ORDINANCE NO. 0 -12 -32
AN ORDINANCE AUTHORIZING THE DISPOSITION
OF CERTAIN SURPLUS PERSONAL PROPERTY OWNED
BY THE VILLAGE OF DEERFIELD
WHEREAS, the Village of Deerfield owns certain items of personal property listed and
described below (the "Surplus Property ") that are no longer necessary or useful for service in the
Village; and,
WHEREAS, the Computer Systems Coordinator has recommended that the Village
dispose of such Surplus Property as provided herein; and,
WHEREAS, the corporate authorities of the Village of Deerfield concur in the
recommendation of the Computer Systems Coordinator and hereby determine that the items of
personal property described below are surplus property and are no longer necessary for the use of
the Village and should be disposed of as authorized in this Ordinance;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, in the exercise of its home rule powers, as follows:
SECTION 1: The President and Board of Trustees of the Village of Deerfield do hereby
find and determine that the items of personal property described below (the "Surplus Property ")
are no longer necessary for, useful to or in the best interests of the Village of Deerfield, and that
the Village would be best served by the disposition of said Surplus Property.
1. Miscellaneous obsolete cellular telephone equipment
SECTION 2: That the Computer Systems Coordinator of the Village of Deerfield is
hereby authorized and directed to dispose of such items provided that the items shall be disposed
of "As Is ", with the Village making no express or implied guarantees or warranties of any kind
whatsoever. The Computer Systems Coordinator of the Village of Deerfield is authorized and
directed to cause the property to be disposed of by recycling or disposal as appropriate.
SECTION 3: That this Ordinance, and each of its terms, shall be the effective legislative
act of a home rule municipality without regard to whether such Ordinance should: (a) contain
terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b)
legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the
intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of
this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall
supersede state law in that regard within its jurisdiction.
SECTION 4: That this Ordinance shall be in full force and effect from and after its
passage, approval and publication in pamphlet form as provided by law.
