AVIS Deputy Village Clerk Submitted by: Village of Deerfield 850 Waukegan Road Deerfield, IL 60015 I VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0 -06 -56 AN ORDINANCE APPROVING A SPECIAL USE FOR A RELIGIOUS INSTITUTION AT 1141,1181 AND 1201 LAKE COOK ROAD AND AN AMENDMENT TO THE SPECIAL USE PLANNED UNIT DEVELOPMENT FOR DEERFIELD BUSINESS CENTER TO AUTHORIZE THE B'NAI JEHOSHUA BETH ELOHIM SYNAGOGUE AND CHILDCARE FACILITY WHEREAS, Congregation B'nai Jehoshua Beth Elohim (referred to herein as "Petitioner" or "BJBE "), the owner of certain property commonly known as 1141, 1181 and 1201 Lake Cook Road and legally described on Exhibit A attached hereto and made a part hereof (the "Subject Property "), has petitioned the Plan Commission of the Village of Deerfield under and pursuant to the provisions of Article 6.01 -C, Paragraph 19, Article 12.09 and Article 13.11 of the Zoning Ordinance of the Village of Deerfield for: (i) approval of Special Use authorizing and permitting the establishment, development, maintenance and use of the B'nai Jehoshua Beth Elohim religious institution. and accessory childcare facility (collectively, the `.`BJBE religious facility ") as a Special Use of the Subject Property in the Deerfield Business Center Planned Unit Development; and (ii) for approval of a final development plan for the BJBE religious facility as an amendment to the Deerfield Business Center Special Use Planned Unit Development, including approval of a parking variation to allow 155 on -site parking spaces for the BJBE religious facility in lieu of the required 194 on -site parking spaces and approval of a sign modification to allow a directional sign not more than 13.5 square feet in size,; and, WHEREAS, the Plan Commission of the Village of Deerfield held a public hearing on October 123 2006 to consider Petitioner's. request for approval of Special Use for the Subject t Property to permit the proposed BJBE religious facility and for approval of a final development plan for the BJBE religious facility as an amendment to the Deerfield Business Center Special Use Planned Unit Development of the Subject Property in the I -1 Office, Research and Restricted Industrial District, said hearing being held pursuant to public notice and conforming in all respects, in both manner and form, with the requirements of the statutes of the State of Illinois and the Zoning Ordinance of the Village of Deerfield; and, WHEREAS, the Plan Commission of the Village of Deerfield, after considering the proposed BJBE religious facility and final development plan for the Subject Property, and after further considering the evidence and supporting materials offered at said public hearing, submitted its written report to the Board of Trustees of the Village of Deerfield recommending: (i) approval of the BJBE religious facility as Special Use of the Subject Property in the Deerfield Business Center Planned Unit Development; and (ii) approval of a final development plan for the BJBE religious facility, as more fully described herein, as an amendment to the Deerfield Business Center Special Use Planned Unit Development in the I -1 Office, Research and Restricted Industrial District, including approval of a parking variation to allow 155. on -site parking spaces for the BJBE religious facility in lieu of the required 194 on -site parking spaces and approval of a sign modification to allow a directional sign not more than 13.5 square feet in size; and, WHEREAS, the .President and Board of Trustees of the Village .of Deerfield concur in the recommendation of the Plan Commission and have determined that it is in the best interests of the Village of Deerfield to approve a Special Use authorizing the BJBE religious facility, as more fully described herein, as a Special Use of the Subject Property in the I -1 Office, Research and Restricted Industrial District; and, j WHEREAS, the President and Board of Trustees of the Village of Deerfield further concur in the recommendation of the Plan Commission and have determined that it is in the best interests of the Village of Deerfield that the final development plan for the BJBE religious facility attached hereto and made a part hereof as Exhibit B should be approved as an amendment to the Deerfield Business Center Special Use Planned Unit Development in the I -1 Office, Research and Restricted Industrial District authorizing and permitting the construction, development, maintenance and use of the Subject Property as a religious institution and accessory childcare facility, including approval of a parking variation to allow 155 on -site parking spaces for the BJBE religious facility in lieu of the required 194 on -site parking spaces and approval of a sign modification to allow a directional sign not more than 13.5 square feet in size, all in accordance with the final development plan and with the evidence and supporting materials submitted by the Petitioner which are incorporated herein and made a part hereof by this reference; NOW; THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: That the President and Board of Trustees do hereby affirmatively find that the Special Use as hereby authorized fully complies with the requirements and standards set forth in Article 6.01 -C, Paragraph 19, Article 12.09 and Article 13.11 of the Zoning Ordinance of the Village of Deerfield and do hereby authorize 'and approve the establishment of the BJBE religious facility as a Special Use of the Subject Property in the I -1 Office, Research and Restricted Industrial District, subject to the conditions, regulations and restrictions set forth in Section 4 of this Ordinance. 