VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0 -08 -28 AN ORDINANCE AUTHORIZING A SPECIAL USE TO PERMIT A FREE- STANDING TELECOMMUNICATIONS SERVICE FACILITY (TCSF) AT THE DEERFIELD VILLAGE HALL (850 WAUKEGAN ROAD) WHEREAS, the Plan Commission of the Village of Deerfield held a public hearing on March 22, 2007 to consider the joint application of the Village of Deerfield and Verizon Wireless (hereinafter referred to as the "Applicants ") for approval of a special use pursuant to Articles 2.08 -H, 2.08 -I and 13.11 of the Zoning Ordinance of the Village of Deerfield authorizing and permitting the construction, establishment, maintenance and use of a stealth monopole structure and related facilities as a free - standing telecommunications service facility ( "TCSF ") on certain property commonly known as the Deerfield Village Hall at 850 Waukegan Road and legally described on Exhibit A attached hereto (the "Subject Property "), including a modification of the maximum height requirements of Article 2.08 -I to allow the monopole TCSF facility to have a maximum height of 120 feet; and, WHEREAS, said hearing was held pursuant to public notice duly given and published as required by law and conforming in all respects, in both manner and form, with the requirements of the Zoning Ordinance of the Village of Deerfield and the statutes of the State of Illinois; and, WHEREAS, the Plan Commission of the Village of Deerfield, after considering the testimony, documentary evidence and supporting materials offered at said public hearing, filed its report with the President and Board of Trustees containing its written findings of fact and recommendation that a 120 -foot monopole TCSF facility of stealth design accommodating the wireless communications antenna facilities of up to four wireless telecommunications carriers, together with the Village of Deerfield's emergency radio communications antennas, should be authorized as a Special Use TCSF antenna support structure in the P -1 Public Lands District pursuant to Article 13.11 and Articles 2.08 -H and 2.08 -I of the Zoning Ordinance of the Village of Deerfield, including a modification pursuant to Article 7.06 -B of the Zoning Ordinance of the Village of Deerfield permitting said free - standing TCSF structure to have a maximum height of 120 feet; and, WHEREAS, the President and Board of Trustees of the Village of Deerfield have considered and reviewed the proposed free - standing TCSF structure, the supporting materials submitted by the Applicants, the evidence adduced at said public hearing, and the findings of fact and recommendations of the Plan Commission of the Village of Deerfield; and, WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the best interests of the Village will be served by the authorization and granting of said Special Use, including a modification to permit a 20 foot increase in the height of the free- standing TCSF facility to 120 feet, subject to and in accordance with the plans and supporting materials submitted by the Applicants which are incorporated herein and made a part hereof by this reference; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: That the above and foregoing recitals, being material to this Ordinance, are incorporated and made a part hereof as if fully set forth herein. -4- SECTION 2: That the President and Board of Trustees do hereby affirmatively find that the proposed Special Use authorizing and permitting the construction, establishment, maintenance and use of a stealth monopole as a free - standing TCSF antenna support structure, as recommended by the Plan Commission, including a modification of the height requirements of Article 2.08 -I to permit said TCSF facility to have a maximum height of 120 feet, fully complies with the applicable special use requirements and standards for a free - standing TCSF antenna support structure in the P -1 Public Lands District as set forth in Articles 2.08 -H, 2.08 -1 and Article 13.11 of the Zoning Ordinance of the Village of Deerfield. SECTION 3: That the President and Board of Trustees do hereby authorize and approve a Special Use for the Subject Property in the P -1 Public Lands District to authorize and permit the construction, establishment, maintenance, operation and use of a 120 -foot free - standing monopole TCSF antenna support structure of stealth design accommodating the wireless telecommunications antenna facilities of up to four telecommunications carriers, together with the emergency communications radio antenna facilities of the Village of Deerfield. Said free - standing TCSF support structure shall include a 33 -ft. x 12 -ft. equipment room enclosure with a matching west facade gable at the north end of the police station building, all constructed with exterior building materials to match the Village Hall facade; an 8 -ft. tall brick wall constructed with exterior building materials to match the Village Hall facade to enclose the base of the monopole structure and equipment pads for future wireless carriers; and, the installation of necessary and associated equipment, cabling, fixtures and fasteners, all as more fully described on Exhibit B attached hereto and subject to the further conditions, regulations and restrictions set forth in Section 4 of this Ordinance. -5- SECTION 4: That the approval and authorization of said Special Use is granted subject to the following conditions, regulations and restrictions: (i) the construction, establishment, development, maintenance and use of said Special Use monopole free - standing TCSF structure on the Subject Property shall be in accordance with the plans and supporting materials attached and made a part of this Ordinance as Exhibit B hereof, and with all representations made and submitted by the Applicants to the Plan Commission and to the President and Board of Trustees of the Village of Deerfield; (ii) compliance with all FCC and FAA rules regarding construction requirements, technical standards, interference protection, power and height limitations and radio frequency (RF) standards; (iii) compliance with all applicable requirements of Article 2.08 ofthe Zoning Ordinance of the Village of Deerfield, as now or hereafter amended; and, (iv) compliance with the Zoning Ordinance and Municipal Code of the Village of Deerfield. SECTION 5: That the Special Use as hereby authorized shall be binding upon and inure to the benefit of the Applicants and to Applicants' successors, grantees, transferees and assigns, and any violation of this Ordinance, or the conditions, regulations and restrictions set forth herein by the Applicants or their authorized successors, grantees, transferees or assigns shall authorize the revocation of the Special Use as hereby authorized. SECTION 6: That the Village Clerk is hereby authorized and directed to publish this Ordinance in pamphlet form and to record this Ordinance in the office of the Recorder of Deeds of Lake County, Illinois at Applicants' expense. SECTION 7: That this Ordinance, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a 1511 t ) manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction. SECTION 8: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law. PASSED this 4th day of August , 2008. All modeling has been performed to predict the FCC Maximum Permissible Exposure (MPE) levels for occupational workers, as defined in Appendix B (Assumptions and Definitions), unless otherwise noted at the bottom of the modeling diagram. Color coding on the diagram is as follows: • Areas indicated as Gray are at 5% of the MPE limits or below. • Green represents areas predicted to be between 5% and 20% of the MPE. • Yellow represents areas predicted to be between 20% and 100% of the MPE. • Red areas indicated predicted levels greater than 100% of the Occupational MPE. Software modeling was performed for all transmitting antennas located on the site. Sitesafe has further assumed a 100 % duty cycle and maximum radiated power. The site has been modeled with these assumptions to show the maximum RF energy density. Sitesafe believes this to be a worst -case analysis, based on best available data. Areas modeled in Yellow most likely will not actually occur, but are shown as a worst -case prediction that could be realized real time. Sitesafe believes these areas to be safe for entry by occupationally trained personnel utilizing appropriate personal protective equipment (in most cases, a personal monitor). Thus, at any time if power density measurements were made, we believe the real -time measurements would indicate levels below those shown in this report. By modeling in this way, Sitesafe has conservatively shown exclusion areas — areas that should not be entered without the use of a personal monitor, carriers reducing power, or performing real -time measurements to indicate real -time exposure levels. Use of Generic Antennas For the purposes of this report, the use of "Generic" as an antenna model, or "Unknown" for an operator, means the information about a carrier, their FCC license and/or antenna information was not provided and could not be obtained while on site. In the event of unknown information, Sitesafe will use our industry specific knowledge of equipment, antenna models, and transmit power to model the site. If more specific information can be obtained for the unknown measurement criteria, Sitesafe recommends remodeling of the site utilizing the more complete and accurate data. Information about similar facilities is used when the service is identified and associated with a particular antenna. If no information is available regarding the transmitting service associated with an unidentified antenna, using the antenna manufacturer's published data regarding the antenna's physical characteristics makes more conservative assumptions. Where the frequency is unknown, Sitesafe uses the closest frequency in the antenna's range that corresponds to the highest Maximum Permissible Exposure (MPE), resulting in a conservative analysis. General Population/Uncontrolled Environment - defined by the FCC, as an area where RFR exposure may occur to persons who are unaware of the potential for exposure and who have no control of their exposure. Effective Radiated Power (ERP) — In a given direction, the relative gain of a transmitting antenna with respect to the maximum directivity of a half wave dipole multiplied by the net power accepted by the antenna from the connecting transmitter. Equivalent Isotropic Radiated Power (EIRP) —The product of the power supplied to the antenna and the antenna gain in a given direction relative to an isotropic antenna. Transmitter Power Output (TPO) — The radio frequency output power of a transmitter's final radio frequency stage as measured at the output terminal while connected to a load. Maximum Permissible Exposure (MPE) — The rms and peak electric and magnetic field