ORDINANCE NO. 0 -12 -30
AN ORDINANCE AMENDING SECTION 22 -164 OF THE
DEERFIELD MUNICIPAL CODE TO AUTHORIZE A FOUR -WAY STOP
AT ROBERT YORK AVENUE AND OSTERMAN AVENUE
WHEREAS, a traffic warrant engineering study has been conducted to determine whether
multiway stop signs at the intersection of Robert York Avenue and Osterman Avenue (the
"Interscetion ") are warranted in conformance with the standards and guidance published in the
Manual on Uniform Traffic Control Devices ( "MUTCD "); and,
WHEREAS, said warrant study considered the criteria published in the MUTCD for
installation of multiway stop control at the Intersection; and
WHEREAS, the corporate authorities of the Village of Deerfield have considered the traffic
warrant study and the standards and guidance published in the MUTCD; and
WHEREAS, there are multi - family condominium buildings at and near the Intersection of
that can generate high pedestrian volumes near the Intersection, the Deerfield Square shopping
center is located on the north side of Osterman near the Intersection, and there is a railroad grade
crossing of Osterman in proximity to the Intersection; and
WHEREAS, the corporate authorities of the Village of Deerfield have determined that it is
in the interest of public health, safety and welfare to establish the intersection of Robert York
Avenue and Osterman Avenue as a four -way stop intersection;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in
the exercise of its home rule powers, as follows:
SECTION 1: That Section 22 -164 of the Deerfield Municipal Code entitled "Exhibit D,
Stop Street Intersections," be and the same is hereby amended to add the following intersection as a
four -way stop street intersection:
Robert York Avenue and Osterman Avenue (4 -way)
SECTION 2: That this Ordinance, and each of its terms, shall be the effective legislative act
of a home rule municipality without regard to whether such Ordinance should: (a) contain terms
contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a
manner or regarding a matter not delegated to municipalities by state law. It is the intent of the
corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance
should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law
in that regard within its jurisdiction.
SECTION 3: That this Ordinance shall be in full force and effect from and after its passage,
approval and publication in pamphlet form as provided by law.
