VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0 -06 -51 AN ORDINANCE APPROVING AN AMENDMENT TO THE SIGNAGE PLAN FOR CORPORATE 500 CENTRE TO ALLOW FOUR TENANT GROUND SIGNS WHEREAS, the owner of certain property commonly known as the Corporate 500 Centre and legally described on Exhibit A attached hereto (the "Subject Property") has petitioned the Plan Commission of the Village of Deerfield to approve an amendment to the previously approved Signage Plan for the Subject Property as an amendment to the Special Use Planned Unit Development heretofore approved for the Subject Property in the I -1 Office, Research and Restricted Industrial District to allow a total of four (4) new monument ground signs, one (1) of each to be located in front the office buildings at 500 Lake Cook Road, 510 Lake Cook Road, 520 Lake Cook Road and 540 Lake Cook Road as provided herein; and, WHEREAS, the Plan Commission of the Village of Deerfield held a public hearing on September 28, 2006 to consider Petitioner's request for an amendment to the approved Signage Plan for the Subject Property to allow a total of four (4) new monument ground signs, each of which will be 24.37 square feet in area (7' 6" in length by 3'3" in height), not including the concrete base, for Beam Global Spirits & Wine, Inc. at 510 Lake Cook Road, for Fortune Brands at 520 Lake Cook Road and for the tenant names and logos of future tenants of the 500 Lake Cook Road and 540 Lake Cook Road buildings; and, WHEREAS, said public hearing was held pursuant to public notice duly given and published as required by statute and conforming in all respects, in both manner and form, with the requirements of the statutes of the State of Illinois and the Zoning Ordinance of the Village of Deerfield; and, WHEREAS, the Plan Commission of the Village of Deerfield, after considering the proposed amendment to the approved signage plan for the Subject Property, and the evidence and supporting materials offered at said public hearing, has submitted its written report and recommendation to the President and Board of Trustees of the Village of Deerfield that said amendment to the approved Signage Plan should be approved as an amendment to the Special Use Planned Unit Development of the Subject Property in the I -1 Office, Research and Restricted Industrial District; and, WHEREAS, the President and Board of Trustees find that said amendment to the approved Signage Plan for the Subject Property should be approved as an amendment to the Special Use Planned Unit Development of the Subject Property in the I -1 Office, Research and Restricted Industrial District authorizing and permitting four (4) new monument ground signs not more than 24.37 square feet in area (7' 6" in length by 3' 3" in height), not including the concrete base, to identify: (1) up to four (4) tenant names and logos of future tenants of the 500 Lake Cook Road building; (2) to identify Beam Global Spirits & Wine, Inc. as tenant of the 510 Lake Cook Road building; (3) to identify Fortune Brands as tenant of the 520 Lake Cook Road building; and, (4) to identify up to four (4) future tenant names and logos of future tenants of the 540 Lake Cook Road, building, all in accordance with the plans and exhibits presented by the Petitioner and attached hereto as Exhibit B hereof; MA NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: That the President and Board of Trustees of the Village of Deerfield do hereby find that the requested amendment to the approved Signage Plan as described in Section 2 hereof fully complies with the requirements and standards set forth in Article 9.02 -C and Article 13.11 of the Zoning Ordinance of the Village of Deerfield and is hereby authorized and approved as an amendment to the Special Use Planned Unit Development of the Subject Property in the I -1 Office, Research and Restricted Industrial District. SECTION 2: That the following monument signs are hereby approved and authorized as an amendment to the previously approved Signage Plan for the Corporate 500 Centre Special Use Planned Unit Development of the Subject Property, subject to the conditions, regulations and restrictions set forth in Section 3 of this Ordinance: A. A new monument ground sign not more than 24.37 square feet in area (7' 6" in length by 3' 3" in height), not including the concrete base of the sign, containing the future tenant name and logo of up to four (4) tenants of the 500 Lake Cook Road building to be installed in accordance with the plans, drawings and exhibits listed on Exhibit B attached hereto. Prior to installation of any such ground sign, Petitioner shall submit the proposed sign faces to the Plan Commission and to the Board of Trustees for recommendation and approval, respectively. B. A new monument ground sign not more than 24.37 square feet in area (7' 6" in length by 3' 3" in height), not including the concrete base of the sign, containing the name and logo of Beam Global Spirits & Wine, Inc. as tenant of the 510 Lake Cook Road building to be installed in accordance with the plans, drawings and exhibits listed on Exhibit B attached hereto. C. A new monument ground sign not more than 24.37 square feet in area (7' 6" in length by 3' 3" in height), not including the concrete base of the sign, containing the name and logo of Fortune Brands as tenant of the 520 Lake Cook Road building to be installed in accordance with the plans, drawings and exhibits listed on Exhibit B attached hereto. 511 D. A new monument ground sign not more than 24.37 square feet in area (7' 6" in length by 3' 3" in height), not including the concrete base of the sign, containing the future tenant name and logo of up to four (4) tenants at 540 Lake Cook Road to be installed in accordance with the plans, drawings and exhibits listed on Exhibit B attached hereto. Prior to installation of any such ground sign, Petitioner shall submit the proposed sign faces to the Plan Commission and to the Board of Trustees for recommendation and approval, respectively. E. Such signs shall not be illuminated between 10:00 p.m. prevailing time and dawn of the next succeeding day. SECTION 3: That the approval and authorization of said amendment to the approved Signage Plan for the Subject Property is hereby granted subject to the following conditions: (i) that the construction, maintenance and use of the four (4) new monument ground signs hereby approved shall be in accordance with the supporting documents, materials and exhibits attached hereto and made a part hereof as Exhibit B; (ii) except as otherwise provided herein, the construction, development, maintenance and use of the Subject Property shall be in accordance with the final development plan heretofore approved as a Special Use Planned Unit Development of the Subject Property in the I -1 Office, Research and Restricted Industrial District, as amended; (iii) continued compliance by the Petitioner with all applicable provisions of the Zoning Ordinance of the Village of Deerfield. SECTION 4: That said amendment to the approved Signage Plan for the Subject Property, hereby approved and authorized as an amendment to the Special Use Planned Unit Development of the Subject Property in the I -1 Office, Research and Restricted Industrial District, shall be binding upon and inure to the benefit of Petitioner and Petitioner's successors, grantees, transferees and assigns and any violation of the conditions hereinabove set forth by Petitioner or its successors, grantees, transferees or assigns shall authorize the revocation of the amended Special Use hereby authorized. -4- Exhibit B Documents Comprising Amendment to the Approved Signage Plan for 500 Corporate Centre (500, 510, 520 and 540 Lake Cook Road) 1. SECTION 5: That the Village Clerk is hereby authorized and directed to record this Ordinance in the office of the Recorder of Deeds of Lake County, Illinois at Petitioner's expense. SECTION 6: That this Ordinance, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction. SECTION 7: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law. PASSED this 20th day of November , 2006.