strength, their squares, or the plane -wave equivalent power densities associated with these fields to which a person may be exposed without harmful effect and with acceptable safety factor. Currently, there are two different levels of MPE - General Public MPE and Occupational MPE. An individual classified as Occupational can be defined as an individual who has received appropriate RF training and meets the conditions outlined below. General Public is defined as anyone who does not meet the conditions of being Occupational. FCC and OSHA Rules and Regulations define compliance in terms of total exposure to total RF energy, regardless of location of or proximity to the sources of energy. It is the responsibility of all licensees to ensure these guidelines are maintained at all times. It is the ongoing responsibility of all tenants composing the site to maintain ongoing compliance with FCC rules and regulations. The exception to this is if an individual carrier contributes no more than 5 % MPE to any total area out of compliance. OSHA has adopted and enforces the FCC's exposure guidelines. A building owner or site manager can use this report as part of an overall RF Health and Safety Policy. It is important for building owners /site managers to identify areas in excess of the General Population MPE and ensure that only persons qualified as Occupational are granted access to those areas. Occupational Environment Explained The FCC definition of Occupational exposure limits apply to persons who: • are exposed to RF energy as a consequence of their employment; • have been made aware of the possibility of exposure; and • can exercise control over their exposure. OSHA guidelines go further to state that persons must complete RF Safety Awareness training and must be trained in the use of appropriate personal protective equipment. In order to consider this site an Occupational Environment, the site must be controlled to prevent access by any individuals classified as the General Public. Compliance is also maintained when any non - occupational individuals (the General Public) are prevented from accessing areas indicated as Red or Yellow in the attached RF Emissions diagram. In addition, a person must be aware of the RF environment into which they are entering. This can be accomplished by an RF Safety Awareness class, and by appropriate written documentation such as this Site Compliance Report. Appendix D — General Safety Recommendations The following are general recommendations appropriate for any site with accessible areas in excess of 100 % General Public MPE. These recommendations are not specific to this site. These are safety recommendations appropriate for typical site management, building management, and other tenant operations. 1. All individuals needing access to the main site (or the area indicated to be in excess of General Public MPE) should wear a personal RF Exposure monitor, successfully complete proper RF Safety Awareness training, and have and be trained in the use of appropriate personal protective equipment. 2. All individuals needing access to the main site should be instructed to read and obey all posted placards and signs. 3. The site should be routinely inspected and this or similar report updated with the addition of any antennas or upon any changes to the RF environment including: adding new antennas that may have been located on the site removing of any existing antennas changes in the radiating power or number of RF emitters. 4. Post the appropriate NOTICE, CAUTION, or WARNING sign at the main site access point(s) and other locations as required. Note: Please refer to RF Exposure Diagrams in Appendix B, to inform everyone who has access to this site that beyond posted signs there may be levels in excess of the limits prescribed by the FCC. VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0 -08 -28 AN ORDINANCE AUTHORIZING A SPECIAL USE TO PERMIT A FREE - STANDING TELECOMMUNICATIONS SERVICE FACILITY (TCSF) AT THE DEERFIELD VILLAGE HALL (850 WAUKEGAN ROAD) WHEREAS, the Plan Commission of the Village of Deerfield held a public hearing on March 22, 2007 to consider the joint application of the Village of Deerfield and Verizon Wireless (hereinafter referred to as the "Applicants ") for approval of a special use pursuant to Articles 2.08 -H, 2.08 -I and 13.11 of the Zoning Ordinance of the Village of Deerfield authorizing and permitting the construction, establishment, maintenance and use of stealth monopole structure and related facilities as a free - standing telecommunications service facility ( "TCSF ") on certain property commonly known as the Deerfield Village Hall at 850 Waukegan Road and legally described on Exhibit A attached hereto (the "Subject Property "), including a modification of the maximum height requirements of Article 2.08 -I to allow the monopole TCSF facility to have a maximum height of 120 feet; and, WHEREAS, said hearing was held pursuant to public notice duly given and published as required by law and conforming in all respects, in both manner and form, with the requirements of the Zoning Ordinance of the Village of Deerfield and the statutes of the State of Illinois; and, WHEREAS, the Plan Commission of the Village of Deerfield, after considering the testimony, documentary evidence and supporting materials offered at said public hearing, filed its report with the President and Board of Trustees containing its written