VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0 -06 -23 AN ORDINANCE APPROVING A SPECIAL USE FOR A RETAIL STORE OVER 10,000 SQUARE FEET AND AN AMENDMENT TO THE PLANNED UNIT DEVELOPMENT FOR LAKE COOK PLAZA SHOPPING CENTER WHEREAS, The Tile Shop and the owner of the Lake Cook Plaza Shopping Center (collectively referred to herein as the "Applicants ") have petitioned the Plan Commission of the Village of Deerfield to approve a Special Use authorizing the establishment and operation of 21,900 square foot "The Tile Shop" retail store at 497 Lake Cook Road in the Lake Cook Plaza Shopping Center legally described on Exhibit A attached hereto (the "Subject Property ") including: (i) approval of a variation to allow two (2) parking spaces to project into the required five foot (5') setback; (ii) approval of sign modifications to permit the proposed east wall sign to be larger than the permitted square footage and to permit the east and north wall signs to project above the roof deck of the building; and, (iii) an amendment to the previously approved signage plan for the Lake Cook Plaza Shopping Center to allow the wall signs for The . Tile Shop store consisting of letters on a single line to be seventy -five inches (75 ") in height for the east and north wall signs and sixty -one inches (61 ") in height for the west wall sign, all as an amendment to the Lake Cook Plaza Commercial Planned Unit Development heretofore approved for the Subject Property in the C -2 Outlying Commercial District; and, WHEREAS, said public hearing was held on March 23, 2006 pursuant to public notice duly given and published as required by statute and conforming in all respects, in both manner and form, with the provisions of the Zoning Ordinance of the Village of Deerfield; and, WHEREAS, the Plan Commission of the Village of Deerfield, after considering the evidence, testimony and supporting materials offered at said public hearing, filed its report with the President and Board of Trustees containing its written findings of fact and recommendation that the requested Special Use be authorized pursuant. to Section 13.11 and Section 5.02 -C, Paragraph 1, Subparagraph k, of the Zoning Ordinance of the Village of Deerfield to allow: (i) the establishment and operation of 2.1,900 square foot "The Tile Shop" retail store at 497 Lake Cook Road in the Lake Cook Plaza Commercial Planned Unit Development in the C -2 Outlying Commercial District; (ii) approval of a variation to allow two (2) parking spaces to project into the required five (5) foot setback; (iii) approval of sign modifications to permit the proposed east wall sign to be 146.35 square feet in area, an increase over the maximum 99.56 square foot area allowed under the Zoning Ordinance, and to permit the east and north wall signs to project above the roof deck of the building; and, (iv) an amendment to the previously approved signage plan for the Lake Cook Plaza Shopping Center to allow the wall signs for The Tile Shop store consisting of letters on a single line to be seventy -five inches (75 ") in height for the east and north wall signs and sixty -one inches (61 ") in height for the west wall sign, all as an amendment to the Special Use Planned Unit Development of the Subject Property in the .0 -2 Outlying Commercial District; and, WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that substantial evidence supporting the Plan Commission recommendation was adduced at said public hearing, that the proposed Special Use for the Subject Property fully complies with the -2- requirements and standards set forth in Section 13.11 and Section 5.02 -C, Paragraph 1, Subparagraph k, of the Zoning Ordinance of the Village of Deerfield, and that the best interests of the Village will be served by the authorization and granting of said Special Use as an amendment to the Special Use Planned Unit Development of the Subject Property in the C -2 Outlying Commercial District, including a variation to allow two (2) parking spaces to project into the required five (5) foot setback, sign modifications to permit the proposed east wall sign to be larger than the permitted square footage and to permit the east and north wall signs to project above the roof deck of the building, and an amendment to the previously approved signage plan for the Lake Cook Plaza PUD authorizing and permitting the wall signs for The Tile Shop store consisting of letters on a single line to be seventy -five inches (75 ") in height for the east and north wall signs and sixty -one inches (61 ") in height for the west wall sign, all subject to and in accordance with the plans and supporting materials submitted