AN ORDINANCE AUTHORIZING A SPECIAL USE
TO PERMIT THE ESTABLISHMENT OF A PRESCHOOL AT
ST. GREGORY'S EPISCOPAL CHURCH
WHEREAS, the Plan Commission of the Village of Deerfield has held a public hearing on
the application of St. Gregory's Episcopal Church (the "Applicant ") for approval of a special use
authorizing the establishment of a preschool on Applicant's property commonly known as 815
Wilmot Road and legally described on Exhibit A attached hereto (the "Subject Property") in the R -2
and R -3 Single - Family Residential Districts; and,
WHEREAS, said public hearing was held on June 8, 2006 pursuant to public notice duly
given and published as required by statute and conforming in all respects, in both manner and form,
with the provisions of the Zoning Ordinance of the Village of Deerfield; and,
WHEREAS, the Plan Commission of the Village of Deerfield, after considering the
proposed special use to authorize and permit the establishment and operation of a preschool on the
Subject Property, and the evidence, testimony and supporting materials offered at said public
hearing, filed its report with the President and Board of Trustees containing its written findings of
fact and recommendation that the requested Special Use be authorized pursuant to Article 13.11,
Article 4.02 -C, Paragraph 1, Subparagraph d, and Article 4.03 -C, Paragraph 1, Subparagraph d of
the Zoning Ordinance of the Village of Deerfield to allow Applicant to locate, establish and operate
an academic year preschool program in the existing southwest wing of the St. Gregory's Episcopal
Church building as a Special Use of the Subject Property; and,
WHEREAS, the President and Board of Trustees of the Village of Deerfield have
determined that substantial evidence supporting the Plan Commission recommendation was adduced
at said public hearing, that the proposed Special Use for the Subject Property fully complies with the
requirements and standards set forth in Article 13.11 and in Articles 4.02 -C, Paragraph 1,
Subparagraph d, and 4.03 -C, Paragraph 1, Subparagraph d, of the Zoning Ordinance of the Village
of Deerfield, and that the best interests of the Village will be served by the authorization and granting
of said Special Use as provided herein, subject to and in accordance with the plans and supporting
materials submitted by the Applicant which are incorporated herein and made a part hereof by this
reference;
NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF
TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS,
in the exercise of its home rule powers, as follows:
SECTION 1: That the President and Board of Trustees do hereby affirmatively find that the
Special Use as hereby authorized fully complies with the requirements and standards set forth in
Article 4.02 -C, Paragraph 1, Subparagraph d, Article 4.03 -C, Paragraph 1, Subparagraph d and
Article 13.11 of the Zoning Ordinance of the Village of Deerfield.
SECTION 2: That the President and Board ofTrustees do hereby authorize and approve the
establishment, operation and use of an academic year preschool in the southwest wing of the existing
St. Gregory's Episcopal Church building as a Special Use of the Subject Property in the R -2 and R -3
Single Family Residential Districts, subject to the conditions, regulations and restrictions set forth
in Section 3 of this Ordinance.

SECTION 3: That the approval and authorization of said Special Use is granted subject to
the following conditions, regulations and restrictions: (i) the establishment, development, operation,
maintenance and use of the Subject Property for said Special Use shall be in accordance with the
plans and supporting materials attached hereto and made a part of this Ordinance as Exhibit B
hereof, and with all representations .made and submitted by the Applicant to the Plan Commission
and to the President and Board of Trustees of the Village of Deerfield; (ii) not more than thirty-four
(34) children shall be enrolled and attending the preschool at any time, and not more than six (6)
persons shall be employed by and for the preschool at any time; (iii) the drop -off and pick -up area
at the southeast corner of the building shall be restricted during hours of preschool operation to
prohibit motor vehicle parking and to allow adequate space for all necessary turning movements; (iv)
the Deerfield Road driveway serving the Subject Property shall be physically closed to motor vehicle
during hours of preschool operation and all preschool student vehicle drop -off and pick -up shall be
required to utilize the Wilmot Road driveway serving the Subject Property; (v) compliance by the
Applicant with all other applicable provisions of the Zoning Ordinance and Municipal Code of the
Village of Deerfield.
SECTION 4: That the Special Use as hereby authorized shall be binding upon and inure to
the benefit of the Applicant and Applicant's successors, grantees, transferees and assigns, and any
violation of this Ordinance or the conditions, regulations and restrictions set forth herein by the
Applicant or its successors, grantees, transferees or assigns shall authorize the revocation of the
Special Use as hereby authorized.

