VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. o -u -o l AN ORDINANCE AUTHORIZING AN AMENDED SPECIAL USE TO ALLOW THE REPLACEMENT OF THE NORTH AVENUE LIFT STATION AT 845 NORTH AVENUE IN THE P -1 PUBLIC LANDS DISTRICT WHEREAS, the Plan Commission of the Village of Deerfield held a public hearing on September 27, 2007, and a continued public hearing on November 9, 2007, to consider the application of the Village of Deerfield, the owner of certain property commonly known as 845 North Avenue and legally described on Exhibit A attached hereto (the "Subject Property"), for approval of an amended special use to permit the construction of a replacement sanitary sewer lift station facility on the Subject Property in the P -1 Public Lands District, including modifications to the yard requirements in the P -1 District to reduce the required front yard setback to 22.52 feet and to reduce the required rear yard setback to 3.87 feet; and, WHEREAS, said public hearing was held pursuant to public notice and conformed in all respects, in both manner and form, with the requirements of the statutes of the State of Illinois and the Zoning Ordinance of the'Village of Deerfield; and, WHEREAS, the Plan Commission of the-Village of Deerfield, after considering the testimony, documentary evidence and supporting materials offered at said public hearing, filed its report with the President and Board of Trustees containing its written findings of fact and recommendation to authorize an amended Special Use pursuant to Article 7.02 -C, Paragraph 12 and Article 13.11 of.the Zoning Ordinance of the Village of Deerfield, including modifications to the front and rear yard setback requirements in the P -1 Public Lands District, to permit the replacement of the North Avenue lift station in accordance with certain plans and supporting materials submitted by the Applicant, and subject to certain additional conditions, regulations and restrictions including: (i) the prefabricated lift station building shall be clad with exterior brick (Could Ceramics — modular size, texture: velour, color: ironspot) with an asphalt shingled hip roof; (ii) the installation of a new 5 -foot wide sidewalk with a rubberized covering for access to the John Blumberg Tot Lot also located on the Subject Property; (iii) the addition of a 3 -foot wide concrete stoop at the back of the replacement lift station building; (iv) the addition of non - climbable fencing in back of the replacement lift station building to allow Village authorized personnel to gain access to the building; and, (v) the removal and replacement of an existing wood retaining wall at the south end of the Subject Property; (vii) the motion - detection light(s) shall be an instant on type that does not require warm -up time; (viii) a final landscape plan shall be presented to the Plan Commission for review and upon approval by the Plan Commission shall be implemented by Applicant; and, (ix) an evergreen landscape buffer shall be installed on the property south of the Subject Property (832 Northwoods Court) in accordance with an agreement between the Applicant and the owner of such property; and, WHEREAS, the President and Board of Trustees of the Village of Deerfield have considered and reviewed the replacement North Avenue lift station, the supporting materials submitted by the Applicant, the evidence and testimony offered at said public hearing, and the findings of fact and recommendations of the Plan. Commission of the` Village of Deerfield; and, WHEREAS, the President and Board of Trustees of the Village of Deerfield concur in the recommendation of the Plan Commission and have determined that the best interests of the Village will be served by the authorization and granting of an amended Special Use to authorize the -2- replacement of the North Avenue lift station in accordance with the plans and supporting materials submitted by the Applicant, and in accordance with certain special use conditions and restrictions provided herein; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: That the above and foregoing recitals, being material to this Ordinance, are hereby incorporated by this reference. and made a part of this Ordinance as if fully set forth herein. SECTION 2: That the President and Board of Trustees of the Village of Deerfield do hereby authorize and approve the replacement of the North Avenue lift station, including modifications to the yard requirements in the P -1 District to reduce the required front yard setback to 22.52 feet and to reduce the required rear yard setback to 3.87 feet, as an amendment to the Special Use previously approved.for the Subject Property in the P -1 Public Lands District pursuant to Article 7.02 -B, Paragraph 12, and Article 13.11 of the Zoning Ordinance of the Village of Deerfield, subject to the conditions, regulations and restrictions set forth in Section 3 of this Ordinance SECTION 3: That the approval and authorization of said amended Special Use is hereby granted subject to the following additional conditions, restrictions and