VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0 -12 -23 AN ORDINANCE APPROVING A VARIATION AND SIGN MODIFICATIONS FOR THE McDONALD'S RESTAURANT At 50 WAUKEGAN ROAD WHEREAS, Petitioner Franchise Realty Investment Trust.IL, a Maryland real estate investment trust (the "Petitioner "), the owner of the McDonald's Restaurant (the "Restaurant ") on the property commonly known as 50 Waukegan Road (the "Subject Property"), has petitioned the Village of Deerfield for: (1) a variation from the requirements of Article 8.02- E(2)(i)(1) and (2) of the Zoning Ordinance of the Village of Deerfield to permit the number of parking spaces required for the Restaurant to be reduced from 97 spaces to 80 spaces to allow a reconfiguration of the Subject Property site to accommodate the relocation of the refuse enclosure, the provision of accessible parking that is accessible via the shortest available accessible path of travel, an additional drive- through order station, and new internal curbing to allow motor vehicle cross - access through the Golden Bear /Atrium PUD to the Lake -Cook Road curb cut providing access to the Golden Bear /Atrium PUD and to the signalized Waukegan Road curb cut providing access to the Subject Property via a cross - access easement agreement; and WHEREAS, Petitioner further petitioned the Village of Deerfield for: (1) a modification to the requirements of Article 9.02- B(2)(a)(1) and (2) of the Zoning Ordinance to allow for the installation of a second wall sign (a yellow swish) on the east elevation of the building, (2) a modification to the requirements of Article 9.02- B(2)(b)(1) of the Zoning Ordinance to permit the erection of a sign (the yellow swish) that is 213 square feet in size on the east elevation of the building, (3) a modification to the requirements of Article 9.02- B(2)(d)(1) of the Zoning Ordinance to permit (i) a wall sign (the yellow swish) to be located at a height of 20 feet 1, which is inch above the parapet line of the roof of the Restaurant building on the east elevation, and (ii) a portion of a second wall sign (the Golden Arches "M ") erected on the east elevation to project above the parapet line of the roof of the Restaurant building, (4) a modification to allow for the erection of a wall sign (a "McDonald's" sign) located above the roof deck on the south (drive - through) elevation of the Restaurant building, and (5) a modification to permit a wall sign (the Golden Arches "M" logo sign) to be located on the north elevation of the Restaurant building at a height above the roof deck; and (6) a modification to the requirements of Article 9.01 -A(5) of the Zoning Ordinance to allow for the construction, installation and maintenance of certain directional signs on the Subject Property, all as more fully described herein (collectively, the "Sign Modifications "); and, WHEREAS, the Board of Zoning Appeals of the Village of Deerfield held a public hearing on April 17, 2012 to consider said petition, said hearing being held pursuant to public notice duly given and published as required by statute and conforming in all respects, in both manner and form, with the provisions of the Zoning Ordinance of the Village of Deerfield; and, WHEREAS, the Board of Zoning Appeals has filed its report with the President and Board of Trustees containing its written findings that the requested variation conforms to the standards for variations set forth in Article 13.07 -E of the Zoning Ordinance of the Village of Deerfield and recommending that the President and Board of Trustees grant the requested variation to allow the number of parking spaces required for the Restaurant on the Subject Property to be reduced from ninety -seven (97) parking spaces to eighty (80) parking spaces, including accessible parking spaces; and, -2- WHEREAS, the Board of Zoning Appeals has filed its report with the President and Board of Trustees containing its written findings that the requested Sign Modifications be granted to allow modifications in the number, size, height and character of certain building and ground signs as more fully described in this Ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: That the above and foregoing recitals be and the same are incorporated and made a part of this Ordinance as if fully set forth herein. SECTION 2: That the findings of fact and recommendations of the Board of Zoning Appeals are concurred in and adopted as the findings of fact of the President and Board of Trustees. SECTION 3: That the Petitioners have proven to the satisfaction of the Board of Zoning Appeals and the Board of Trustees that strict enforcement of the requirements of Sections 8.02- E(2)(i)(1) and (2) of the Zoning Ordinance of the Village of Deerfield providing for the number of parking spaces required to be provided for the Restaurant will pose practical difficulty or unnecessary hardship as applied to the following described property (the "Subject Property ") unless varied as provided herein: That portion of the South West quarter of the South East quarter of Section 33, Township 43 North, Range 12, East of the 3`d P. M., described as follows: A parcel of land 300.0 feet wide lying Northerly of a line perpendicular to the center of Waukegan Road, at a point on said center line of Waukegan Road, 450.0 feet North Westerly from the intersection of said center line of Waukegan Road with the South line of the South West quarter of the South East quarter of Section 33 and extending from said center line of Waukegan Road to the West line of said South West quarter of the South East quarter of Section 33, the Northerly boundary of said parcel of land being 300.0 feet North Westerly and parallel to its Southerly boundary (except the West 150.0 feet measured at right angles to the West line of the South West quarter -3- of the South East quarter of said Section 33, and except the North Easterly 50.0 feet taken for Waukegan Road), in Lake County, Illinois. SECTION 5: Pursuant to Articles 9.02- B(2)(a)(1) and (2), Article 9.02- B(2)(b)(1), Article 9.02- B(2)(d)(1) and Article 9.01 -A(5) of the Zoning Ordinance of the Village of Deerfield, the following described Sign Modifications be and the same are hereby granted, consistent with the signage exhibits described in Section 4 of this Ordinance: (i) a modification to the requirements of Article 9.02- B(2)(a)(1) and (2) of the Zoning Ordinance to allow for the installation of a second wall sign (a yellow swish) on the east elevation of the building, provided, however, that the swish sign may never be internally illuminated; -5- (ii) a modification to the requirements of Article 9.02- 13(2)(b)(1) of the Zoning Ordinance to permit the erection of a sign (the yellow swish) that is 213 square feet in size on the east elevation of the building, (iii) a modification to the requirements of Article 9.02- 13(2)(d)(1) of the Zoning Ordinance to permit: (i) a wall sign (the yellow swish) to be located at a height of 20 feet 1 inch, which is above the parapet line of the roof of the Restaurant building on the east elevation, and (ii) a portion of a second wall sign (the Golden Arches "M ") erected on the east elevation to project above the parapet line of the roof of the Restaurant building, (iv) a modification to the requirements of Article 9.02- 13(2)(d)(1) of the Zoning Ordinance allow for the erection of a wall sign ( "McDonald's ") located above the roof deck on the south (drive - through) elevation of the Restaurant building, and (v) a modification to permit a wall sign (the Golden Arches "M" logo sign) to be located on the north elevation of the Restaurant building; and (vi) a modification to the requirements of Article 9.01 -A(5) of the Zoning Ordinance to allow for the construction, installation and maintenance of certain directional signs on the Subject Property, SECTION 6: That the variations and sign modifications hereby granted are subject to compliance by the Petitioners with the requirements of this Ordinance, with all applicable provisions of the Zoning Ordinance of the Village of Deerfield, and with all other applicable codes and ordinances of the Village of Deerfield. SECTION 7: That this Ordinance, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction. in SECTION 8: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law.
