounts
invoiced and received by Post Newsweek from
its subscribers as a result of the rate
review being conducted by the Village of
Deerfield. The Village of Deerfield will
issue a rate order after receipt and review
of all requested information from Post
Newsweek.
SECTION That this Resolution shall be in full force and
TWO: effect from and after its adoption and passage in
the manner provided by law.
SECTION That the Village Clerk is directed to prepare a
THREE: certified copy of this resolution and to forward
the same to Post Newsweek.