3 SECTION 2: That the President and Board of Trustees do further find that the final development plan for the Subject Property attached hereto and made a part hereof as Exhibit B fully complies with the requirements and standards set forth in Article 6.01 -C, Paragraph 16, Article 12.09 and Article 13.11 of the Zoning Ordinance of the Village of Deerfield. SECTION 3: That the President and Board of Trustees do hereby authorize and approve the Final Development Plan attached hereto and made a part hereof as Exhibit B as an amendment to the Deerfield Business Center Special Use Planned Unit Development in the I -1 Office, Research and Restricted Industrial District authorizing and permitting the construction, development and use of the BJBE religious facility on the Subject Property, including approval of a parking variation to allow 155 on -site parking spaces for the BJBE religious facility in lieu of the required 194 on -site parking spaces and approval of a sign modification to allow a directional sign not more than 13.5 square feet in size, all subject to the conditions, regulations and restrictions set forth in Section 4 of this Ordinance SECTION 4: That the approval and authorization of said Final Development Plan is hereby granted subject to the following conditions, regulations and restrictions: A. That the construction, development and use of the Subject Property shall be in accordance with the documents, materials and exhibits comprising the Final Development Plan for the Subject Property attached .hereto and made a part hereof as Exhibit B. B. The 1181 Lake Cook Road building, as renovated and expanded to include a new double- height sanctuary with balconies, shall accommodate a maximum of 600 people (422 persons in the main seating area and 118 in the balcony). C. The 1141 Lake Cook Road building, as renovated for a. religious school with 19 classrooms, shall have a maximum enrollment capacity of 380 students with school hours limited to weekends and to weekdays after school hours. 4 D. The total square footage of building 1141, building 1181 and building 1201 shall not exceed 71,380 square feet (63,282 existing gross square feet plus 8,098 gross square feet of new construction). E. A cross - access agreement with the owners of the Deerfield Business Center to permit primary traffic access to BJBE off the Pine Street extension to enter the eastern driveway to the Deerfield Business Center and exit through the western driveway at the frontage road at the northwest corner of the Subject Property. F. A parking agreement with the owner of Deerfield Business Center to allow for use of Deerfield Business Center parking lots for 40 cars during non - business hours and on weekends from 8:00 o'clock a.m. to 1:00 o'clock p.m. G. An agreement with the Chicagoland Jewish High School ( "CJHS "), approved by the Director of Building and Zoning, for use of the existing CJHS access road and for use of the CJHS parking lot adjacent to the Subject Property during the Jewish High Holidays for BJBE overflow parking. H. All representations submitted and made by the Petitioner to the Plan Commission and to the President and Board of Trustees of the Village of Deerfield. I. Petitioner's initial and continued compliance with this ordinance, with the Final Development Plan for the Deerfield Business Center Planned Unit Development, as amended, and with all applicable provisions of the Development Code and Zoning Ordinance of the Village of Deerfield. SECTION 5: That the Final Development Plan for BJBE hereby approved and authorized as an amendment to Deerfield Business Center Special Use Planned Unit Development authorizing a religious institution, on the Subject Property shall be binding upon and inure to the benefit of Petitioner's successors, grantees; transferees and assigns, and any violations of the conditions hereinabove set forth by Petitioner or its successors, grantees, transferees or assigns shall authorize the revocation of the Special Use hereby authorized. 5 I I SECTION 6: That the Village Clerk is hereby authorized and directed to record this Ordinance in the Office of the Recorder of Deeds of Cook County, Illinois at Petitioner's expense. SECTION 7: That this Ordinance, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction. PROJECT CONTEXT AND SUMMARY STATEMENT GEWALT HAMILTON ASSOCIATES, INC. (GHA) has investigated the traffic planning requirements of the proposed B'nai Jehoshua Beth Elohim (BJBE) development. BJBE intends to remodel and expand three of the existing buildings in the Deerfield Business Center (1141, 1181, and 1201 Lake Cook Road). The Deerfield Business Center is made of up six existing buildings located on approximately 10.5 -acres at the southwest corner of the Pine Street intersection with Lake Cook Road in the Village of Deerfield, Illinois (see Exhibit 1). Per the September 11, 2006 site plan