VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0 -10 -27 AN ORDINANCE REZONING PROPERTY AT 1313 AND 1331 WILMOT ROAD (WOODLAND PARK) AS P -1 PUBLIC LANDS DISTRICT AND AUTHORIZING AN AMENDED SPECIAL USE FOR RENOVATIONS TO WOODLAND PARK WHEREAS, the Deerfield Park District (the "Applicant ") is the owner of a certain 17.12 acre parcel of property legally described on Exhibit A attached hereto (the Subject Property) and commonly known as 1313 and 1331 Wilmot is located in the Village of Deerfield which is currently zoned in the R -1 Single - Family Residence District; and, WHEREAS, the Applicant has petitioned the Village of Deerfield to rezone the Subject Property as P -1 Public Lands District, for the vacation of a portion of the northern portion of Crabtree Lane within Woodland Park, and for approval of an amendment to the Special Use for the Subject Property in the P -1 Public Lands District to permit certain renovations and improvements to Woodland Park including: (i) the razing of a 36,000 square foot former school building to provide open green space; (ii) the addition of a new picnic shelter with restroom facilities; (iii) an enlarged parking lot; (iv) the replacement of playground equipment; (v) relocation of the basketball court; (vi) savannah restoration; and (vii) the extension of walking trails and bicycle paths (collectively referred to herein as the "Woodland Park Renovations "); and, WHEREAS, the Plan Commission of the Village of Deerfield held a public hearing on May 6, 2010 to consider said application for rezoning the Subject Property to the P -1 Public Lands District, for the vacation of the northern portion of Crabtree Lane within Woodland Park, and for approval of an amendment to the previously approved Special Use for the Subject Property in the P -1 Public Lands District to permit Woodland Park Renovations, said hearing being held pursuant to public notice duly given and published as required by statute and conforming in all respects, in both manner and form, with the requirements of the statutes of the State of Illinois and the Zoning Ordinance of the Village of Deerfield; and, WHEREAS, the Plan Commission of the Village of Deerfield, after considering the testimony, documentary evidence and supporting materials offered at said public hearing, filed its report with the President and Board of Trustees containing its written findings of fact and recommendation to rezone the Subject Property from the R -1 Single - Family Residence District to the P -1 Public Lands District, to vacate the northern portion of Crabtree Lane within Woodland Park, and to authorize an amended Special Use pursuant to Article 7.02 -13, Paragraph 4 and Article 13.11 of the Zoning Ordinance of the Village of Deerfield to permit the Woodland Park Renovations as an amendment to the previously approved Special Use for the Subject Property in the P -1 Public Lands District, all in accordance with the plans and supporting materials submitted by the Applicant which are incorporated herein and made a part hereof by this reference; and, WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the best interests of the Village will be served by amending the Zoning Map of the Village of Deerfield to change the zoning classification of the Subject Property from the R -1 Single- Family Residence District to the P -1 Public Lands District; and, WHEREAS, the President and Board of Trustees of the Village of Deerfield have further determined that part of the northern portion of Crabtree Lane within Woodland Park is no longer needed for public street purposes and can be vacated pursuant to Applicant's request and in accordance with a plat of vacation to be prepared and approved by a separate ordinance; and WHEREAS, the President and Board of Trustees of the Village of Deerfield have further -2- determined that the proposed amended Special Use for the Woodland Park Renovations fully complies with the requirements and standards set forth. in Article 7.02 -B, Paragraph 4, and Article 13.11 of the Zoning Ordinance of the Village of Deerfield, and that the best interests of the Village will be served by the further authorization and granting of the requested amendment to the Special Use for the Subject Property to permit the Woodland Park Renovations to the extent provided; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE. OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: That the above and foregoing recitals, being material to this Ordinance, are hereby incorporated by this reference and made a part of this Ordinance as if fully set forth herein. SECTION 2: That the President and Board of Trustees of the Village of Deerfield do hereby authorize and approve an amendment to the Zoning Map of the Village of Deerfield to change the zoning classification of the property legally described on Exhibit A attached hereto from the R -1 Single - Family Residence District to the P -1 Public Lands District, subject to the Amended Special Use for the proposed Woodland Park Renovations as hereby approved and authorized. SECTION 3: That the President and Board of Trustees do hereby affirmatively find that the proposed Woodland Park Renovations, hereby authorized as an amended Special Use of the Subject Property in P -1 - Public Lands District, fully complies with the requirements and standards for modifications set forth in Article 7.02 -B, Paragraph 4 and Article 13 -11 of the Zoning Ordinance of the Village of Deerfield. -3- SECTION 4: That the President and Board of Trustees of the Village of Deerfield do hereby authorize and approve the establishment, operation and maintenance of the Woodland Park Renovations, as more fully described on the plans and supporting documents incorporated as part of Exhibit B to this ordinance, including but not limited to: (i) the razing of a 36,000 square foot former school building to provide open green space; (ii) the addition of a new picnic shelter with restroom facilities; (iii) an enlarged parking lot; (iv) the replacement of playground equipment; (v) relocation of the basketball court; (vi) savannah restoration; and (vii) the extension of walking trails and bicycle paths (collectively referred to herein as the "Woodland Park Renovations "), all as an amendment to the Special Use previously approved for the Subject Property in the P -1 Public Lands District pursuant to Article 7.02 -B, Paragraph 4 of the Zoning Ordinance of the Village of Deerfield, subject to the conditions, regulations and restrictions set forth in Section 5 of this ordinance. SECTION 5: That the approval and authorization of said amended Special Use is granted subject to the following additional conditions, regulations and restrictions: (i) The construction, development, maintenance and use of the Woodland Park Renovations shall be in accordance with the site plan, floor plans, elevations, landscape plans, photometric plans, signage plans and supporting materials attached hereto and made a part of this Ordinance as Exhibit B hereof, and with all representations made and submitted by the Applicant to the Plan Commission and to the President and Board of Trustees; (ii) Compliance by the Applicant with all other applicable provisions of the Zoning Ordinance of the Village of Deerfield. SECTION 6: That the amended Special Use as hereby authorized shall be binding upon and inure to the benefit of the Applicant and to Applicant's successors, grantees, transferees and assigns, and any violation of the conditions herein set forth by' the Applicant or its successors, grantees, transferees or assigns shall authorize the revocation of the amended Special Use as hereby authorized. ME SECTION 7: That this Ordinance, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction. The following should answer any questions or concerns regarding emergency vehicle access: 1. The fire department does not foresee any emergency vehicle access issues with the proposed parking lot and site improvements for the Woodland Park project. 2. Emergency vehicle access for the shelter area will be from the proposed eight -foot sidewalk. The sidewalk shall be designed to meet emergency vehicle GVW limits. A complete life safety plan review will be done when complete construction plans and documents have been submitted to the fire department. Have a safe day.
