VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0 -07 -36 AN ORDINANCE AUTHORIZING AN AMENDMENT TO A SPECIAL USE PLANNED UNIT DEVELOPMENT TO PERMIT CERTAIN EXTERIOR CHANGES AND OTHER RENOVATIONS AT 1405 LAKE COOK ROAD (TEXTURA) WHEREAS, Textura LLC (the "Applicant "), being the owner of certain property known as 1405 Lake Cook Road and legally described on Exhibit A attached hereto (the "Subject Property") also known as Phase I of the Teradyne PUD, has petitioned the Plan Commission of the Village of Deerfield pursuant to Article 6.01 -C, Paragraph 5, Article 12.09 and Article 13.11 of the Zoning Ordinance of the Village of Deerfield, for an amendment to the Special Use Planned Unit Development of the Subject Property in the I -1 Office, Research and Restricted'Industrial District, to permit a major change to the exterior of the existing building on the Subject Property, certain minor changes to the parking lot and certain minor site improvements, all as more fully described.herein; and, WHEREAS, the Plan Commission of the Village of Deerfield held a public hearing on September 27, 2007 to consider Applicant's request for approval of an amendment to the Special Use Planned Unit Development for the Subject Property to permit: (i) the removal of the facade on the existing building and its replacement with.a new glazed cur tain.wall system; (ii).the renovation of the entrance vestibule to the building; (iii) retrofitting and upgrading of the security gates at the . parking lot entrances; (iv) the removal and replacement of existing bollards; (v) relamping of all existing parking lot lighting fixtures; (vi) resurfacing, resealing and restriping of the existing parking lot; (vii) the installation of two (2) new ground identification. signs along the Lake Cook Road frontage and the Edens Spur frontage of the Subject Property, including a variation to permit a ground identification sign to be located within the 50 -foot rear setback along the Edens Spur frontage; (viii) the establishment. of a new paved fire lane; (ix) a variation to reduce the required number of parking spaces from 227 to 217 provided that Applicant shall land bank sufficient space for the future establishment of ten (10) additional parking spaces if required by the Village; and, (x) a waiver of the current installation of a 5 -foot pedestrian sidewalk along the south side of the frontage road, provided that Applicant shall install such pedestrian sidewalk upon future notice from the Village that the Village deems the installation of such sidewalk to be necessary; and, WHEREAS, said hearing was held pursuant to public notice and conformed in all respects, in both manner and form, with the requirements of the statutes of the State of Illinois and the Zoning Ordinance of the Village of Deerfield; and, WHEREAS, the Plan Commission of the Village of Deerfield, after considering the evidence, testimony and supporting materials offered at said public hearing, filed its report with the President and Board of Trustees containing its written findings of fact and recommendation that the Applicant's petition to permit said major change to.the Teradyne Planned Unit Development be approved as an amendment to the Special Use Planned Unit Development of the Subject Property in the I -1 Office, Research and Restricted Industrial District to authorize and permit the establishment, operation, maintenance and use of the Textura Office Building as more. fully described herein including: (i) the removal of the facade on. the existing building and its replacement with anew glazed curtain wall system; (ii) the renovation of the entrance vestibule .to the building;'.(iii) retrofitting and upgrading of the security gates at the parking lot entrances; (iv) the removal and replacement of existing bollards; (v) relamping of all existing parking lot lighting fixtures; (vi) -4- resurfacing, resealing and restriping of the existing parking lot; (vii) the installation of two (2) new ground identification signs along the Lake Cook Road frontage and the Edens Spur frontage of the Subject Property, including a variation to permit a ground identification sign to be located within the 50 -foot rear setback along the Edens Spur frontage; and, WHEREAS, the President and Board of Trustees of the Village of Deerfield concur in the recommendation of the Plan Commission and have determined that it is in the best interests of the Village of Deerfield to authorize and the Textura office facility as more fully described herein as an amendment to the Special Use Planned Unit Development of the Subject Property in the I -1 Office, Research and Restricted Industrial District; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES. OF THE VILLAGE OF DEERFIELD, LAKE AND COOK. COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: . SECTION. 