VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0 -09 -03 AN ORDINANCE AUTHORIZING AN AMENDMENT TO THE SIGN PLAN FOR THE LAKE COOK PLAZA SHOPPING CENTER PUD FOR A NEW PYLON SIGN AND A SIGN MODIFICATION WHEREAS, Lake Cook Plaza LLC (the "Petitioner "), being the owner of certain property commonly known as Lake Cook Plaza Shopping Center (to be renamed Deerfield Park Plaza) and legally described on Exhibit A attached hereto (the "Subject Property"), has petitioned the Plan Commission of the Village of Deerfield for an amendment to the approved signage plan for the Lake Cook Plaza Shopping Center PUD to allow the existing pylon ground sign on the Subject Property to be replaced with a new pylon ground sign as described herein, including a modification to allow the proposed new pylon sign to exceed the maximum permitted area of 120 square feet, all as an amendment to the Lake Cook Plaza Shopping Center Planned Unit Development heretofore approved as a Special Use of the Subject Property in the C -2 Outlying Commercial District; and, WHEREAS, the Plan Commission of the Village of Deerfield held a public hearing on January 8, 2009 to consider said amendment to the approved signage plan for the Lake Cook Plaza Shopping Center Planned Unit Development and sign modification to allow a new twenty-five foot (25.0 ft.) tall, internally illuminated double -sided pylon ground sign to be installed and maintained on the Subject Property, with one hundred ninety-one (191 sq. ft.) square feet of area per sign face containing the name and address of the shopping center and twenty-three (23) individual tenant identification panels, as a replacement to the existing pylon ground sign on the Subject Property; and, WHEREAS, said public hearing was held pursuant to public notice duly given as required by law and conforming in all respects, in both manner and form, with the requirements of the Zoning Ordinance of the Village of Deerfield; and WHEREAS, the Plan Commission of the Village of Deerfield, after considering the proposed amendment to the approved signage plan for the Lake Cook Plaza Shopping Center, and the evidence and supporting materials offered at said hearing, has submitted its written report and recommendation to the President and Board of Trustees of the Village of Deerfield that the requested amendment to the approved signage plan for the Lake Cook Plaza Shopping Center PUD and sign modification be authorized pursuant to Article 9.02 -B, paragraph 4 and Article 13.11 of the Zoning Ordinance of the Village of Deerfield as an amendment to the Special Use Shopping Center Planned Unit Development of the Subject Property in the C -2 Outlying Commercial District; and, WHEREAS, the President and Board of Trustees of the Village of Deerfield find that an amendment to the approved signage plan for the Lake Cook Plaza Shopping Center PUD should be approved for the Subject Property authorizing and approving a twenty -five foot (25.0 ft.) tall internally illuminated double -sided pylon sign on the Subject Property, with one- hundred ninety -one (191 sq. ft.) square feet of area per sign face containing the name "Deerfield Park Plaza" and twenty - three (23) individual tenant identification panels, all in accordance with the evidence, testimony, plans and supporting materials presented by the Petitioner at the public hearing and as provided herein; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: That the President and Board of Trustees of the Village of Deerfield do hereby find that said amendment to the approved signage plan for the Lake Cook Plaza Shopping Center fully complies with the requirements and standards set forth in Article 9.02 -B, paragraph 4 and Article 13.11 of the Zoning Ordinance of the Village of Deerfield. SECTION 2: That an amendment to the approved signage plan for the Subject Property is hereby authorized and approved as an amendment to the Special Use Planned Unit Development of the Subject Property in the C -2 Outlying Commercial District authorizing and permitting: (i) an internally illuminated, double -sided pylon ground sign measuring 25.0 feet from grade level to the top of the sign, supported by steel posts clad in red brick creating 2.0 ft. by 2.0 ft. red brick columns framing the sign, with a 26.0 sq.ft. (per side) architectural element at the top of the sign containing the name and address of the shopping center, and a 165.0 sq.ft. (per side) sign panel consisting of 23 individual tenant panels, to replace an existing pylon ground sign at the southeast quadrant of the main entrance drive from Lake Cook Road into Lake Cook Plaza (to be known as Deerfield Park Plaza) shopping center; and (ii) a modification from the regulations set forth in Article 9, Signs, of the Zoning Ordinance of the Village of Deerfield to permit an increase in the maximum allowable area of the ground sign from 120 square feet per sign face to 191 square feet per sign face, all in accordance with the plans, drawings and supporting exhibits listed on Exhibit B attached hereto. SECTION 3: That the approval of said amended signage plan authorizing a new pylon ground sign on the Subject Property as an amendment to the Special Use Planned Unit Development of the Subject Property, and the approval of said modification to the sign regulations set forth in Article 9 of the Zoning Ordinance of the Village of Deerfield, are hereby granted subject to the following additional conditions, regulations and restrictions: (i) that the construction, maintenance and use of the pylon ground sign as hereby approved shall be in accordance with the supporting documents, materials and exhibits attached hereto and made a part hereof as Exhibit B; (ii) compliance with the requirements and recommendations of the Appearance Review Commission with respect to the proposed tenant identification panels to be displayed on the pylon ground sign; (iii) except as otherwise provided herein, the construction, development, maintenance and use of the Subject Property shall be in accordance with the final development plan heretofore approved as a Special Use Planned Unit Development of the Subject Property in the C -2 Outlying Commercial District, including the signage plan for the Subject Property as hereby amended; and (iv) continued compliance by the Applicant with all other applicable provisions of the Zoning Ordinance of the Village of Deerfield. SECTION 4: That this amendment to the approved signage plan for the Subject Property commonly known as the Lake Cook Plaza Shopping Center, hereby approved and authorized as an amendment to the Special Use Planned Unit Development of the Subject Property, shall be binding upon and inure to the benefit of the Petitioner and Petitioner's successors, grantees, transferees and assigns, and any violation of the conditions herein set forth by Petitioner or its successors, grantees, transferees or assigns shall authorize the revocation of the amended Special Use hereby authorized. SECTION 5: That the Village Clerk is hereby authorized and directed to record this Ordinance in the office of the Recorder of Deeds of Cook County, Illinois at Petitioner =s expense. SECTION 6: That this Ordinance, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction. SECTION 7: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law. PASSED this 3rd day of March , 2009.