findings of fact and recommendation that a 120 -foot monopole TCSF facility of stealth design accommodating the wireless communications antenna facilities of up to four wireless telecommunications carriers, together with the Village of Deerfield's emergency radio communications antennas, should be authorized as a Special Use TCSF antenna support structure in the P -1 Public Lands District pursuant to Article 13.11 and Articles 2.08 -H and 2.08 -I of the Zoning Ordinance of the Village of Deerfield, including a modification pursuant to Article 7.06 -13 of the Zoning Ordinance of the Village of Deerfield permitting said free - standing TCSF structure to have a maximum height of 120 feet; and, WHEREAS, the President and Board of Trustees of the Village of Deerfield have considered and reviewed the proposed free - standing TCSF structure, the supporting materials submitted by the Applicants, the evidence adduced at said public hearing, and the findings of fact and recommendations of the Plan Commission of the Village of Deerfield; and, WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the best interests of the Village will be served by the authorization and granting of said Special Use, including a modification to permit a 20 foot increase in the height of the free- standing TCSF facility to 120 feet, subject to and in accordance with the plans and supporting materials submitted by the Applicants which are incorporated herein and made a part hereof by this reference; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: That the above and foregoing recitals, being material to this Ordinance, are incorporated and made a part hereof as if fully set forth herein. -4- SECTION 2: That the President and Board of Trustees do hereby affirmatively find that the proposed Special Use authorizing and permitting the construction, establishment, maintenance and use of a stealth monopole as a free - standing TCSF antenna support structure, as recommended by the Plan Commission, including a modification of the height requirements of Article 2.08 -I to permit said TCSF facility to have a maximum height of 120 feet, fully complies with the applicable special use requirements and standards for a free - standing TCSF antenna support structure in the P -1 Public Lands District as set forth in Articles 2.08 -H, 2.08 -1 and Article 13.11 of the Zoning Ordinance of the Village of Deerfield. SECTION 3: That the President and Board of Trustees do hereby authorize and approve a Special Use for the Subject Property in the P -1 Public Lands District to authorize and permit the construction, establishment, maintenance, operation and use of a 120 -foot free - standing monopole TCSF antenna support structure of stealth design accommodating the wireless telecommunications antenna facilities of up to four telecommunications carriers, together with the emergency communications radio antenna facilities of the Village of Deerfield. Said free - standing TCSF support structure shall include a 33 -ft. x 12 -ft. equipment room enclosure with a matching west facade gable at the north end of the police station building, all constructed with exterior building materials to match the Village Hall facade; an 8 -ft. tall brick wall constructed with exterior building materials to match the Village Hall facade to enclose the base of the monopole structure and equipment pads for future wireless carriers; and, the installation of necessary and associated equipment, cabling, fixtures and fasteners, all as more fully described on Exhibit B attached hereto and subject to the further conditions, regulations and restrictions set forth in Section 4 of this Ordinance. -5- SECTION 4: That the approval and authorization of said Special Use is granted subject to the following conditions, regulations and restrictions: (i) the construction, establishment, development, maintenance and use of said Special Use monopole free - standing TCSF structure on the Subject Property shall be in accordance with the plans and supporting materials attached and made a part of this Ordinance as Exhibit B hereof, and with all representations made and submitted by the Applicants to the Plan Commission and to the President and Board of Trustees of the Village of Deerfield; (ii) compliance with all FCC and FAA rules regarding construction requirements, technical standards, interference protection, power and height limitations and radio frequency (RF) standards; (iii) compliance with all applicable requirements of Article 2.08 of the Zoning Ordinance of the Village of Deerfield, as now or hereafter amended; and, (iv) compliance with the Zoning Ordinance and Municipal Code of the Village of Deerfield. SECTION 5: That the Special Use as hereby authorized shall be binding upon and inure to the benefit of the Applicants and to Applicants' successors, grantees, transferees and assigns, and any violation of this Ordinance, or the conditions, regulations and restrictions set forth herein by the Applicants or their authorized successors, grantees, transferees or assigns shall authorize the revocation of the Special Use as hereby authorized. SECTION 6: That the Village Clerk is hereby authorized and directed to publish this Ordinance in pamphlet form and to record this Ordinance in the office of the Recorder of Deeds of Lake County, Illinois at Applicants' expense. SECTION 7: That this Ordinance, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction.
