VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0 -08 -31 AN ORDINANCE ADOPTING NEW FLOOD INSURANCE RATE MAPS FOR LANDS WITHIN THE JURISDICTION OF DEERFIELD IN COOK COUNTY AND AMENDING SECTION 6 -38 OF THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD WHEREAS, the Village of Deerfield regulates the development of buildings, structures and other improvements in special flood hazard areas defined by Flood Insurance Rate Maps prepared by the Federal Emergency Management Agency ( "FEMA ") for lands within the jurisdiction of the Village of Deerfield as a requirement for participating in the federal flood insurance program; and, WHEREAS, FEMA has recently completed a revision to the Flood Insurance Study ( "FIS ") Flood Insurance Rate Map ( "FIRM ") for portions of Cook County, Illinois are located within the Village of Deerfield and within the subdivision jurisdiction of Deerfield in unincorporated Cook County, Illinois; and, WHEREAS, the new FIRM maps and Flood Insurance Study will be effective on August 19, 2008; and, WHEREAS, the corporate authorities of the Village of Deerfield have determined that public health, safety and welfare will be advanced by the adoption of the new Flood Insurance Rate Maps as provided herein and the continued participation by the Village of Deerfield in the National Flood Insurance Program; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: That the Flood Insurance Rate Maps, Panel Nos. 17031 C0088J,17031 C0089J, 17031 CO069J and 17031 C0069J, heretofore approved by FEMA, be and the same are hereby adopted as the current FIRM maps for those portions of the Village of Deerfield and unincorporated Cook County within the subdivision jurisdiction of the Village of Deerfield as depicted on said FIRM maps. Said FIRM maps and Flood Insurance Study are incorporated herein and made a part hereof by this reference. SECTION 2: That Section 6 -38 ( "Definitions ") of Article 6 ( "Flood Plain Requirements "), of Chapter 6 ( "Building ") of the Municipal Code of the Village of Deerfield be and the same is hereby amended by adding the following definition: (i) "Current Flood Insurance Rate Map ": The following Flood Insurance Rate Map ( "FIRM" panels: Community Deerfield (Cook County) Unincorporated Cook County (ii) Community Deerfield Unincorporated Cook County Effective Date of FIRM August 19, 2008 August 19, 2008 FIRM Panel Nos. 17031 C0088J 17031 C0089J 17031 C0069J 17031 C0069J Effective Date of Flood Insurance Study August 19, 2008 August 19, 2008 SECTION 3: That this Ordinance, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction. SECTION 4: That this Ordinance shall supersede all Ordinances or parts thereof adopted prior to this Ordinance, which are in conflict herewith, to the extent of such conflict. SECTION 5: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law. PASSED this 18th day of August , 2008.