prepared by Finegold Alexander and Associates, Inc. (FAA), the project will connect three existing buildings and make other modifications to bring the total area under roof to 71,380 square feet. (See Appendix I) Our study findings are discussed below and various recommendations are offered for your consideration. Exhibits referenced in the text are centrally located in the Technical Addendum at the end of this report. Briefly summarizing, we believe that the adjacent roadways can accommodate the anticipated development traffic through the implementation of recommended Traffic Operations Plan. Reasons include... • Analyses consider traffic generated by both adjacent schools at maximum occupancy. • Peak period traffic generations are considerably less than existing office space. • Availability of public bus service to help minimize individual vehicle usage. • Planned roadway improvements will assist in addressing an existing deficiency. • Staggered school and activity peaks should minimize interaction between adjacent school uses and BJBE traffic. BACKGROUND INFORMATION Roadway Network Discussion Lake Cook Road is a major east -west route in the site vicinity under the jurisdiction of the Cook County Highway Department (CCHD). Lake Cook is classified as a Strategic Regional Arterial (SRA) route. Lake Cook generally provides two travel lanes in each direction with a center median. Separate eastbound and westbound left turn lanes have been "carved" into the median at its signalized intersection with Pine Street. Lake Cook Road has a posted speed limit of 45 -mph along the site frontage. Pile Street is a local north -south route under the jurisdiction of the Village of Deerfield. South of Lake Cook, Pine Street is actually on the site of he recently approved Chicagoland Jewish High School (CJHS) site. Through traffic (i.e. crossing Lake Cook Road) is not permitted on either of the north or south approaches. A raised island restricts the south leg traffic to right or left turns only, while only signage exists for the north leg. Approximately 100 feet south of Lake Cook Road, there is an internal intersection that serves the office development to the west, and the 1085 Lake Cook building to the east. This north -south frontage road intersection provides two northbound lanes approaching Lake Cook and a single lane in each direction on the other three legs of the intersection. Inbound traffic (i.e. entering from Lake Cook) does not stop, but the balance of the intersection is under Stop Sign control. Currently, a barrier, boulevard style median exists on the south approach that will be removed as part of the CJHS site development to the south. The BJBE building will maintain the existing connections to the CJHS access roadway through the existing access easements that exist. Exhibit 2 provides a photo inventory of current operations at the internal Frontage Road intersection. Appendix II provides an April 2005 aerial photograph of the site and surrounding development at the time. Note that both the CJHS and HAAC project borders are also highlighted. Planned / Proposed Roadway Improvements The CCHD has a series of programmed improvements that were slated for 2006 construction in the site vicinity, including: 1. Reconstruction of Lake Cook from Pfingsten Road to the bridge section east of Pine 2. Signalization of the Birchwood / Frontage intersection west of the site 3. Extending turn lanes at the Lake Cook / Wilmot intersection The most critical to the site of these improvements is the signalized intersection proposed at Birchwood / Huehl Road. A signal at that location has the potential to attract some of the westbound left turns from Pine that may be destined to offices between Pine at the next signal at Wilmot that are avoiding a left turn at that currently unsignalized location. It is our understanding from talking with the 17111age that land acquisition at the ii,estern end of the business park has put off the improvements at least until 2007. Existing Traffic GHA conducted weekday morning and evening peak period traffic counts in July 2006 at the Lake Cook Road / Pine Street intersection as well as at the frontage road intersection and the access drives to the Deerfield Business Center. The time periods were chosen so as to coincide with the highest combination of background and anticipated / planned development - generated traffic. Exhibit 3 illustrates the existing 2006 peak hour volumes, which occurred from 7:30 -8:30 am and from 4:30 -5:30 pm. No unusual delays occurred during the counts such as foul weather (e.g. heavy snowfall or rain), road construction, or emergency vehicle activity that would adversely affect the volumes or travel patterns. Baseline Traffic Exhibit 4 illustrates the Baseline Traffic Volumes in the site vicinity. The Baseline Traffic represents the anticipated traffic volumes for both the Hellenic American Academy of Chicagoland (HAAC) and the Chicagoland Jewish High School (CJHS) at full buildout for both projects. Using these projections as a basis for the analyses of the. BJBE project helps ensure that the maximum traffic impacts of the BJBE development are considered. Parldng Observations In addition to our existing traffic observations, GHA conducted parking lot counts