SECTION 5: That the Village Clerk is hereby authorized and directed to publish this
Ordinance in pamphlet form and to record this Ordinance in the office of the Recorder of Deeds of
Lake County, Illinois at Applicant's expense.
SECTION 6: That this Ordinance, and each of its terms, shall be the effective legislative
act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms '
contrary to the provisions of current or subsequent non - preemptive state law; or; (b) legislate in a
manner or regarding a matter not delegated to municipalities by state law. It is the intent of the
corporate authorities of the Village of Deerfield that to the extent that the terms of this. Ordinance
should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law
in that regard within its jurisdiction.
SECTION 7: That this Ordinance shall be in full force and effect from and after its passage,
approval and publication in pamphlet form as provided by law.

On behalf of St. Gregory's Episcopal Church I am pleased to submit f r your review our
Application for Special Use in order to operate "St. Gregory's Episcopa I l Preschool."
St. Gregory's has a long history of hospitality in the Village. We make ur parking lot
available to the Park District, to Wilmot Elementary School, and to B' ai Tikvah. Since
1957 we have sponsored Boy Scout Troop 50, and most recently we h ve welcomed
members of the Townley Women's Club Bridge Group.
Over the past two years we have been looking into new ways to extend) our hospitality
and serve the Deerfield community, and several parishioners have mentioned the idea of
offering a Preschool. In exploring that possibility we have discovered that the preschools
in Deerfield and our surrounding communities have waiting lists, and that a need exists
for more quality preschools.
Our Parish would like to offer this Preschool because we believe that e ly childhood
education creates the roots for developing the whole child. To that end, our Preschool
would provide for the developmentally appropriate social, emotional, c:ignitive, spiritual,
and physical needs of young children. By teaching The Creative Curtimilum ® used by
Deerfield District 109, we would be able to offer our students a seamlc ss transition into
our Village's kindergartens.
We are working with Mary Evans - Livorsi, the Illinois Department of C ildren & Family
Services' Day Care Licensing Representative for Lake County. She has already visited
our facility and we will implement all of her recommendations. We hav a been issued
DCFS Provider ID number 45433, and we will meet or exceed all DCF , standards.
Donald Bland, a Fire Prevention Inspector from the Office of the State Fire Marshal has
visited St. Gregory's, and we are working locally with Fire Marshal Chlistopher Johnson
from the Deerfield- Bannockburn Fire Department to comply with all fie safety code
requirements.

For academic year 2006 -2007, we would offer two -day, three -day, and five -day programs
for three -year olds in the morning, and for four- and five -year olds in the afternoon. We
would also offer a two -day afternoon Kindergarten Enrichment program.
The morning programs would meet Monday through Friday from 9:00 until 11:30 a.m.,
and the afternoon programs from 12:30 until 3:00 p.m.
The maximum number of morning students would be 17, with 3 to 4 teachers in each
class; and the maximum number of afternoon students would be 17 on Mondays,
Wednesdays, and Fridays, and 34 on Tuesdays and Thursdays, with 3 to 4 teachers in
each class.
During our second academic year, 2007 -2008, we would offer two sets of three -year old
programs in the morning, and two sets of four- and five -year old programs in the
afternoon. The maximum number of students on any given day, morning or afternoon,
would be 34, with 3 to 4 teachers in each class.
Appendix A, "Full Enrollment Scenarios," shows three possible combinations for the
enrollment maximums described in the last two paragraphs.
Appendix B, "St. Gregory's Episcopal Preschool Schedule," details our morning and
afternoon program schedules.
In the future we may wish to allow parents to drop off their children as early as 7 a.m.
and /or to pick up their children as late as 6:00 p.m. Whatever activities or enrichment
programs we would offer in addition to our regular morning and afternoon programs
would not exceed 34 students and would provide the same minimum ratio of 1 teacher
to every 5 or 6 students.
During academic year 2006 -2007, our three preschool programs would primarily use
our first floor southwest Christian Education wing (Appendix C, "Classroom Site Plan").
This area is one large classroom divided into three sections. The morning and afternoon
programs would use section C1, and the afternoon Kindergarten Enrichment program
would use section C2. For academic year 2007 -2008, the two morning programs would
be divided between sections C 1 and C2, and the two afternoon programs would be
similarly divided. The Preschool staff would use the Christian Education Office (C3) for
administrative work. The Preschool Entrance (C4) has an outdoor porch where children
would be sheltered while waiting to be picked up.
We would like to affix our Preschool logo to the right of the Preschool entrance as
identification signage in accordance with the Village of Deerfield's Zoning Ordinance
9.01 -A,1 d (Appendix D, "Sign Proposal") .
We would create a special drop -off and pick -up zone between the Deerfield Road
driveway and the Preschool entrance by using only our Wilmot Road driveway for
entering and exiting our parking lot (Appendix E, "Traffic and Parking Study"— Civil
Tech Engineering, Inc., Technical Memorandum, Traffic Impact Analysis).

