VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0 -06 -36 AN ORDINANCE APPROVING AN AMENDMENT TO A PLANNED UNIT DEVELOPMENT TO PERMIT NEW SIGNAGE AND EXTERIOR CHANGES TO THE PUBLIC STORAGE BUILDING AT 125 SOUTH PFINGSTEN ROAD WHEREAS, the Plan Commission of the Village of Deerfield held a public hearing on June 8, 2006 to consider the application of Public Storage (the "Applicant') for: (1) approval of an amendment to the signage plan for the Public Storage property at 125 South Pfingsten Road, legally described on Exhibit A attached hereto (the "Subject Property") and certain exterior changes to the building on the Subject Property as an amendment to the Special Use Planned Unit Development of the Subject Property in the I -2 Outlying Limited Industrial District; and (2) approval of a sign modification to allow a 77.45 square foot (3' 3" x 23' 10.5 ") wall sign on the south wall ofthe Public Storage building; and, WHEREAS, said public hearing was held pursuant to public notice duly given and published as required by law and conforming in all respects, in both manner and form, with the requirements of the Zoning Ordinance of the Village of Deerfield; and, WHEREAS, the Plan Commission, after considering the proposed amendments to the approved signage plan for the Subject Property, the proposed exterior changes to the building on the Subject Property, the proposed sign modification and the evidence and supporting materials offered at said public hearing, has submitted its written report and recommendation to the President and Board of Trustees of the Village of Deerfield that: (1) that the proposed amendment to the signage plan for the Subject Property and the proposed exterior changes to the building on the Subject Property should be approved as an amendment to the Special Use Planned Unit Development of the Subject Property in the I -2 Outlying Limited Industrial District; and, (2) that the proposed sign modification should be approved to allow a 77.45 square foot (3' 3" x 23' 10.5 ") wall sign to be placed on the south wall of the Public Storage building; and, WHEREAS, the President and Board of Trustees of the Village of Deerfield find that the proposed amendment to the approved signage plan and the proposed exterior changes to the Public Storage building on the Subject Property should be approved as an amendment to the Special Use Planned Unit Development of the Subject Property in the I -2 Outlying Limited Industrial District, and that a sign modification should be approved for the Subject Property authorizing a 77.45 square foot (3'3" x 23' 10.5 ") wall sign on the south wall of the Public Storage building consisting of the letter "Public Storage" and the Public Storage logo ( "PS ") to be placed on the south wall of the Public Storage building, all in accordance with the plans and exhibits presented by the Applicant and . attached hereto as Exhibit B hereof. NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: That the President and Board of Trustees of the Village of Deerfield do hereby find that the requested amendment to the approved signage plan and the proposed exterior changes to the Public Storage building on the Subject Property fully complies with the requirements and standards set forth in Article 9.02 -E, entitled I -2 Limited Industrial District Planned Unit Development, and Section 13. 11 of the Zoning Ordinance of the Village of Deerfield. -2- SECTION 2: That an amendment to the approved signage plan for the Subject Property and certain exterior changes proposed for the Public Storage building on the Subject Property are hereby authorized and approved as an amendment to the Special Use Planned Unit Development of the Subject Property in the I -2 Outlying Limited Industrial District authorizing and permitting: (i) a 47.29 square foot (2.5'x 18' 11.5 ") internally illuminated wall sign on the north wall of the Public Storage building consisting of the letters "Public Storage" and the Public Storage (PS) logo; (ii) a 77.45 square foot (3' 3" x 23' 10.5 ") internally illuminated wall sign on the west wall of the Public Storage building consisting of the letters "Public Storage" and the Public Storage (PS) logo; (iii) a 77.45 square foot (3' 3" x 23' 10.5 ") internally illuminated wall sign consisting of the letter "Public Storage" and the Public Storage (PS) logo on the south wall of the Public Storage building, all in accordance with the plans, drawings and exhibits listed on Exhibit B attached hereto. SECTION 3: That a modification from the regulations set forth in Article 9, Signs, of the Zoning Ordinance of the Village of Deerfield is hereby approved for the Subject Property to permit an increase in the area of the south wall sign to 77.45 square foot (3' 3" x 23' 10.5 "), all in accordance with the plans, drawings and exhibits listed on Exhibit B attached hereto. SECTION 4: That the approval and authorization of said amendment to the Special Use Planned Unit Development of the Subject Property and the approval of said modification to the sign regulations set forth in Article 9 of the Zoning Ordinance are hereby granted subject to the following conditions, .regulations and restrictions: (i) that the construction, maintenance and use of the signs hereby approved shall be in accordance with the supporting documents, materials and exhibits attached hereto and made a part hereof as Exhibit B; (ii) that the exterior modifications to the Public Storage building shall be in accordance with the supporting documents, materials and exhibits -3- attached hereto and made a part hereof as Exhibit B; (iii) except as otherwise provided herein, the construction, development, maintenance and use of the Subject Property shall be in accordance with the final development plan heretofore approved as a Special Use Planned Unit Development of the Subject Property in the I -2 Outlying Limited Industrial District, including the signage plan as hereby amended; (iv) continued compliance by the Applicant with all other applicable provisions of the Zoning Ordinance of the Village of Deerfield. SECTION 5: That the amendment to the approved signage plan for the Subject Property and the exterior modifications to the Public Storage building hereby approved and authorized as an amendment to the Special Use Planned Unit Development of the Subject Property shall be binding upon and inure to the benefit of Applicant and Applicant's successors, grantees, transferees and assigns, and any violation of the conditions hereinabove set forth by Applicant or its successors, grantees, transferees or assigns shall authorize revocation of the amended Special Use hereby authorized. SECTION 6: That the Village Clerk is hereby authorized and directed to record this Ordinance in the office of the Recorder of Deeds of Lake County, Illinois at Applicant's expense. SECTION 7:. That this Ordinance, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this- Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction. -4- SECTION 8: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law.
