SECTION 1: That the above and foregoing recitals; being material to this Ordinance, are hereby incorporated by this reference and made a part .of this Ordinance as if fully set forth herein. SECTION 2: That the President and Board of Trustees of the Village of Deerfield do hereby authorize and approve the Briarwood. Renovations as more fully described herein as an -2- amendment to the Special Use previously approved for the Subj ect Property in the P -1 Public Lands District pursuant to Article 7.02 -B, Paragraph 4 of the Zoning Ordinance of the Village of Deerfield, including a modification of the front yard requirements of Article 7.05 -C, Paragraph 1 to permit the construction'of a 13-;space parking lot within the required front yard of the Subject Property, subj ect to the conditions, regulations and restrictions set forth in Section 3 of this Ordinance. SECTION 3: That the approval and authorization of said amended Special Use authorizing and permitting the Briarwood Renovations is hereby granted subject to the following additional conditions, restrictions and regulations: (i) the 13 -space parking lot hereby approved shall be constructed of porous pavers in accordance with the documents attached hereto as Exhibit B; (ii) unlit informational/educational signage is permitted throughout the Briarwood Nature Area and Trail Tree Park provided same shall not be greater than 2 ft. by 3 ft. in size and shall be installed and maintained in accordance with the plans and exhibits incorporated as part of Exhibit B attached hereto; (iii) the development, construction, maintenance, operation and use of the Briarwood Renovations and the amended Special Use for the Subject Property shall be in accordance with the plans and supporting documents attached hereto as Exhibit B, and with the further conditions, restrictions and regulations set forth herein; (iv) compliance with all representations submitted and made by the Applicant to the Plan Commission and to the President and Board of Trustees of the Village of Deerfield;.and (v) compliance by the Applicant with the terms of this Ordinance and with all other applicable provisions of the Zoning Ordinance of the Village of Deerfield. SECTION 4: That the amended Special Use as hereby authorized shall be binding upon and inure to the benefit of the Applicant and to Applicant's successors, grantees, transferees and assigns, and any violation of the conditions herein set forth by the Applicant or its successors, grantees, -3- transferees or assigns shall authorize the revocation of the amended Special Use as hereby authorized. SECTION 5: That the Village Clerk is hereby authorized and directed to publish this Ordinance in pamphlet form and to record this Ordinance in the office of the Recorder of Deeds of Lake County, Illinois at Applicant's expense. SECTION 6:. That this Ordinance, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction. I W-v 1 - k --, w! & fyl sit, THOMPSON DYKE & ASSOCIATES, LTD Land Planning Landsmye Architecture Urban Planning Memorandum To: Linda Gryziecki (Deerfield PD) Rick Julison (Deerfield PD) From: Ben Kutscheid, ASLA Miranda Lovato Re: Permeable Pavement Comparison Date: 05.01.08 At the plan commission meeting on April 10, several alternate permeable pavement options were mentioned and questions asked about our next steps. Below is information on each, as well as reasons why the Park District has chosen to use Unilock's permeable paver. Grasscrete: A poured in place reinforced concrete system with cellular voids in which grass can grow. This product allows for maximum drainage, but does not promote healthy grass growth. The fill material inhibits grass growth. In addition the heat radiated from the concrete bands does not allow the grass to grow successfully, and the void spaces are too small to overcome this problem. For this reason grasscrete is not as aesthetically pleasing as other pavement options. In addition if sections need to be replaced this cannot be easily done. Hastings Checker Block: Consists of steel - reinforced, wale -like configurations which create voids for grass or crushed stone. This product is similar to grasscrete, but comes in precast 24 "x 24" blocks. The problems with this product are similar to the problems encountered with grasscrete. Although the individual blocks could be replaced. Not mentioned at the Plan Commission meeting but reviewed by the design team was porous Asphalt and porous Concrete surfaces. These two surface often clog and to keep clear is fairly high maintenance. Unilock Permeable Pavers: Eco- optiloc is a brick paver with W wide voids between pavers that are filled with drainage gravel. Each paver is dimensioned at 10 % width, 10 ' /a" length, and 3 1/8" height. The voids are smaller in this permeable system than the Grasscrete and the Hasting Checker block, but still allow for drainage of + 7" an hour (the 100 year stoma is about 4.5" hour). In addition the pavers are decorative and aesthetically pleasing, as well as being heavy duty allowing for heavy loads such as buses and utility vehicles. Pavers are veiy easy to change out if they become damaged or areas settle. VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0-08 -22 AN ORDINANCE AUTHORIZING AN AMENDED SPECIAL USE TO PERMIT RENOVATIONS TO BRIARWOOD PARK/NATURE AREA AND TRAIL TREE PARK IN THE P -1 PUBLIC LANDS DISTRICT WHEREAS, the Deerfield Park District (the "Applicant "), the owner of certain property commonly known as Briarwood Park, Briarwood Nature Area and Trail Tree Park that is legally described on Exhibit A attached hereto (the "Subject