PASSED AND APPROVED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, this 17th day of MaV , 2010. -2- VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0 -10 -15 AN ORDINANCE AMENDING ARTICLE 12 (SPECIAL PURPOSE BOARDS AND COMMISSIONS) OF CHAPTER 2 (ADMINISTRATION) OF THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD TO ESTABLISH THE SUSTAINABILITY COMMISSION AND TO ELIMINATE THE ENVIRONMENTAL COMMISSION AND THE ENERGY AND RECYCLING COMMISSION WHEREAS, the Energy and Recycling Commission has recommended that the Energy and Recycling Commission be reconstituted as the Deerfield Sustainability Commission, and that its mission be established to assist and educate the entire Deerfield community on sustainability, meaning the use of resources such that they do not become depleted or permanently damaged, and requiring the balancing of environmental, economic and social demands; and, WHEREAS, the mission of the Sustainability Commission would overlap the currently established Environmental Commission and the Energy and Recycling Commission, and represents an evolution of the environmental, energy and recycling purposes of those commissions; and, WHEREAS, the Environmental Commission has been inactive in recent years; and, WHEREAS, the corporate authorities of the Village of Deerfield concur in the recommendation of the Energy and Recycling Commission and are of the opinion that members of the Energy and Recycling Commission should continue as members of the Sustainability Commission, subject to appointment by the President and confirmation by the Board of Trustees; -3- NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: That Section 2 -156 (Establishment; Number Of Members) of Article 12 (Special Purpose Board and Commissions) of Chapter 2 (Administration) of the Municipal Code of the Village of Deerfield, as amended, be and the same is hereby further amended to read as follows (additions are indicated by underscoring and deletions are indicated by stFikethr-eugh markings): See. 2 -156. Establishment; Number of Members: There are hereby established the following special purpose boards and commissions within the village: Appearance review commission B 5 members Community relations commission B 7 members Deerfield cable and telecommunications commission B 9 members Deerfield cemetery commission B 3 members Family Days commission B 9 members Fine arts commission B 7 members Manpower commission B 5 members Safety commission B 7 members Sustainability commission B 12 members Village center district development and redevelopment commission B 9 members SECTION 2: That Subsection (a)(3) entitled "Environmental Commission" of Section 2 -158 (Duties and Functions) of Article 12 (Special Purpose Boards and Commissions) of Chapter 2 (Administration) of the Municipal Code of the Village of Deerfield is hereby retitled as "Sustainability Commission" and is further amended to read as follows: -4- (3) Sustainability Commission: (A) Establishment and Purpose: The Sustainability Commission is established to optimize Deerfield's potential in environmentally sound practices, thereby improving the quality of our local environment for the benefit of our citizens, businesses and neighbors with respect to "sustainability," meaning the use of resources such that they do not become depleted or permanently damaged and requiring the balancing of environmental, economic and social demands. (B) Membership and Terms of Appointment: The Sustainability Commission shall consist of persons with a demonstrated interest in the sustainable use and reuse of resources, considering environmental, economic and social demands. The Sustainability Commission shall consist of twelve (12) voting members appointed pursuant to Section 2 -157 of this Article and such additional ex- officio members the President and Board of Trustees may deem necessary. (C) Functions and Duties: The Sustainability Commission shall act in an advisory capacity to the President and Board of Trustees, to the Village administration and to the Deerfield community to optimize the potential of the Village and the Deerfield community in environmentally sound practices with a view toward improving the quality of the local environment for the benefit of our citizens, businesses and neighbors. The Sustainability Commission shall have the following functions, duties and missions: 1. To educate and actively engage the Deerfield community regarding the benefits of living sustainably. 2. To make environmental information and resources readily available. To create partnerships with interested parties to help achieve our mutual sustainability goals. 4. To recommend sustainable initiatives which are fiscally responsible and enhance economic vitality. (D) Meetings: The commission may meet as necessary, but shall meet at least once during each fiscal year. -5- (E) Terms of Appointment: The Sustainability Commission shall consist of twelve (12) members, and such ex- officio members as the President and Board of Trustees may deem necessary from time to time. All members shall be appointed for a term of three (3) years. Initially, four (4) members shall be appointed for a term of three (3) years, four (4) members for a term of two (2) years, and four (4) members for a term of one (1) year. All appointments thereafter shall be for a period of three (3) years, as provided in Section 2 -157 of this Article. SECTION 3: That Subsection (a)(7) entitled "Energy and Recycling Commission" of Section 2 -158 (Duties and Functions) of Article 12 (Special Purpose Boards and Commissions) of Chapter 2 (Administration) of the Municipal Code of the Village of Deerfield is hereby repealed. SECTION 4: That this Ordinance, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction. SECTION 5: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law. PASSED this 17th day of May , 2010.
