O-12-20VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0 -12 -20 AN ORDINANCE AMENDING SECTION 6 -6 ( "FEES ") AND SECTION 6 -79 ( "SCHEDULE OF CHAPTER 6 FEES, CHARGES AND RATES ") OF CHAPTER 6 ( "BUILDING ") OF THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD WHEREAS, the Village of Deerfield is a home rule unit of local government pursuant to the provisions of Article VII, Section 6 of the Illinois Constitution of 1970; and WHEREAS, as a home rule unit of local government, the Village may exercise any power and perform any function pertaining to its government and affairs including, but not limited to, the power to regulate for the protection of the public health, safety, moral and welfare, to license, and to tax, except as limited by Article VII, Section 6 of the Illinois Constitution; and WHEREAS, the corporate authorities of the Village of Deerfield have determined that the demolition of existing buildings, the construction of new buildings and the renovation of existing buildings in the Village, including related site development activities ( "Construction Work "), place an additional demand on and serve to shorten the expected life span of the Village's capital facilities and infrastructure, including but not limited to streets, sidewalks, water mains, sanitary and storm sewers, overland drainage facilities, public trees and streetscape improvements by reason of, among things, increased vehicle traffic including heavy vehicles, street cuts, the compaction or loosening of soil, erosion, silting of catch basins, drains and pipes and the collapse or blockage of utility facilities; and WHEREAS, the depreciation of and damage done to public infrastructure as a result of Construction Work in the Village is in addition to the normal wear and tear imposed on public Page 1 of 8 infrastructure facilities; and WHEREAS, the depreciation of and damage done to public infrastructure facilities as a result of Construction Work is typically incremental in nature and often cannot be directly connected to a particular site or to particular building construction, demolition or site development activities; and WHEREAS, the corporate authorities of the Village of Deerfield have determined that it is in the public interest of the Village of Deerfield and the resident taxpayers of the Village of Deerfield that an infrastructure impact fee be charged at the rate of one -half percent (0.5 %) of the estimated cost of permitted Construction Work, and should be imposed and collected as an incident to the issuance of building permits for any building construction or demolition activity which requires a building permit under the Municipal Code of the Village of Deerfield at the rates set forth in this Ordinance, or at the rates as may hereafter be set forth in a future annual fee resolution adopted by the corporate authorities, the proceeds of which infrastructure impact fee shall be deposited in the Infrastructure Fund for the purpose of defraying the cost of future infrastructure improvements and repairs; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: That the above and foregoing recitals, being material to this Ordinance, are hereby incorporated and made a part of this Ordinance as if fully set forth herein. SECTION 2: That Section 6 -6 ( "Fees ") of Chapter 6 (Building) of the Municipal Code of the Village of Deerfield, as amended, be and the same is hereby further amended to read as follows (additions are indicated by underscoring and deletions are indicated by strikethFeugh Page 2 of 8 markings): Sec. 6 -6. Fees, Charges, Rates and Taxes: (a) No permit or amendment thereto shall be issued without the-fee being paid. The sehedule shall be as pFevided fOF in seetien 6 79 ef this ehaptef-. fees, charges, rates and taxes set forth in section 6 -79 of this chanter being paid (b) Any person granted a building permit or a demolition permit under the provisions of this chanter, who is not exempted from paving hermit fees under section 6-7 of this all pay an infrastructure impact fee at the rate se forth in section 6 -79 of this chanter, or the rate set forth in the Annual Fee Resolution as defined in this Code. The infrastructure impact fee imposed pursuant to this subsection shall be in addition to any building_ permit fee or demolition permit fee set forth in section 6 -79 of this chapter, The funds received by the Village shall be deposited in the Infrastructure Fund. Imposition of the infrastructure impact fee pursuant to this subsection shall not apply_ to any demolition or any building construction, renovation or remodeling for which -a complete and proper permit application was on file with the Village on or before June 1.2012. SECTION 3: That Section 6 -79 (Schedule of Fees, Charges and Rate) of Chapter 6 (Building) of the Municipal Code of the Village of Deerfield, as amended, be and the same is hereby further amended to read as follows (additions are indicated by underscoring and deletions are indicated by strikethreugk markings): 6 -79. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of Page 7 of 8 this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction. SECTION 5: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law. PASSED this 7th day of May 2012.