by the Applicants which are incorporated herein and made a part hereof by this; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: That the President and Board of Trustees of the Village of Deerfield do hereby affirmatively find that the Special Use as hereby authorized fully complies with the requirements and standards set forth in Section 5.02 -C, Paragraph 1, Subparagraph k and Section 13.11 of the Zoning Ordinance of the Village of Deerfield. SECTION 2: That the President and Board of Trustees do hereby approve and authorize a Special Use in the Lake Cook Plaza Commercial Planned Unit Development in the C -2 Outlying Commercial District permitting the establishment, operation and use of an approximately 21,900 110 square foot The Tile Shop retail store on the Subject Property, subject to the.conditions, regulations. and restrictions set forth in Section 7 of this Ordinance. SECTION 3: That the President and Board of Trustees do hereby further authorize and approve a variation to allow two (2) parking spaces to project into the required five (5) foot setback for the Subject Property, subject to the conditions, regulations and restrictions set forth in Section 7 of this Ordinance. SECTION 4: That the President and Board of Trustees do hereby further authorize and approve sign modifications for The Tile Shop retail store to allow the east wall sign to be 146.35 square feet in area, an increase over the maximum 99.56 square, foot area allowed under the Zoning Ordinance, and a sign modification to allow the north and east wall signs to be located above the roof deck of the building, but below the top of the parapet wall, all subject to the conditions, regulations and restrictions set forth in Section 7 of this Ordinance. SECTION '5: That the President and Board of Trustees do hereby further authorize and approve an amendment to the approved Signage Plan for the Subject Property to permit the wall signs for The Tile Shop store to consist of letters thirty -three inches (33 ") in height on a single line, subject to the conditions, regulations and restrictions set forth in Section 7 of this Ordinance. SECTION 6: That the Special Use, variation and sign modifications are hereby approved and authorized as an amendment to the Special Use Commercial Planned Unit Development of the Subject Property in the C -2 Outlying Commercial District, subject to the conditions, regulations and restrictions set forth in Section 7 of this Ordinance. SECTION 7: That the approval and authorization of said Special Use, variation and sign modifications is granted subject to the following conditions, regulations and restrictions: (i) the -4- establishment, development, maintenance and use of the Subject Property for said Special Use shall be in accordance with the plans and supporting materials attached hereto and made a part of this Ordinance as Exhibit B hereof, and with all representations made and submitted by the Applicants to the Plan Commission and to the President and Board of Trustees of the Village of Deerfield; (ii) that the construction, maintenance and use of the east, west and north wall signs on the Subject Property shall be in accordance with the plans and supporting materials attached hereto and made a part hereof as Exhibit B and the approval of the Appearance Review Commission; (iii) continued compliance with the requirements of the. Final Development Plan and Ordinances for the Lake Cook Plaza Planned Unit Development, as amended, and with all applicable provisions of the Zoning Ordinance of the Village of Deerfield. SECTION 8: That the Special Use and amendment to the Commercial Planned Unit Development of the Subject Property in the C -2 Outlying Commercial District as hereby authorized shall be binding upon and inure to the benefit of the Applicants and Applicants' successors, grantees, transferees and assigns, and any violation of this Ordinance or the conditions, regulations and restrictions set forth herein by Applicants or their successors, grantees, transferees or assigns shall authorize the revocation of the Special Use as hereby authorized. SECTION 9: That the Village Clerk is hereby authorized and directed to publish this Ordinance in pamphlet form and to record this Ordinance in the office of the Recorder of Deeds of Cook County, Illinois at Applicants' expense. SECTION 10: That this Ordinance, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) containterms contrary to the provisions of current or subsequent non- preemptive state law; or, (b) legislate in a -5- manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction. SECTION 11: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law. PASSED