1: That the President and. Board of Trustees do hereby affirmatively find that the Special Use as. hereby authorized fully complies with'the requirements and, standards set forth. in. Article 6.01 -C, Paragraph 5, Article 12.09 and Article 13.1.1 of the Zoning Ordinance of the Village of Deerfield and do hereby authorize and approve the establishment of the Textura office facility as -5- an amendment to the Special Use Planned Unit Development of the Subject Property in the I -1 Office, Research and Restricted Industrial District, subject to the conditions, regulations and restrictions set forth in Section 3 of this Ordinance. SECTION 3: That the approval and authorization of said amendment to the Special Use Planned Unit Development of the Subject Property is granted subject to the following conditions, regulations and restrictions: A. That the construction, development and use of the Subject Property shall be in accordance with the documents, materials and exhibits attached hereto and made a part hereof as Exhibit B. B. That the parking variation hereby authorized is subject to Applicant's agreement to. land bank and install ten (10) additional parking spaced upon notice from the Village that Applicant is required to fully comply with the parking requirements of the Zoning Ordinance of the Village of Deerfield. C. The waiver of a pedestrian sidewalk along the frontage road abutting the Subject Property is subject to Applicant's agreement to promptly install a 5 -foot pedestrian sidewalk adjacent to the frontage road on the north side of the Subject Property upon written notice and specifications from the Village of Deerfield to install said pedestrian sidewalk. D. All representations submitted and made by the Applicant to the Plan Commission and to the President and Board of Trustees of the Village of Deerfield. E. Applicant's initial and continued compliance with this Ordinance, with the final development plan for Phase I of the Teradyne Planned Unit Development as hereby amended, and with all applicable provisions of the Municipal Code and Zoning Ordinance of the Village of Deerfield. SECTION 4: That the amended Special Use as hereby authorized shall be binding upon and inure to the benefit of the Applicant and to Applicant's successors, grantees, transferees and assigns, and any violation of the conditions herein set forth by the Applicant or its successors, grantees, transferees or assigns shall authorize the revocation of the amended Special Use as .hereby authorized. SECTION 5: That the Village Clerk is hereby .authorized and directed to record this Ordinance in the Office of the Recorder of Deeds of Cook County, Illinois at Applicant's expense. -7- SECTION 6: That this Ordinance, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction. SECTION 7: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law. PASSED this 3rd day of December , 2007. VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0 -07 -36 AN ORDINANCE AUTHORIZING AN AMENDMENT TO A SPECIAL USE PLANNED UNIT DEVELOPMENT TO PERMIT CERTAIN EXTERIOR CHANGES AND OTHER RENOVATIONS AT 1405 LAKE COOK ROAD (TEXTURA) WHEREAS, Textura LLC (the "Applicant "), being the owner of certain property known as 1405 Lake Cook Road and legally described on Exhibit A attached hereto (the "Subject Property ") also known as Phase I of the Teradyne PUD, has petitioned the Plan Commission of the Village of Deerfield pursuant to Article 6.01 -C, Paragraph 5, Article 12.09 and Article 13.11 of the Zoning Ordinance of the Village of Deerfield, for an amendment to the Special Use Planned Unit Development of the Subject Property in the I -1 Office, Research and Restricted Industrial District, to permit a major change to the exterior of the existing building on the Subject Property, certain minor changes to the parking lot and certain minor site improvements, all as more fully described herein; and, WHEREAS, the Plan Commission of the Village of Deerfield held a public hearing on September 27, 2007 to consider Applicant's request for approval of an amendment to the Special Use Planned Unit Development for the Subject Property to permit: (i) the removal of the facade on the existing building and its replacement with a new glazed curtain wall system; (ii) the renovation of the entrance vestibule to the building; (iii) retrofitting and upgrading of the security gates at the parking lot entrances; (iv) the removal and replacement of existing bollards; (v) relamping of all existing parking lot lighting fixtures; (vi) resurfacing, resealing and restriping of the existing parking lot; (vii) the installation of two (2) new ground identification signs along the Lake Cook Road frontage and the Edens Spur frontage of the Subject Property, including a variation to permit a ground identification sign to be located within the 50 -foot rear setback along the Edens Spur frontage; (viii) the establishment of a new paved fire lane; (ix) a variation to reduce the required number of parking spaces from 227 to 217 provided that Applicant shall land bank sufficient space for the future establishment of ten (10) additional parking spaces if required by the Village; and, (x) a waiver of the current installation of a 5 -foot pedestrian sidewalk along the south side of the frontage road, provided that Applicant shall install such pedestrian sidewalk upon future notice from the Village that the Village deems the installation of such sidewalk to be