ORDINANCE NO. 0 -09 -29
AN ORDINANCE AUTHORIZING THE SALE AND DISPOSITION
OF CERTAIN SURPLUS PERSONAL PROPERTY OWNED
BY THE VILLAGE OF DEERFIELD
WHEREAS, the Deerfield Police Department owns certain items of personal property
listed and described on Exhibit A attached hereto (the "Surplus Property") that are no longer
necessary or useful for service in the Police Department; and,
WHEREAS, the Chief of Police of the Deerfield Police Department has recommended
that the Village sell and otherwise dispose of such Surplus Property as provided herein; and,
WHEREAS, the corporate authorities of the Village of Deerfield concur in the
recommendation of the Chief of Police and hereby determine that the items of personal property
described on Exhibit A attached hereto are surplus property and are no longer necessary for the
use of the Village and should be sold or otherwise disposed of as authorized in this Ordinance;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES,
ILLINOIS, in the exercise of its home rule powers, as follows:
SECTION 1: The President and Board of Trustees of the Village of Deerfield do hereby
find and determine that the items of personal property described on Exhibit A attached hereto
(the "Surplus Property ") are no longer necessary for, useful to or in the best interests of the
Village of Deerfield, and that the Village would be best served by the sale or other disposition of
said Surplus Property.
SECTION 2: That the Chief of Police of the Village of Deerfield is hereby authorized
and directed to cause the following to be sold and disposed of by sale as indicated, provided that
such items shall be sold "As Is" with the Village making no express or implied guarantees or
warranties of any kind whatsoever:
1. 2006 Ford Crown Victoria (VIN 2FAFP71W76X159261)
to Village of Cambridge, Wisconsin for $5,000.
SECTION 3: That the Chief of Police is hereby further authorized and directed to cause
the items of Surplus Property listed on Exhibit A for disposal by auction to be disposed of by
auction to the best bidder through Obenauf Auction Services, provided that such items shall be
sold "As Is" with the Village making no express or implied guarantees or warranties of any kind
whatsoever.
SECTION 4: That the Chief of Police, having determined that the following items of
Surplus Property have no value for sale, trade or donation, is hereby authorized and directed to
cause said following items of Surplus Property to be disposed of as scrap or refuse:
11 Tri -band Antennas
11 Siren / PA speakers
1 Kustom VHS Camera Vault
SECTION 5: That this Ordinance, and each of its terms, shall be the effective legislative
act of a home rule municipality without regard to whether such Ordinance should: (a) contain
terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b)
legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the
intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of
this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall
supersede state law in that regard within its jurisdiction.
SECTION 6: That this Ordinance shall be in full force and effect from and after its
passage, approval and publication in pamphlet form as provided by law.