Property"), petitioned the Village of Deerfield for approval of an amended Special Use pursuant to Article 7.02 -13, Paragraph 4 of the Zoning Ordinance of the Village of Deerfield, including a modification of the front yard requirements of Article 7.05 -C, Paragraph 1, to permit certain park improvements and renovations to be made on the Subject Property consisting of, among other things, trail improvements, landscape improvements (including the eradication of the invasive and noxious plant species such as buckthorn), the addition of unlit informational /educational signage and the construction of a 13 -space parking lot within the required front yard of the Subject Property, said park improvements and renovations being more fully described herein (the " Briarwood Renovations "); and, WHEREAS, the Plan Commission of the Village of Deerfield held a public hearing on April 10, 2008, to consider said request for an amendment to the previously approved Special Use for Briarwood Park, Briarwood Nature Area and Trail Tree Park to permit the Briarwood Renovations, said hearing being held pursuant to public notice and conforming in all respects, in both manner and form, with the requirements of the statutes of the State of Illinois and the Zoning Ordinance of the Village of Deerfield; and, WHEREAS, the Plan Commission of the Village of Deerfield, after considering the testimony, documentary evidence and supporting materials offered at said public hearing, filed its report with the President and Board of Trustees containing its written findings of fact and recommendation to authorize the Briarwood Renovations as an amended Special Use of the Subject Property in the P -1 Public Land District pursuant to Article 7.02 -13, Paragraph 4 of the Zoning Ordinance of the Village of Deerfield, all in accordance with certain plans and supporting materials submitted by the Applicant; and, WHEREAS, the President and Board of Trustees of the Village of Deerfield have considered and reviewed the proposed Briarwood Renovations, the supporting materials submitted by the Applicant, the evidence adduced at said public hearing, and the findings of fact and recommendations of the Plan Commission of the Village of Deerfield; and, WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the best interests of the Village will be served by the authorization and granting of an amendment to the Special Use for Briarwood Park, Briarwood Nature Area and Trail Tree Park to authorize the Briarwood Renovations, as more fully described in the plans and supporting materials submitted by the Applicant and attached hereto, and to the extent authorized in this ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: That the above and foregoing recitals, being material to this Ordinance, are hereby incorporated by this reference and made a part of this Ordinance as if fully set forth herein. SECTION 2: That the President and Board of Trustees of the Village of Deerfield do hereby authorize and approve the Briarwood Renovations as more fully described herein as an IPA amendment to the Special Use previously approved for the Subject Property in the P -1 Public Lands District pursuant to Article 7.02 -B, Paragraph 4 of the Zoning Ordinance of the Village of Deerfield, including a modification of the front yard requirements of Article 7.05 -C, Paragraph 1 to permit the construction of a 13 -space parking lot within the required front yard of the Subject Property, subject to the conditions, regulations and restrictions set forth in Section 3 of this Ordinance. SECTION 3: That the approval and authorization of said amended Special Use authorizing and permitting the Briarwood Renovations is hereby granted subject to the following additional conditions, restrictions and regulations: (i) the 13 -space parking lot hereby approved shall be constructed of porous pavers in accordance with the documents attached hereto as Exhibit B; (ii) unlit informational /educational signage is permitted throughout the Briarwood Nature Area and Trail Tree Park provided same shall not be greater than 2 ft. by 3 ft. in size and shall be installed and maintained in accordance with the plans and exhibits incorporated as part of Exhibit B attached hereto; (iii) the development, construction, maintenance, operation and use of the Briarwood Renovations and the amended Special Use for the Subject Property shall be in accordance with the plans and supporting documents attached hereto as Exhibit B, and with the further conditions, restrictions and regulations set forth herein; (iv) compliance with all representations submitted and made by the Applicant to the Plan Commission and to the President and Board of Trustees of the Village of Deerfield; and (v) compliance by the Applicant with the terms of this Ordinance and with all other applicable provisions of the Zoning Ordinance of the Village of Deerfield. SECTION 4: That the amended Special Use as hereby authorized shall be binding upon and inure to the benefit of the Applicant and to Applicant's successors, grantees, transferees and assigns, and any violation of the conditions herein set forth by the Applicant or its successors, grantees, -3- transferees or assigns shall authorize the revocation of the amended Special Use as hereby authorized. SECTION 5: That the Village Clerk is hereby authorized and directed to publish this Ordinance in pamphlet form and to record this Ordinance in the office of the Recorder of Deeds of Lake County, Illinois at Applicant's expense. SECTION 6: That this Ordinance, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction.
