Published in pamphlet form by authority of the President and Board of Trustees of the Village of Deerfield, Lake and Cook Counties, Illinois, this 4th day of April , 2006: VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0 -06 -14 AN ORDINANCE ADOPTING THE LAKE COUNTY WATERSHED DEVELOPMENT ORDINANCE WHEREAS, the County of Lake, pursuant to the powers granted to it by 55 ILCS 5/5 -1062, has adopted certain amendments to the Lake County Watershed Development Ordinance ( "WDO ") on November 8, 2005 and January 10, 2006, establishing rules and regulations for floodplain and stormwater management throughout the County of Lake and superseding any less restrictive municipal rules and regulations therein; and, WHEREAS, the President and Board of Trustees of the Village of Deerfield have previously adopted Ordinance No. 0 -92 -38 and Ordinance No. 0- 00 -35, adopting the Lake County Watershed Development Ordinance, as amended, as the Village of Deerfield Stormwater Management Code; and, WHEREAS, the President and Board of Trustees of the Village of Deerfield have determined that it is in the best interests of the Village of Deerfield to require all development to meet the minimum standards prescribed by the Watershed Development Ordinance to the fullest extent practicable; and, WHEREAS, three (3) copies of the Lake County Watershed Development Ordinance have been on file in the office of the Village Clerk at the Village of Deerfield and available for public inspection for not less than thirty (30) days prior to the adoption of this Ordinance; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: That the above and foregoing recitals, being material to this Ordinance, are incorporated and made a part of this Ordinance as if fully set forth herein. SECTION 2: That the Lake County Watershed Development Ordinance, as amended by the County of Lake_ on November 8, 2005 and January 10, 2006, be and the same is hereby adopted by reference as the Village of Deerfield Stormwater Management Code as if fully set forth herein. SECTION 3: That in the event that the rules, regulations, terms or conditions imposed pursuant to the Lake County Watershed Development Ordinance, as hereby adopted, are either more restrictive or less restrictive than comparable rules, regulations, terms or conditions imposed by any other applicable rule, regulation, resolution, ordinance, statute or law, then the more restrictive rules, regulations, terms or conditions shall govern. SECTION 4: That Chapter 20 entitled "Subdivisions and Stormwater" of the Municipal Code of the Village of Deerfield is hereby further amended by adding at the end thereof the following: That the Lake County Watershed Development Ordinance, as amended by the County of Lake on November 8, 2005 and January 10, 2006, of which not less than three (3) copies have been and are now on file in the office of the Village Clerk, is adopted and incorporated herein by this reference as if fully set forth herein and shall be known as the "Amended and Restated Village of Deerfield Stormwater Management Code," and from the effective date of this Ordinance the provisions hereof shall be controlling within the corporate limits of the Village of Deerfield. SECTION 5: That all ordinances and resolutions, or parts thereof, in conflict with the provisions of this Ordinance are, to the extent of such conflict, expressly repealed. SECTION 6: That this Ordinance, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction. SECTION 7: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law. PASSED this 4th day of April , 2006.