SPECIAL USE, CRITERIA
1. Compatible with Existing Development
The nature and intensity of the Preschool's activities would be appreciably less
than some of the other activities that currently take place in the Church building,
including our Church School on Sunday mornings (with almost 90 :children and
teachers) and our sponsored Boy Scout Troop 50 on Wednesday evenings (with about
40 boys and adults).
We would not need any new structures to operate our Preschool, so there would
be no impediment to the development and improvement of surrounding property.
2. Lot of Sufficient Size
The Preschool would require a small proportion of our lot (Appendix C, "Classroom
Site Plan, and Appendix E, "Traffic and Parking Study"— Civil Tech Engineering, Inc.,
Technical Memorandum, Traffic Impact Analysis, Exhibit C).
3. Traffic
During Preschool hours traffic would enter and exit only from Wilmot Road, and
this would minimize any adverse effects on surrounding properties. We would create a
special drop -off and pick -up zone between the closed Deerfield Road driveway and the
Preschool's entrance on our southeast porch (Appendix E, "Traffic and Parking Study" —
Civil Tech Engineering, Inc., Technical Memorandum, Traffic Impact Analysis).
4. Parking and Access
Our parking lot would be more than adequate for our Preschool, and we would
still be able to accommodate our Wilmot Elementary School and Park District guests,
as well as the congregants from B'nai Tikvah on their Holy Days (Appendix E, "Traffic
and Parking Study" — Civil' Tech Engineering, Inc., Technical Memorandum, Traffic
Impact Analysis).
5. Effect on Neighborhood
The proposed Preschool would significantly and materially enhance the health,
safety, and welfare of the public by offering a quality Preschool to the community; and
because its activities would be similar to those already offered by St. Gregory's and
Wilmot Elementary School, the Preschool would not adversely affect other property,
neighborhood improvements, or property values in the surrounding area.
6. Adequate Facilities
St. Gregory's facilities are more than adequate for all of our existing uses, and the
Preschool will operate at times and in areas of the church building which are currently
unused or little used.

7. Adequate buffering
Thanks to the Village's widening of our parkways and sidewalks last summer, we
have ample buffering along Deerfield Road and Wilmot Road to our south and west; and
the shrubbery and trees along our border with Mitchell Park to our east and north
provides adequate buffering while allowing mutually compatible use by the Park District
and St. Gregory's.
We believe that we have met the standards for a Special Use, and we hope you will

The purpose of this Technical Memorandum is to evaluate the traffic and circulation
impacts which a preschool, proposed by the parish of St. Gregory's Episcopal Church, will
have on the roadways adjacent to their property. Additionally, this report will also
evaluate the on -site traffic patterns associated with the preschool to insure that the pick-
up /drop -off movements are safe and will in no way impede traffic flows on the adjacent
public roadways.
site Description
The preschool is proposed to be located within the existing main building of St. Gregory's
Episcopal Church located on the northeast corner of Deerfield Road and Wilmot Road, in
Deerfield, Illinois (Exhibit A). There a currently a number of existing buildings on the five
acre property occupied by the parish. The primary structure located on the southern
portion of the property is the existing church building itself, which contains the sanctuary
(worship space), a gathering hall, church offices and a number of classrooms. Other
buildings on the property include two houses and a garage which are used by the Rector
and a Youth Pastor as their primary residences.
There are currently two, full- access driveways serving the portion of the site occupied by
the existing church building, one driveway to Deerfield Road and one to Wilmot Road.
These driveways provide access to a 120 space parking lot, located primarily along the
eastern edge of the property. There are also separate driveways to each of the houses on
the property.

