VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0 -11 -01 AN ORDINANCE AMENDING SECTION 22 -80 (PENALTY) OF ARTICLE 12 (PARKING REGULATIONS) OF CHAPTER.22 (VEHICLES AND TRAFFIC) OF THE DEERFIELD MUNICIPAL CODE WHEREAS, the Village of Deerfield has not amended its schedule of penalties for various motor vehicle parking and standing violations since 1979; and, WHEREAS, the Chief of the Deerfield Police Department has submitted his recommendation for an amendment to the schedule of penalties provided in Section 22 -80 of the Deerfield Municipal Code; and, WHEREAS, the Mayor and Board of Trustees of the Village of Deerfield concur in the recommendation of the Police Chief; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: That Section 22 -80 entitled "Penalty ", of Article 12 entitled "Parking Regulations ", of Chapter 22 entitled "Vehicles and Traffic ", of the Municipal Code of the Village of Deerfield, as amended, be and the same is hereby amended to read as follows: See. 22 -80. Compromise Penalty for Parking and Standing Violations: (a) Process of Settlement: Any person accused of any of the following enumerated motor vehicle parking or standing offenses may, in lieu of a court appearance, settle and compromise the ordinance violation notice or citation by payment of the fines and penalties hereinafter provided in accordance with the instructions contained in the citation or violation notice. (b) Payment Schedule: The parking or standing offense described in any citation issued pursuant to this Section may be settled, compromised and paid in the respective amounts set forth in the following payment schedule. Citations issued pursuant to this section may be compromised and settled for the compromise amount if paid within the time specified in the citation. Compromise Parking or Standing Violation Amount 1. In a designated no- loading zone $25.00 (Section .22- 64(a)(3 )). 2. In any intersection $25.00 (Section 22- 64(1)(4)). 3. In any crosswalk $25.00 (Section 22- 64(64(a)(4)). 4. Upon any bridge or viaduct, $25.00 or in any subway or approach thereto (Section 22- 64(a)(7)). 5. Between a safety zone and the $25.00 adjacent curb, or within 30 feet of points on the curb immediately opposite the ends of a safety zone (Section 22- 64(a)(5)). 6. At any place where vehicle standing $25.00 will reduce usable roadway width to less than 12 feet (Section 22- 64(a)(9)). 7. Within 15 feet of a fire hydrant $25.00 (Section 22- 64(b)(2)). 8. Obstruction of any driveway $25.00 (Section 22- 64(b)(d)(1)). 9. Within 20 feet of a crosswalk or an $25.00 intersection (Section 22- 64(b)(3)). 10. Within 30 feet of any stop sign, yield $25.00 sign or traffic control signal (Section 22- 64(b)(4)). 11. At any place where parking is prohibited $25.00 for snow removal (Section 22 -71). 12. For violation of Village parking lot $25.00 regulations (Section 22 -130). 13. For failure to pay parking fees for parking $25.00 in Village parking lots (Section 22- 129A). 14. Parking on Village streets between the hours $25.00 of 10 o'clock a.m. and 12 o'clock noon where prohibited (Section 22 -165). 15. Within 50 feet of the nearest rail of a $25.00 railroad grade crossing (Section 22- 64(c)(1)). 16. On any sidewalk or parkway $25.00 (Section 22- 64(a)(2)). 17. At any place where official signs $25.00 prohibit parking (Section 22- 64(c)(2)). 18. Failure to park parallel to within $25.00 12 inches of the curb line (Section 22 -65). 19. Parking with the left side of the vehicle $25.00 next to the curb, except on one -way streets (Section 22 -65). 20. Displaying vehicle for sale $25.00 (Section 22 -66). 21. Violation of all -night parking $25.00 restrictions (Section 22 -67). 22. Where prohibited for street cleaning $25.00 (Section 22 -72). 2' ). Parking on private property without $25.00 consent (Section 22 -73). 24. All other parking violations not listed $25.00 above and described in Article 12 of this Chapter. (c) Late Payment Amount: Failure to pay the compromise penalty assessed pursuant to paragraph (b) of this Section within thirty (3 0) days shall result in an increase of said compromise penalty to twice the amount set forth in this Section. (d) Payment of Fines: Fines and compromise penalties assessed pursuant to this Section shall be paid at the Village Hall or Police Department and a receipt shall be issued for all money so received. All money received pursuant to this Section shall be promptly turned over to the Village Treasurer to be used in the manner provided for the disposition of fines for traffic violations. (e) Filing_ Complaint: In the event that the person to whom the citation is issued fails to settle and pay compromise penalty amount within the time prescribed in this Section (or within the period of time otherwise specified in a final notice if a final notice is served upon the offender), a Notice to Appear or Uniform Traffic Complaint may be issued to said offender for the violation and said person shall be subject to the general penalty set forth in this Section. (f) General Penalty: Unless another penalty is otherwise specifically provided in Article 12 of this Chapter, any person violating any provision of Article 12 of this Chapter shall, upon conviction, be subject to a fine of not less than Seventy Five Dollars ($75.00) and not more than Five Hundred Dollars ($500.00), and court costs. SECTION 2: All ordinances or parts of ordinances in conflict herewith are hereby repealed; provided, however, that nothing contained herein shall affect any rights, actions or causes of action which shall have accrued to the Village of Deerfield prior to the effective date of this Ordinance. SECTION 3: That this Ordinance, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction. SECTION 4: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law. PASSED this 18th day of January , ?011.