in the Deerfield Business Center. There are currently ±480 spaces on the Deerfield Business Center site. 200 of those spaces fall within the BJBE project limit. PROJECT TRAFFIC CHARACTERISTICS Traffic Generations `I Part A of Exhibit S tabulates the anticipated traffic volumes for the proposed BJBE development based on information published by the Institute of Transportation Engineers (ITE) in the manual Trip Generation. ` While BJBE will have periods where more traffic is generated, (e.g. Monday nights (6 -9 pm) and Friday Evening services (generally beginning at 7:30 or 8:00 pm)), the traffic volumes on the adjacent sites and 1 within the business park are considerably lower at those off peak hours. In discussion with BJBE representatives, the Evening Peak Hour volume based on the published ITE information is overstated for their anticipated uses / schedule. For comparison, Part B. of Exhibit S compares the anticipated BJBE Peak Hour traffic with the Peak Hour Traffic that would be expected by a re -use of the office buildings that will make up the BJBE site. As can be seen; the proposed use of the former office buildings by BJBE is expected to generate 115 fewer Morning Peak Hour and 30 fewer Evening Peak Hour trips than one would expect from the office buildings at full occupancy. Trip Distribution Part B of Exhibit S summarizes the anticipated directional distribution of BJBE traffic. Based on the congregation population areas and arrival methods, we expect that slightly more traffic will be destined to and fiom the west along Lake Cook Road. Use of the Frontage Road for traffic arriving from the west will make up the balance of site traffic arrival patterns. Recall, north south movements are prohibited at Pine Street. i Property Access The BJBE site will continue to utilize the existing site driveways that serve the Deerfield Business Center. However, all BJBE site traffic will circulate one way _clockwise around the buildings. Therefore inbound traffic will use the eastern driveway to the Business Center and all site traffic will exit via the western Business Center driveway. It is our understanding that discussions between BJBE and CJHS are ongoing with respect to cross access and potential shared parking agreements. Two access points between BJBE and CJHS could be considered: 1. A right turn in only drive from the southern extension of Pine Street that would allow some BJBE traffic to enter near the northeast corner of the BJBE site without having to travel through the remaining office building parcel. 2. A one way eastbound connection near the south end of both sites that would allow interaction between the parking fields. EVALUATION Traffic Assignments B'nai Jehoshua Beth Elohhn 1201 Lake Cook Road Deerfield, IL Traffic generated by the proposed BJBE project was "assigned" to the adjacent roadways based on the project characteristics (see Exhibit S) and the site's access system and is illustrated in Exhibit 6. BJBE traffic was then combined with the Baseline Traffic volumes (see Exhibit 4) to yield the Future Traffic assignment, which is presented, in Exhibit 7. Intersection Capacity Analyses ' Capacity analyses were conducted at the key Lake -Cook / Pine Street intersection. The analysis parameters are listed in Exhibit 8, as published in the Transportation Research Board's (TRB) 2000 j Highway Capacity Manual (HCM). At signalized intersections, Level of Service (LOS) reports ' operations using the letter designations "A" (best) through "F" (worst) and measures the average control delay per vehicle in seconds. Usually, LOS C is referred to as providing "design" operations and LOS D Jis the lower threshold of "acceptable operations. LOS E and F are usually considered as being "unacceptable ". The current travel lanes and traffic signal timings were used as the "base" for testing. Various geometric improvements (e.g. adding travel lanes) and operational modifications (e.g. traffic signal timing changes) were considered, as necessary. Exhibit 9 summarizes the results. _J Currently, the north and south approaches experience some significant delays during the Peak Hours. However, overall intersection operations at the Lake Cook Road / Pine Street intersection operate at or better than the design LOS C during the peak hours tested. Without improvements, the additional traffic generated by the various developments south of Lake Cook Road would continue to result in unacceptable delays for the entering left turns (AM Peak) and exiting right turns (PM Peak), while the Joverall intersection would continue to operate acceptably (i.e. LOS D or better). The improvements will be designed to meet CCHD and Village standards. Key traffic plan elements and those entities responsible for the improvements include... • Extend the westbound left turn lane from its current length of 150 feet to 300 feet. [CCHD] • Modify existing traffic signal timing and phasing at the Lake Cook / Pine Street intersection. [CCHD] Widen the south leg of the frontage road intersection to provide two northbound lanes. [CJHS] • Coordinate with CJHS to consider a one way (right turn only) connection near the BJBE building entrance. [BJBE] • Consider a second, gated connection between the BJBE and CJHS sites to allow easier