regulations: (i) the development,. construction, maintenance, operation and use of the replacement North Avenue lift station shall be in accordance with the plans and supporting documents attached hereto as Exhibit B; and with the further conditions, restrictions and regulations set forth.herein; (ii) the prefabricated lift station building shall be clad with exterior brick (Could Ceramics — modular size, texture: velour, color: ironspot), with additional brick break lines, and with an asphalt shingled hip roof; (iii) a new -3 546ot wide sidewalk with a rubberized covering for access to the John Blumberg Tot Lot; (iv) the addition of a Moot wide concrete stoop at the back of the lift station building; (v) the addition of non - climbable fencing in back of the lift station building to limit access to Village personnel; (vi) the removal and replacement of an existing wood retaining wall at the south end of the Subject Property; (vii) the motion - detection lights shall be an instant on type that does not require warm -up time; (viii) a final landscape plan shall be presented to the Plan Commission for review and, upon approval, shall be implemented by Applicant; (ix) an evergreen landscape buffer shall be installed on the property south of the Subject Property (832 Northwoods Court) in accordance with an agreement between the Applicant and the owner of such property; (x) compliance with all representations submitted and made by the Applicant to the Plan Commission and to the President and Board of Trustees of the Village of Deerfield; and, (xi) compliance by the Applicant with the terms of this Ordinance and with all other applicable provisions of the Zoning Ordinance of the Village of Deerfield. SECTION 4: That the amended Special Use as hereby authorized shall be binding upon and inure to the benefit of the Applicant and to Applicant's successors, grantees, transferees and assigns; and any violation of the conditions herein set forth by the Applicant or its successors, grantees, transferees or assigns shall authorize the revocation of the amended Special Use as hereby authorized. SECTION 5: That the Village. Clerk 'is hereby authorized and directed. to publish this Ordinance in pamphlet form and to record this Ordinance in the office of the Recorder of Deeds of Lake County, Illinois at Applicant's expense. -4- SECTION 6: That this Ordinance, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction. SECTION 7: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law. PASSED this 7th day of January , 2008. VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0 -08 -01 AN ORDINANCE AUTHORIZING AN AMENDED SPECIAL USE TO ALLOW THE REPLACEMENT OF THE NORTH AVENUE LIFT STATION AT 845 NORTH AVENUE IN THE P -1 PUBLIC LANDS DISTRICT WHEREAS, the Plan Commission of the Village of Deerfield held a public hearing on September 27, 2007, and a continued public hearing on November 9, 2007, to consider the application of the Village of Deerfield, the owner of certain property commonly known as 845 North Avenue and legally described on Exhibit A attached hereto (the "Subject Property"), for approval of an amended special use to permit the construction of a replacement sanitary sewer lift station facility on the Subject Property in the P -1 Public Lands District, including modifications to the yard requirements in the P -1 District to reduce the required front yard setback to 22.52 feet and to reduce the required rear yard setback to 3.87 feet; and, WHEREAS, said public hearing was held pursuant to public notice and conformed in all respects, in both manner and form, with the requirements of the statutes of the State of Illinois and the Zoning Ordinance of the Village of Deerfield; and, WHEREAS, the Plan Commission of the Village of Deerfield, after considering the testimony, documentary evidence and supporting materials offered at said public hearing, filed its report with the President and Board of Trustees containing its written findings of fact and recommendation to authorize an amended Special Use pursuant to Article 7.02 -C, Paragraph 12 and Article 13.11 of the Zoning Ordinance of the Village of Deerfield, including modifications to the front and rear yard setback requirements in the P -1 Public Lands District, to permit the replacement of the North Avenue lift station in accordance with certain plans and supporting materials submitted by the Applicant, and subject to certain additional conditions, regulations and restrictions including: (i) the prefabricated lift station building shall be clad with exterior brick (Could Ceramics — modular size, texture: velour, color: ironspot) with an asphalt shingled hip roof; (ii) the installation of a new 5 -foot wide sidewalk with a rubberized covering for access to the John Blumberg Tot Lot also located on the Subject Property; (iii) the addition of a 3 -foot wide concrete stoop at the back of the replacement lift station building; (iv) the addition of non - climbable fencing in back of the replacement lift station building to allow Village authorized personnel to gain