VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0 -09 -07 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE VILLAGE OF DEERFIELD TO AUTHORIZE CONTINUING CARE RETIREMENT COMMUNITIES AS A SPECIAL USE IN THE I -1 OFFICE, RESEARCH AND RESTRICTED INDUSTRIAL DISTRICT WHEREAS, the JFMC Facilities Corporation (referred to herein as "Petitioner" or "JFMC "), the owner and contract purchaser of certain property commonly known as 1552, 1601 and 1627 Lake Cook Road, has petitioned the Plan Commission of the Village of Deerfield for an amendment to Article 6.01 -C of the Zoning Ordinance of the Village of Deerfield to permit Continuing Care Retirement Communities (CCRC's) in the I -1 Office, Research and Restricted Industrial District when authorized as a Special Use as part of a Planned Unit Development in the I -1 District, and for an amendment to 8.02 -E of the Zoning Ordinance providing for the number of off - street parking spaces required for CCRC's; and, WHEREAS, the Plan Commission of the Village of Deerfield held a public hearing on May 1, 2008 to consider said text amendment, said hearing being held pursuant to public notice and conforming in all respects, in both manner and form, with the requirements of the statutes of the State of Illinois and the Zoning Ordinance of the Village of Deerfield; and, WHEREAS, the Plan Commission of the Village of Deerfield, after considering the evidence and supporting materials presented at said public hearing, submitted its written report and recommendation to the Board of Trustees ofthe Village of Deerfield recommending that: (i) Article 6.01 -C, Special Uses, of the Zoning Ordinance of the Village of Deerfield be amended to allow Continuing Care Retirement Communities (CCRC's) as a Special Use in the I -1 Office, Research and Restricted Industrial District when authorized as a Special Use as part of a Planned Unit Development in said zoning district, and (ii) that Article 8.02 -E, Required Spaces, of the Zoning Ordinance be amended providing that the number of off - street parking spaces required for Continuing Care Retirement Communities shall be determined by the Board of Trustees, following a public hearing and recommendation by the Plan Commission, based on the number of CCRC employees, the number of resident vehicles anticipated, the number of visitor vehicles anticipated, the number of parking spaces needed to accommodate any ancillary uses conducted at the facility, and considering situations where overflow parking is available on adjacent parking via reciprocal parking agreements; and, VVMREAS, the President and Board of Trustees of the Village of Deerfield concur in the recommendation of the Plan Commission and have determined that it is in the best interests of the Village of Deerfield that the text of the Zoning Ordinance be amended as provided herein; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: That Article 6.01 -C, Special Uses, of the Zoning Ordinance of the Village of Deerfield be and the same is hereby amended to add the following as Paragraph 20 thereof- 20. Continuing Care Retirement Community that would consist of assisted living facilities as allowed in Article 6.01 -C, 15, a nursing care facility, and independent living facilities with the following ancillary uses: (1) Multi- purpose room for meetings; (2) Entertainment; (3) Services and parties for residents; (4) Resident convenience store; (5) Hair salon and spa; (6) Library; (7) Rehabilitation Therapy; (8) Resident classrooms; (9) Billiards room; (10) Wellness center including an aerobics studio, exercise equipment room, massage rooms, therapeutic pool and spa; (11) Art studio; (12) Small movie theater; (13) Meeting /conference rooms; (14) Meditation room; (15) Business center; (16) Dining facilities and kitchen for residents and their guests including a bistro /grill, casual dining, main dining, lounge, and private dining rooms; and (17) Similar uses. SECTION 2: That Article 8.01 -E, Required Spaces, of the Zoning Ordinance of the Village of Deerfield be and the same is hereby amended to add the following as Paragraph d thereof: d. Continuing Care Retirement Community The Board of Trustees shall determine, following a public hearing by the Plan Commission and receipt and review ofthe recommendation of that body, the number of parking spaces required for such a facility based on the number of employee resent at various times of the day, the numbers of resident vehicles anticipated, the number of visitors anticipated, and the number of spaces necessary to accommodate any ancillary uses conducted at the facility. Consideration may be given to situation where overflow parking is available on adjacent property by virtue of reciprocal parking agreements. SECTION 3: That this Ordinance, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a manner or regarding a matter not delegated to municipalities by state Jaw. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction.