cross access J for shared parking arrangements and provide both sites with an alternate emergency access. [BJBE] SECTION 5. SITE PLAN ELEMENTS Site Circulation The majority of the parking and drive aisles on the BJBE portion of the Deerfield Business Center will remain. A dedicated drop off is planned near the main BJBE entrance. All circulation around the building (with the exception of the parking bay at near the front door) will be signed to allow only one — way (clockwise) circulation. If an agreement is reached with CJHS, *a right in only drive may be constructed near the main BJBE entrance that will reduce the number of visitors and congregation members that enter through the office building portion of the site. Parking J The current site provides approximately 200 parking spaces on the portion of the lot that will become the BJBE development. The current plan and proposed modifications will reduce the parking spaces on the BJBE site to 163. There are a number of different programs and classes proposed as part of the educational component of BJBE. Of those various programs, it is our understanding that the maximum number of students on site at any one time would generally be less than 100. As such, the maximum parking demand on site is expected to occur on Friday evenings and holidays when the Rill congregation attends services in the sanctuary. Based on site data tabulated on the site plan by FAA, the seating capacity is approximately 711 including the Chapel space. At the times when - parking demand for BJBE is expected to peak, we would.expect minimal parking on the Business Center portion of the lot and generally minimal use of the CJHS parking lots, suggesting that sufficient parking can be provided through a combination of "on- site" and off site or shared parking arrangements. (GHA) has reviewed the proposed signage locations and revised entrance road / parking lot design for the proposed Temple BJBE development located within the Deerfield Business Center. After reviewing the proposed site plan prepared by Fiuegold Alexander & Associates, Inc. (FAA) dated October 12, 2006 we offer lie following brief continents: Signage There are three main signs on the BJBE campus: Main monument sign, Directional Sign, and the Secondary monument sign. The main monument sign is located near Lake -Cook Road and has been relocated to a location approximately 30 feet south of the south curb line on Lake -Cook Road. This location is an improvement over the previous location as it is no longer within the Lake -Cook Road Right -of -Way and has been moved south out of the sight line for vehicles queued at the signalized intersection. The directional signage is located north of the proposed cross access location from the CJHS driveway. This sign has been relocated to provide a minimum clearance of 3 -feet west of the curb line. As the sidewalk has been relocated to the east side of t11e CJHS entrance drive the sign no longer has potential to block the view of students in the previous crosswalk. Furthermore, the entrance to BJBE is one way and the sign location does not interfere with the sight lines of inbound (CJHS or BJBE) or outbound (CJHS) traffic. The secondary monument sign is located behind the back of curb near the northeast comer of the 1141 Building. A minimum clearance should be provided to ensure the sign does not interfere with parking lot and / or landscaping maintenance, but the location is such that it does not obscure sight lines of oncoming traffic or the sidewalk along the east side of the BJBE buildings. Parking To accentuate the one -way circulation pattern around the BJBE campus, the parking spaces along t11e east circulation aisle have been modified from 90° parking spaces to 750 angle spaces. While not specifically included in the Village's zoning ordinance, the 75° angle spaces will conform to the minimum width (9' wide) and have an 18.5' depth (parallel to the drive aisle) sufficient to accommodate larger passenger vehicles and SUV's. A cross - access agreement with the owners of the Deerfield Business Center to permit primary traffic access to BJBE off the Pine Street extension to enter the eastern driveway to the Deerfield Business Center and exit through the western driveway at the frontage road at the northwest corner of the Subject Property. F. A parking agreement with the owner of Deerfield Business Center to allow for use of Deerfield Business Center parking lots for 40 cars during non - business hours and on weekends from 8:00 o'clock a.m. to 1:00 o'clock p.m. G. An agreement with the Chicagoland Jewish High School ( "CJHS "), approved by the Director of Building and Zoning, for use of the existing CJHS access road and for use of the CJHS parking lot adjacent to the Subject Property during the Jewish High Holidays for BJBE overflow parking. H. All representations submitted and made by the Petitioner to the Plan Commission and to the President and Board of Trustees of the Village of Deerfield. I. Petitioner's initial and continued compliance with this ordinance, with the Final Development Plan for the Deerfield Business Center Planned Unit Development, as amended, and with all applicable provisions of the Development Code and Zoning Ordinance of the Village of Deerfield.