Existing Roadway Conditions
The existing St. Gregory's property is located on the northeast corner of Deerfield Road
and Wilmot Road. Deerfield Road is a major east -west arterial roadway consisting of
two through lanes in each direction west of Wilmot Road. East of Wilmot Road Deerfield
Road tapers to one through lane in each direction. It should, however be noted that
there are two westbound approach lanes on Deerfield Road at the Wilmot Road
intersection. Wilmot Road is a north -south secondary arterial roadway with one through
lane in each direction. Separate left turn lanes are provided on all four approaches to the
intersection.
This intersection was recently improved as part of a Village of Deerfield project on
Deerfield Road between Wilmot Road and Chestnut Street. Construction of the
improvement utilized Federal, State and Village funds and, as such, a Phase I Project
Report was completed for the improvement. Some exhibits prepared as part of the
Project Report are contained in the Appendix and are referenced throughout this
memorandum.
Description of the Proposed Change in Use
St. Gregory's Parish desires to begin a faith -based preschool program to be housed
within their current facilities. The goal of the parish is to provide a morning and an
afternoon program, Monday through Friday, with a maximum of 34 students on -site at
any one time. The morning session would meet from 9:00 A.M. to 11:30 A.M., with the
afternoon session beginning at 12:30 P.M. and ending at 3:00 P.M. The one hour
separation between programs would insure that the pick -up of children from the A.M.
session would not overlap the drop -off of the P.M. students. Additionally, with these
hours there would be no additional traffic generated during the peaks periods of the
Deerfield Road /Wilmot Road intersection of 7:30 -8:30 A.M. and 4:45 -5:45 P.M. which
were identified in the Project Report for Deerfield Road.
The location within the building proposed for the preschool is an area of classrooms in
the southern section of the main building (closest to Deerfield Road). The building
entrance on the southeast interior corner of the building would be the location used to
pick -up and drop -off children. These locations are indicated in Exhibit B. As part of the
pick -up procedure it is anticipated that parents would stay in their cars and that the
preschool teachers and aids would unload the children and escort them into the building.
Similarly, after each session drivers would queue in a pick -up line with the children being
brought to a common loading point.

Site Circulation
The location proposed for the pick -up /drop -off point is located 40 feet from the driveway
to Deerfield Road. We believe that allowing traffic to utilize this driveway during the
pick -up and drop -off periods would add congestion and confusion to the area where
loading was taking place. it would be our recommendation that the Deerfield Road
driveway be closed during these periods and that all access to*and from the site be
provided via the Wilmot Road driveway. The blocking of the Deerfield Road driveway
could initially be accomplished with traffic control cones. Should the cones prove
insufficient to deter traffic from using this driveway, a more permanent measure such as
a swinging gate or a chain across the driveway could be employed. in any case,
prominent signage should also be displayed to alert motorists that the driveway is not
available for use.
Requiring all traffic to use Wilmot Road to access the site provides a number of
advantages. Traffic volumes are significantly lower on Wilmot Road than on Deerfield
Road, so the movements into the site can be made with less obstruction to the through
traffic and with fewer conflicts from opposing traffic. Additionally, the recent
improvements to the Deerfield Road /Wilmot Road intersection provided a painted
median area in front of the Wilmot Road driveway capable of storing three left turning
vehicles out of the through traffic lanes while they wait for adequate gaps in the
oncoming traffic. Lastly, directing all traffic to the Wilmot Road driveway creates a
natural queue storage area on -site for approximately 20 vehicles between Wilmot Road
and the designated pick -up location. Under most circumstances, this should be
sufficient to address the queuing requirements of the preschool.
in order to make this on -site traffic pattern work properly it will also be necessary to
restrict parking during preschool hours in the six spaces by the designated loading point
as well as in the first seventeen spaces on the east side of the parking lot opposite the
loading area. This will provide adequate space for parents to make a U -turn after
picking -up or dropping -off a student in order to proceed back to the Wilmot Road
driveway. The traffic patterns proposed for the site are indicated on Exhibit C.
Traffic Analysis
in order to evaluate the impacts which the preschool will have on the area's
transportation system, it is necessary to determine the volume of traffic which will be
generated by the new use and the directional distribution of these trips.
The directional distribution of the preschool trips will be highly dependant on the specific
students enrolled in the program, which will change on a term -by -term basis. Without

having any specific information on this matter, we do not believe that it is unreasonable
to assume that 25% of the trips will approach the site from each direction.
Based on the anticipated operation of the preschool, it is also reasonable to assume that
there will be one trip end inbound and one trip end outbound for each student during
both the pick -up and drop -off periods, for a total of 35 trips in and 35 trips out in any
period. When combining the directional distribution with the trip generation (and
rounding to the nearest 5 trips), the site generated traffic volumes shown on Exhibit D
result. However, as was stated earlier, none of the pick -up and drop -off periods actually
occur during the peak traffic periods of the adjacent streets. Regardless of this, for the
purpose of our analysis we have added the site generated traffic to the A.M. and P.M.
peak hour traffic volumes presented in the Deerfield Road Project Report to represent a
worst -case scenario for preschool traffic impacts. These traffic volumes are indicated on
Exhibit E.
Signalized Intersection Capacity Analyses were performed for the Total Traffic Volumes
(existing traffic plus site generated traffic with the preschool open) at the Deerfield
Road /Wilmot Road intersection. This condition is compared below to the existing traffic
operations presented in the Deerfield Road Project Report.

The information above indicates that the additional traffic generated by the preschool
will have a negligible impact on the Deerfield Road /Wilmot Road intersection and that
there are no improvements needed to the intersection in order to safely and efficiently
