AN ORDINANCE AMENDING THE ZONING ORDINANCE
OF THE VILLAGE OF DEERFIELD TO AUTHORIZE CHILD
ENRICHMENT CENTERS AS A SPECIAL USE IN THE R -1
SINGLE - FAMILY RESIDENCE DISTRICT
WHEREAS, the Petitioners, Starland LLC as contract purchaser and True Way
Presbyterian Church as owner and contract seller of certain property at 445 Pine Street, have
petitioned the Plan Commission of the Village of Deerfield for a text amendment to the Zoning
Ordinance of the Village of Deerfield to permit a child enrichment center as a special use in an
R -1 Single- Family Residence District, and to allow identification wall signage for a child
enrichment center approved as a special use in the R -1 Single - Family Residence District; and,
WHEREAS, the Plan Commission of the Village of Deerfield held a public hearing on
October 13 and December 8, 2011 to consider said text amendment, said hearing being held
pursuant to public notice and conforming in all respects, in both manner and form, with the
requirements of the statutes of the State of Illinois and the Zoning Ordinance of the Village of
Deerfield; and,
WHEREAS, the Plan Commission of the Village of Deerfield, after considering the
evidence and supporting materials presented at said hearing, submitted its written report and
findings of fact to the Board of Trustees of the Village of Deerfield recommending approval of a
text amendment the Zoning Ordinance of the Village of Deerfield to allow a child enrichment
center as a special use in the R -1 Single - Family Residence District and to allow identification
wall signage for a child enrichment center approved as a special use in the R -1 Single - Family
Residence District; and,
WHEREAS, the President and Board of Trustees of the Village of Deerfield concur in
the recommendation of the Plan Commission and have determined that it is in the best interests
of the Village of Deerfield that the text of the Zoning Ordinance be amended as provided herein;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, in the exercise of its home rule powers, as follows:
SECTION 1: That Paragraph I ( "Educational Institutions ") of Article 4.01 -C ( "Special
Uses ") of Article 4 ( "Residential Districts ") of the Zoning Ordinance of the Village of Deerfield
be and the same is hereby amended to add the following as Subparagraph f thereof:
f. a child enrichment center when conducted on non - residential properties.
SECTION 2: That Section 14.02 ( "Definitions ") of Article 14 ( "Rules and Definitions ")
of the Zoning Ordinance of the Village of Deerfield be and the same is hereby amended to add
the following as a defined term:
CHILD ENRICHMENT CENTER: A facility that offers instruction in a range of
at least five of the following classes: art, dance, drama, voice, music, academics,
fitness, fashion design, jewelry making, and similar instructional classes.
Performances, theater productions, parties, and camps may be provided when
approved as part of the facility.
SECTION 3: That Paragraph 1 ( "Identification Signs ") of Article 9.02 -A ( "Residential
Districts ") of Article 9 ( "Signs ") of the Zoning Ordinance of the Village of Deerfield be and the
same is hereby amended to add the following as Paragraph g. thereof-
g. Identification Signage for a Child Enrichment Center

(1) Number and Content
There shall not be more than one (1) identification sign for each zoning
lot. Such sign shall indicate only the name and /or address and logo of the
child enrichment center.
(2) Type
An identification sign may be a wall sign only.
(3) Area
No identification sign shall have more than one (1) sign face. The gross
surface area of the sign shall not exceed twenty -two (22.5) square feet.
(4) Location
An identification sign shall be located on the same zoning lot as the
principal use to which it is accessory, and shall be located on a wall of the
principal building fronting a public street, public right -of -way, easement
for access, or parking area.
(5) Height
An identification sign shall have a maximum height not to exceed ten feet
six inches (10' 6 ") above grade.
SECTION 4: That this Ordinance, and each of its terms, shall be the effective legislative
act of a home rule municipality without regard to whether such Ordinance should: (a) contain
terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b)
legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the
intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of
this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall
supersede state law in that regard within its jurisdiction.

SECTION 5: That this Ordinance shall be in full force and effect from and after its
passage, approval and publication in pamphlet form as provided by law.