this 15th day of May , 2006. VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0 -06 -23 AN ORDINANCE APPROVING A SPECIAL USE FOR A RETAIL STORE OVER 10,000 SQUARE FEET AND AN AMENDNVIENT TO THE PLANNED UNIT DEVELOPMENT FOR LAKE COOK PLAZA SHOPPING CENTER WHEREAS, The Tile Shop and. the owner of the Lake Cook Plaza Shopping Center (collectively referred to herein as the "Applicants ") have petitioned the Plan Commission of the Village of Deerfield to approve a Special Use authorizing the establishment and operation of 21,900 square foot "The Tile Shop" retail store at 497 Lake Cook Road in the Lake Cook Plaza Shopping Center legally described on Exhibit A attached hereto (the "Subject Property") including: (i) approval of a variation to allow two (2) parking spaces to project into the required five foot (5') setback; (ii) approval of sign modifications to permit the proposed east wall sign to be larger than the permitted-square footage and to permit the east and north wall signs to project above the roof deck of the' building; and, (iii) an amendment to the previously approved signage plan for the Lake Cook Plaza Shopping Center to allow the wall signs for The .Tile Shop` store consisting of lett ers on a single lure to be seventy -five inches (75 ") in height for the east and north wall signs and sixty -one inches (61 ") in height for the west wall sign, all as an amendment 'to the Lake. Cook Plaza Coinuiercial Planned. Unit Development heretofore approved for the Subject Property in the G2 Outlying Commercial District; and, WHEREAS, said public hearing was held on March 23, 2006 pursuant to public notice duly given and published as required by statute and conforming in all respects, in both manner and form, with the provisions of the Zoning Ordinance of the Village of Deerfield; and, WHEREAS; the Plan Commission of the Village of Deerfield, after considering the evidence, testimony and supporting materials offered at said public hearing, filed its report with the President and Board of Trustees containing its written findings of fact and recommendation that the requested Special Use be authorized pursuant to Section 13.11 and Section.5.02 -C, Paragraph 1, Subparagraph k, of the Zoning Ordinance of the Village of Deerfield to allow: (i) the establishment and operation of 21,900 square foot "The Tile Shop" retail store at 497 Lake Cook Road in the Lake Cook Plaza Commercial Planned Unit Development in the C -2 Outlying Commercial District; (ii) approval of a variation to allow two (2) parking spaces to project into the required five (5) foot setback; (iii) approval of sign modifications to permit the proposed east wall sign to be 146.35 square feet m.area, an increase over the maximum 99.56 square foot.area allowed under the Zoning Ordinance, and to permit.the east and north wall signs to project above the roof deck of the building; and, (iv) an amendment to the previously approved signage plan for the Lake Cook Plaza Shopping Center to allow the wall signs for The Tile Shop store consisting of letters on a single line to be seventy -five inches (75 ") in height for the east and. north wall .sign's and sixty -one inches (61 ") in height for the west wall sign, all as an amendment to the Special Use Planned Unit Development of the Subj ect Property in the. .0 -2 Ouutlying Commercial District; and, WHEREAS, the President and - Board of Trustees of the Village of Deerfield have determined that substantial evidence supporting the Plan Commission recommendation was adduced at said public hearing, that the proposed Special Use for the Subject Property fully complies with the -2- requirements and standards set forth in Section 13.11 and Section 5.02 -C, Paragraph 1, Subparagraph k, of the Zoning Ordinance of the Village of Deerfield, and that the best interests of the Village will be served by the authorization and granting of said Special Use as an amendment to the Special Use Planned Unit Development of the Subject Property in the C -2 Outlying Commercial District, including a variation to allow two (2) parking spaces to project into the required five (5) foot setback, sign modifications to permit the proposed east wall sign to be larger than the pennitted square footage and to permit the east and north wall signs to project above the roof deck of the'building, and an amendment to the previously approved signage plan for the Lake Cook Plaza PUD authorizing and permitting the wall signs for The Tile Shop store consisting of letters on a single line to be seventy -five inches (75 ") in height for the east and north wall signs and sixty -one inches (61 ") in height for the west