VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0 -07 -22 AN ORDINANCE AUTHORIZING A SPECIAL USE TO PERMIT A SEASONAL OUTDOOR DINING AREA FOR STONEY RIVER LEGENDARY STEAKS AT 711 DEERFIELD ROAD WHEREAS, the Plan Commission of the Village of Deerfield held a public hearing on March 22, 2007, to consider the application of CRM Properties (hereinafter referred to as the "Applicant "), the owner of Deerfield Square Shopping Center and certain property commonly known as Stoney River Legendary Steaks restaurant at 711 Deerfield Road and legally described on Exhibit A attached hereto (the "Subject Property ") for: (i) approval of a Special Use authorizing and permitting the establishment, maintenance and use of a seasonal outdoor seating and dining area of approximately 525 square feet with capacity for eleven (11) tables seating approximately 36 persons as an accessory use to the Stoney River Legendary Steaks restaurant pursuant to Article 5.01 -C, Paragraph 2, Subparagraph b, of the Zoning Ordinance of the Village of Deerfield, including the installation of black window awnings over the windows on the north and south elevations of the restaurant and the use of black 8 foot diameter umbrellas; (ii) for approval of a sign modification to repaint the existing internally lit reverse channel letter "Stoney River Legendary Steaks" wall signs on the north, south and east walls of the restaurant building in a semi -gloss black paint; and (iii) for a zoning text amendment and sign modifications to allow signage on window awnings and umbrellas located in outdoor seating and dining areas; and, WHEREAS, said public hearing was held pursuant to public notice duly given and published as required by law and conforming in all respects, in both manner and form, with the requirements of the Zoning Ordinance of the Village of Deerfield; and, WHEREAS, the Plan Commission of the Village of Deerfield, after considering the testimony, documentary evidence and supporting materials offered at said public hearing, filed its report with the President and Board of Trustees containing its written findings of fact and recommendation that the requested Special Use for a seasonal outdoor seating and dining area of approximately 525 square feet with capacity for eleven (11) tables seating approximately 36 persons accessory to a restaurant, including the installation of black window awnings over the windows on the north and south elevations of the restaurant and the use of black 8 foot diameter umbrellas in said outdoor seating area, be authorized as a Special Use of the Subject Property in the C -1 Village Center District pursuant to Article 13.11 and Article 5.01 -G, Paragraph 2, Subparagraph b, of the Zoning Ordinance of the Village of Deerfield; and, WHEREAS, the Plan Commission further recommended that a sign amendment be allowed to repaint the existing internally lit reverse channel letter "Stoney River Legendary Steaks" wall signs on the north, south and east walls of the restaurant building in a semi -gloss black paint; and WHEREAS, the Plan Commission further recommended that Applicant's request for a zoning text amendment and sign modifications to allow signage on window awnings and umbrellas located in outdoor seating and dining areas be denied; and WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that the proposed Special Use for the Subject Property fully complies with the requirements and standards set forth in Article 5.01 -G, Paragraph 2, Subparagraph b and Article -2- 13.11 of the Zoning Ordinance of the Village of Deerfield, and that the best interests of the Village will be served by the authorization and granting of said Special Use to the extent provided herein, subject to and in accordance with the plans and supporting materials submitted by the Applicant which are incorporated herein and made a part hereof by this reference, and that Applicant's request for a sign amendment to repaint the existing internally lit reverse channel letter "Stoney River Legendary Steaks" wall signs on the north, south and east walls of the restaurant building in a semi -gloss black paint be allowed; and, WHEREAS, the President and Board of Trustees further concur in the recommendation of the Plan Commission that Applicant's request for a zoning text amendment and sign modifications to allow signage on window awnings and umbrellas located in outdoor seating and dining areas should be denied; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: That the President and Board of Trustees do hereby affirmatively find that the proposed Special Use authorizing and permitting the establishment, maintenance and use of a seasonal outdoor seating and dining area of approximately 525 square feet with capacity for eleven (11) tables seating approximately 36 persons accessory to the Stoney River Legendary Steaks restaurant, as recommended by the Plan Commission, fully complies with the applicable requirements and standards set forth in Article 5.01 -G, Paragraph 2, Subparagraph b, and Article 13.11 of the Zoning Ordinance of the Village of Deerfield. SECTION 2: That the President and Board of Trustees do hereby authorize and approve the establishment, maintenance, operation and use of a seasonal outdoor seating and dining area -3- of approximately 525 square feet with capacity for eleven (11) tables seating approximately 36 persons, including the installation of black window awnings over the windows on the north and south elevations of the restaurant and the use of black 8 foot diameter umbrellas in said outdoor seating area, as a Special Use accessory to the Stoney River Legendary Steaks restaurant previously approved as a Special Use of the Subject Property in Deerfield Square Shopping Center, being a Planned Unit Development in the C -1 Village Center District, provided further that said accessory Special Use is approved subject to the conditions, regulations and restrictions set forth in Section 4 of this Ordinance. SECTION 3: That the President and Board of Trustees do hereby further authorize and approve a sign amendment to repaint the existing internally lit reverse channel letter "Stoney River Legendary Steaks" wall signs on the north, south and east walls of the restaurant building in a semi -gloss black paint, provided further that said sign amendment is approved subject to the conditions, regulations and restrictions set forth in Section 4 of this Ordinance. SECTION 4: That the approval and authorization of said accessory Special Use and sign amendment is granted subject to the following conditions, regulations and restrictions: (i) the establishment, development, maintenance and use of the Subject Property for said accessory Special Use and sign modification shall be in accordance with the plans and supporting materials attached and made a part of this Ordinance as Exhibit B hereof; (ii) the eastern portion of the outdoor seating area shall be screened with six (6) removable planters (one of which shall be on wheels to accommodate handicap accessibility to the outdoor seating area) with a Verdigris finish that shall be 30 inches in height by 57 inches long and 18 inches wide which shall be planted with annual flowers and plantings; (iii) the outdoor seating area shall be separated from public areas and from non - customer access by installing raised railings between the planters; (iv) -4- 8 foot diameter black (Sunbrella fabric #4608) umbrellas may be used in the outdoor seating area, but no advertising, logos or other identification may be shown on such umbrellas; (v) compliance with the statements and representations made and submitted by Applicant to the Plan Commission and to the Board of Trustees of the Village of Deerfield and with the recommendations of the Appearance Review Commission; (vi) continued compliance with the requirements with the Special Use heretofore granted for the Subject Property and with Planned Unit Development and the final Development Plan for Deerfield Square Shopping Center, as amended; and (vii) continued compliance with the Zoning Ordinance and Municipal Code of the Village of Deerfield. SECTION 5: That the accessory Special Use as hereby authorized shall be binding upon and inure to the benefit of the Applicant and Applicant's successors, grantees, transferees and assigns, and any violation of this Ordinance or the conditions, regulations and restrictions set forth herein by the Applicant or its successors, grantees, transferees or assigns shall authorize the revocation of the Special Use as hereby authorized. SECTION 6: That the Village Clerk is hereby authorized and directed to publish this Ordinance in pamphlet form and to record this Ordinance in the office of the Recorder of Deeds of Lake County, Illinois at Applicant's expense. SECTION 7: That this Ordinance, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of -5- this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction. SECTION 8: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law. PASSED this 4th day of ,June , 2007.
