ORDINANCE NO. 0 -09 -04
AN ORDINANCE AUTHORIZING A FIRST AMENDMENT
TO THE BRICKYARDS PARK LEASE AGREEMENT
WHEREAS, the Village of Deerfield leases the property commonly known as Brickyards
Park to the Deerfield Park District pursuant to the terms of a certain lease agreement dated May 21,
1990, which will end on May 31, 2010; and,
WHEREAS, the Village and the Park District have cooperated in the .Patty Turner Senior
Center which the Park District has constructed and is currently operating at Brickyards Park; and,
WHEREAS, the Village and the Park District have agreed to the terms of a certain First
Amendment to the Brickyards Park Lease (the "First Amendment "), which is attached hereto and
made a part hereof; and,
WHEREAS, the First Amendment provides, among other things, for the extension of the
Brickyards Park Lease for an additional term of .fifty (50) years expiring on May 31, 2060, and for
continued cooperation in the operation of the Patty Turner Senior Center, among other things; and,
WHEREAS, the corporate authorities of the Village of Deerfield have determined that the
Brickyard Park property is not needed for other public purposes of the Village and that the public
interest will be served by entering into the First Amendment and leasing said premises to the
Deerfield Park District as provided therein;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in
the exercise of its home rule powers, as follows:
SECTION 1: That the corporate authorities of the Village of Deerfield do hereby authorize
and approve the First Amendment to the Brickyards Park Lease attached hereto and made a part
hereof as Exhibit A, by and between the Village of Deerfield as Lessor and the .Deerfield Park
District as Lessee.
SECTION 2: That the President and Village Clerk of the Village of Deerfield be and they
are hereby authorized and directed to respectively execute and attest said First Amendment for and
on behalf of the Village of Deerfield.
SECTION 3: That this Ordinance, and each of its terms, shall be the effective legislative act
of a home rule municipality without regard to whether such Ordinance should: (a) contain terms
contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a
manner or regarding a matter not delegated to municipalities by state law. It is the intent of the
corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance
should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in
that regard within its jurisdiction.
SECTION 4: That this Ordinance shall be in full force and effect from and after its passage,
approval and publication in pamphlet form as provided by law.