wall sign, all subject to and in accordance with the plans and supporting materials submitted by the Applicants which are incorporated herein and made a part hereof by this; NOW, THEREFORE, BE IT ORDAINED. BY THE PRESIDENT AND BOARD 'OF TRUSTEES OF. THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: That the President and Board of Trustees of the Village of Deerfield do Hereby affirmatively find that the Special: Use as hereby authorized fully complies with the requirements and standards set forth in Section 5.02 -C, Paragraph 1, Subparagraph k and Section 13.11 of the. Zoning Ordinance of the Village of Deerfield. SECTION 2: That the President and Board of Trustees do hereby approve and authorize a Special Use in the Lake Cook Plaza Commercial Planned Unit Development in the C -2 Outlying Commercial District permitting the establishment, operation and use of an approximately 21,900 square foot The Tile Shop retail store on the Subject Property, subject to the.conditions, regulations. and restrictions set forth in Section 7 of this Ordinance. SECTION 3: That the President and Board of Trustees do hereby further authorize and approve a variation to allow two (2) parking spaces to project into the required five (5) foot setback for the Subject Property, subject to the conditions, regulations and restrictions set forth in Section 7 of this Ordinance. SECTION 4: That the President and Board of Trustees do hereby further authorize and approve sign modifications for The Tile Shop. retail store to allow the east wall sign to be 146.35 square feet in area, an increase over the maximum 99.56 square foot area allowed-under the Zoning Ordinance, and a sign modification to allow the north and east wall signs to be located above the roof deck of the building, but below the top of the parapet wall, all subject to the conditions, regulations and restrictions set forth in Section 7 of this Ordinance. SECTION 5: That the President and Board of Trustees do hereby further authorize and approve. an amendment to the approved Signage Plan for the Subject Property to permit the wall signs for The Tile Shop store to consist. of letters thirty -three inches (33 ") in height on a single lime, subject to the conditions, regulations and restrictions set.forth in Section 7 ofthis Ordinance. SECTION 5: That the Special Use, variation and sign modifications are hereby approved and authorized as an amendment to the Special Use Commercial Planned Unit Development of the Subject Property in the.0 -2 Outlying Commercial District,.subject to the conditions, regulations and restrictions set forth in Section 7 of this Ordinance. SECTION 7: That the approval and authorization of said Special Use, variation and sign modifications is granted subject to the following conditions, regulations and restrictions:.(i) the ME establishment, development, maintenance and use of the Subject Property for said Special Use shall be in accordance with the plans and supporting materials attached .hereto and made a part of this Ordinance as Exhibit B hereof, and with all representations made and submitted by the Applicants to the Plan Commission and to the President and Board of Trustees of the Village of Deerfield; (ii) that the construction, maintenance and use of the east, west and north wall signs on the Subject Property shall be in accordance with the plans and supporting materials attached hereto and made a part hereof as Exhibit B and the approval of the Appearance Review Commission; (iii) continued compliance with the requirements of the.. Final Development Plan and Ordinances for the Lake Cook Plaza Planned Unit Development, as amended, and with all applicable provisions of the Zoning Ordinance of the Village of Deerfield. SECTION 8: That the Special Use and amendment to the Commercial Planned Unit Development of the Subject Property in the C -2 Outlying Commercial District as hereby authorized shall be binding upon and inure to the benefit of the Applicants and Applicants' successors, grantees, transferees and assigns, and any violation of this Ordinance or the conditions, regulations and restrictions set forth herein by Applicants or their successors, grantees, transferees or assigns shall authorize the revocation -of the Special Use as Hereby authorized. SECTION 9: That the Village Clerk is hereby authorized and directed to publish this Ordinance in pamphlet form and to record this Ordinance in the office of the Recorder of Deeds of Cook County, Illinois at Applicants' expense: SECTION 10: That this .Ordinance, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a -5- manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction.