necessary; and, WHEREAS, said hearing was held pursuant to public notice and conformed in all respects, in both manner and form, with the requirements of the statutes of the State of Illinois and the Zoning Ordinance of the Village of Deerfield; and, WHEREAS, the Plan Commission of the Village of Deerfield, after considering the evidence, testimony and supporting materials offered at said public hearing, filed its report with the President and Board of Trustees containing its written findings of fact and recommendation that the Applicant's petition to permit said major change to the Teradyne Planned Unit Development be approved as an amendment to the Special Use Planned Unit Development of the Subject Property in the I -1 Office, Research and Restricted Industrial District to authorize and permit the establishment, operation, maintenance and use of the Textura Office Building as more fully described herein including: (i) the removal of the facade on the existing building and its replacement with a new glazed curtain wall system; (ii) the renovation of the entrance vestibule to the building; (iii) retrofitting and upgrading of the security gates at the parking lot entrances; (iv) the removal and replacement of existing bollards; (v) relamping of all existing parking lot lighting fixtures; (vi) -4- resurfacing, resealing and restriping of the existing parking lot; (vii) the installation of two (2) new ground identification signs along the Lake Cook Road frontage and the Edens Spur frontage of the Subject Property, including a variation to permit a ground identification sign to be located within the 50 -foot rear setback along the Edens Spur frontage; (viii) the establishment of a new paved fire lane; (ix) a variation to reduce the required number of parking spaces from 227 to 217 provided that Applicant shall land bank sufficient space for the future establishment often (10) additional parking spaces if required by the Village; and, WHEREAS, the President and Board of Trustees of the Village of Deerfield concur in the recommendation of the Plan Commission and have determined that it is in the best interests of the Village of Deerfield to authorize and the Textura office facility as more fully described herein as an amendment to the Special Use Planned Unit Development of the Subject Property in the I- IOffice, Research and Restricted Industrial District; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: That the President and Board of Trustees do hereby affirmatively find that the Special Use as hereby authorized fully complies with the requirements and standards set forth in Article 6.01 -C, Paragraph 5, Article 12.09 and Article 13.11 of the Zoning Ordinance of the Village of Deerfield and do hereby authorize and approve the establishment of the Textura office facility as -5- an amendment to the Special Use Planned Unit Development of the Subject Property in the I -1 Office, Research and Restricted Industrial District, subject to the conditions, regulations and restrictions set forth in Section 3 of this Ordinance. M SECTION 3: That the approval and authorization of said amendment to the Special Use Planned Unit Development of the Subject Property is granted subject to the following conditions, regulations and restrictions: A. That the construction, development and use of the Subject Property shall be in accordance with the documents, materials and exhibits attached hereto and made a part hereof as Exhibit B. B. That the parking variation hereby authorized is subject to Applicant's agreement to land bank and install ten (10) additional parking spaced upon notice from the Village that Applicant is required to fully comply with the parking requirements of the Zoning Ordinance of the Village of Deerfield. C. The waiver of a pedestrian sidewalk along the frontage road abutting the Subject Property is subject to Applicant's agreement to promptly install a 5 -foot pedestrian sidewalk adjacent to the frontage road on the north side of the Subject Property upon written notice and specifications from the Village of Deerfield to install said pedestrian sidewalk. D. All representations submitted and made by the Applicant to the Plan Commission and to the President and Board of Trustees of the Village of Deerfield. E. Applicant's initial and continued compliance with this Ordinance, with the final development plan for Phase I of the Teradyne Planned Unit Development as hereby amended, and with all applicable provisions of the Municipal Code and Zoning Ordinance of the Village of Deerfield. SECTION 4: That the amended Special Use as hereby authorized shall be binding upon and inure to the benefit of the Applicant and to Applicant's successors, grantees, transferees and assigns, and any violation of the conditions herein set forth by the Applicant or its successors, grantees, transferees or assigns shall authorize the revocation of the amended Special Use as hereby authorized. SECTION 6: That this Ordinance, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction. SECTION 7: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law. PASSED this 3rd day of December 2007.