access to the building; and, (v) the removal and replacement of an existing wood retaining wall at the south end of the Subject Property; (vii) the motion - detection light(s) shall be an instant on type that does not require warm -up time; (viii) a final landscape plan shall be presented to the Plan Commission for review and upon approval by the Plan Commission shall be implemented by Applicant; and, (ix) an evergreen landscape buffer shall be installed on the property south of the Subject Property (832 Northwoods Court) in accordance with an agreement between the Applicant and the owner of such property; and, WHEREAS, the President and Board of Trustees of the Village of Deerfield have considered and reviewed the replacement North Avenue lift station, the supporting materials submitted by the Applicant, the evidence and testimony offered at said public hearing, and the findings of fact and recommendations of the Plan Commission of the Village of Deerfield; and, WHEREAS, the President and Board of Trustees of the Village of Deerfield concur in the recommendation of the Plan Commission and have determined that the best interests of the Village will be served by the authorization and granting of an amended Special Use to authorize the -2- replacement of the North Avenue lift station in accordance with the plans and supporting materials submitted by the Applicant, and in accordance with certain special use conditions and restrictions provided herein; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: That the above and foregoing recitals, being material to this Ordinance, are hereby incorporated by this reference and made a part of this Ordinance as if fully set forth herein. SECTION 2: That the President and Board of Trustees of the Village of Deerfield do hereby authorize and approve the replacement of the North Avenue lift station, including modifications to the yard requirements in the P -1 District to reduce the required front yard setback to 22.52 feet and to reduce the required rear yard setback to 3.87 feet, as an amendment to the Special Use previously approved for the Subject Property in the P -1 Public Lands District pursuant to Article 7.02 -13, Paragraph 12, and Article 13.11 of the Zoning Ordinance of the Village of Deerfield, subject to the conditions, regulations and restrictions set forth in Section 3 of this Ordinance. SECTION 3: That the approval and authorization of said amended Special Use is hereby granted subject to the following additional conditions, restrictions and regulations: (i) the development, construction, maintenance, operation and use of the replacement North Avenue lift station shall be in accordance with the plans and supporting documents attached hereto as Exhibit B, and with the further conditions, restrictions and regulations set forth herein; (ii) the prefabricated lift station building shall be clad with exterior brick (Could Ceramics — modular size, texture: velour, color: ironspot), with additional brick break lines, and with an asphalt shingled hip roof; (iii) a new -3- 5 -foot wide sidewalk with a rubberized covering for access to the John Blumberg Tot Lot; (iv) the addition of a 3 -foot wide concrete stoop at the back of the lift station building; (v) the addition of non - climbable fencing in back of the lift station building to limit access to Village personnel; (vi) the removal and replacement of an existing wood retaining wall at the south end of the Subject Property; (vii) the motion - detection lights shall be an instant on type that does not require warm -up time; (viii) a final landscape plan shall be presented to the Plan Commission for review and, upon approval, shall be implemented by Applicant; (ix) an evergreen landscape buffer shall be installed on the property south of the Subject Property (832 Northwoods Court) in accordance with an agreement between the Applicant and the owner of such property; (x) compliance with all representations submitted and made by the Applicant to the Plan Commission and to the President and Board of Trustees of the Village of Deerfield; and, (xi) compliance by the Applicant with the terms of this Ordinance and with all other applicable provisions of the Zoning Ordinance of the Village of Deerfield. SECTION 4: That the amended Special Use as hereby authorized shall be binding upon and inure to the benefit of the Applicant and to Applicant's successors, grantees, transferees and assigns, and any violation of the conditions herein set forth by the Applicant or its successors, grantees, transferees or assigns shall authorize the revocation of the amended Special Use as hereby authorized. SECTION 5: That the Village Clerk is hereby authorized and directed to publish this Ordinance in pamphlet form and to record this Ordinance in the office of the Recorder of Deeds of Lake County, Illinois at Applicant's expense. Ma SECTION 6: That this Ordinance, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction. SECTION 7: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law. PASSED this 7th day of January _'2008.
