O-06-13VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0 -06 -13 AN ORDINANCE AMENDING ARTICLE 17 (VEHICLE LICENSES) OF CHAPTER 22 (VEHICLES AND TRAFFIC).OF THE MUNICIPAL CODE OF THE VILLAGE OF DEERFIELD BE IT ORDAINED BY THE PRESIDENT AND BOARD_ OF TRUSTEES OF THE VILLAGE OF. DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: That Section 22 -138 (Definition) of Article 17 (Vehicle Licenses of Chapter 22 (Vehicles and Traffic) of the Municipal Code of the Village of Deerfield of 1975, as amended, be and the same is hereby further amended to read as follows. Sec. 22 -138. Definition. The following words and phrases when used in this Article shall, for the purpose of this Article, have the meanings ascribed to them in Chapter 1 of the Illinois Vehicle Code (625 ILCS 511 -100, et seq.) as it may be amended from time to time: (a) Antique Vehicle. (b) Bicycle. (c) Bus. (d) Charitable Vehicle. (e) Commercial Vehicle. (f) Motor Driven Cycle. (g) Motor Vehicle. (h) Motorcycle. (i) Motorized Pedalcycle. 0) Noncommercial Vehicle. (k) Owner. (1) Passenger Car. (m)Recreational Vehicle. (n) School Bus. (o) Truck. SECTION 2: That Section 22 -140 (Fees) of Article 17 (Vehicle Licenses) of Chapter 22 (Vehicles and Traffic) of the Municipal Code of the Village of Deerfield of 1975, as amended, be and the. same is hereby further amended to read as follows. Sec. 22 -140. Fees. (a) The annual fee to be paid for. motor vehicle licenses shall be as follows: Passenger Cars .................................................... No Charge (b) The annual fee. for a noncommercial vehicle license for a vehicle owned or leased by a resident of age sixty five (65) or over (as of the due date of the license) shall be one dollar ($1.00) for the first vehicle per household licensed in each year. Additional vehicles owned or leased by such residents or otherwise registered to the same address shall be licensed at the rates set out above. (c) The annual fee for a noncommercial vehicle license for a vehicle registered to a person with disabilities as defined. in 625 Illinois Compiled Statutes 5/1- 159.1, and where said vehicle has been issued handicapped registration plates as provided for in 625 Illinois Compiled Statutes 5/3- 616(a), shall be one dollar ($1.00). (d) Any person failing to purchase and properly display the vehicle license described herein shall be fined forty ($40.00) therefor. (e) The annual fee for a noncommercial vehicle license for a vehicle owned or leased by a resident on active duty in one of the U.S. military services shall be waived. (f) The annual fee for a noncommercial vehicle license for a charitable vehicle owned or leased by a church or religious organization for the use of a clergyman, minister or practitioner of any religious denomination accredited by the religious body or organization to which he or she belongs shall be waived. SECTION 3: That Section 22 -143 (Time of Payment; License Year) of Article .17 (Vehicle Licenses) of Chapter 22 (Vehicles and Traffic) of the Municipal Code of the Village of Deerfield of 1975, as amended, be and the same is hereby further amended to read as follows. Additions are indicated by underlining and deletions are indicated by strikeout: Sec. 22 -143. Time of Payment; License Year; Delinquency; Exemptions. (a) The license year shall run from July 1 through June 30 of the next following year. The license fee due under this Article for motor vehicles required to display a village vehicle license sticker or tag shall be due and payable on or before July 1. Failure to purchase a vehicle license on or before July 1 shall result in the annual license fee set forth in Section 22 -140 being increased by fifty percent (50 %). Refunds of the license fee shall be made only for stickers or tags returned before commencement of the license year. (b) The license fee due under this Article for new residents of the Village shall be due and payable on or before thirty (30) days after residency is established in the Village. Failure to purchase a vehicle license within thirty (3 0) days after residency is established shall result in the annual license fee set forth in Section 22 -140 being increased by fifty percent (50 %). (c) The license fee due under this Article for motor vehicles purchased, leased or otherwise registered to an address in the Village after July 1 of the license year shall be due and payable on or before thirty (30) days after the motor vehicle has been so purchased, leased or registered. Failure to purchase a vehicle license within thirty (30) days after the acquisition or registration of such vehicle to the Village shall result in the license fee set forth in Section 22 -140 being increased by fifty percent (50 %). (d) The license fee for motor vehicle licenses issued after January 1 shall be one -half (1/2) of the annual fee payable under Section 22 -140, subject to the delinquent fees provided in paragraphs (b) and (c) hereof. SECTION 4: That Section 22 -144 (Use of Fund) of Article 17 (Vehicle Licenses).of Chapter 22 (Vehicles and Traffic) of the Municipal Code of the.Village of Deerfield of 1975, as amended, be and the same is hereby repealed. SECTION 5: That Section 22 -145 (License Plates) of Article 17 (Vehicle Licenses) of Chapter 22 (Vehicles and Traffic) of the Municipal Code of the Village of Deerfield of 1975, as amended, be and the same is hereby further amended to read as follows: Sec. 22 -145. Display of License Stickers and Tags: Every owner or operator of a motor vehicle who receives a license under this Article shall receive at the time of payment of the fee a Village license sticker or tag bearing the number and year for which the license is issued. Each Village license sticker or tag shall be affixed to the inside front windshield of the vehicle in the lower right corner. In the case of motorcycles, motorized pedalcycles, motor driven cycles and antique vehicles, the tag shall be attached to the vehicle for which it is issued, in a conspicuous place so as to be readily readable at all times at which such vehicle is operated on any public highway in the Village. SECTION 6: That this Ordinance, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction. SECTION 7: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law. PASSED this 4th day of April , 2006.
