VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0 -06 -11 AN ORDINANCE AUTHORIZING TWO WALL SIGNS FOR BUILDING ONE IN PARKWAY NORTH CENTER AS AN AMENDMENT TO THE APPROVED SIGNAGE PLAN FOR PARKWAY NORTH CENTER WHEREAS, Petitioner Carr America, being the owner of certain property commonly known as Parkway North Center legally described on Exhibit A attached hereto (the "Subject Property"), has petitioned the Plan Commission of the Village of Deerfield to approve an amendment to the previously approved Signage Plan for Parkway North Center to allow two (2) internally illuminated wall signs for United Stationers, the major tenant in Building One, as an amendment to the Special Use Planned Unit Development heretofore approved for the Subject Property in the I -1 Office, Research and Restricted Industrial District; and, WHEREAS, the Plan Commission of the Village of Deerfield held a public hearing on February 23, 2006 to consider Petitioner's request for an amendment to the approved Signage Plan for the Subject Property to allow two (2) 94.25 square foot (29 ft. x 3 ft. 3 inches) internally illuminated wall signs consisting of the letters "United Stationers" and a logo, said wall signs to be located at the northeast corner of the east wall of Building One and at the northwest corner of the west wall of Building One above the windows on the top floor of the building; and, WHEREAS, said public hearing was held pursuant to public notice duly given and published as required by statute and conforming in all respects, in both manner and form, with the requirements of the statutes of the State of Illinois and the Zoning Ordinance of the Village of Deerfield; and, WHEREAS, the Plan Commission of the Village of Deerfield, after considering the proposed amendments to the approved Signage Plan for the Subject Property and the evidence and supporting materials offered at said public hearing, has submitted its written report and recommendation to the President and Board of Trustees of the Village of Deerfield that said amendment to the approved Signage Plan should be approved as an amendment to the Special Use Planned Unit Development of the Subject Property in the I -1 Office, Research and Restricted Industrial District; and, WHEREAS, the President and Board of Trustees of the Village of Deerfield find that said amendment to the approved Signage Plan for the Subject Property should be approved as an amendment to the Special Use Planned Unit Development of the Subject Property in the I -1 Office, Research and Restricted Industrial District, authorizing and permitting two (2) 94.25 square foot (29 ft. x 3 ft. 3 inches) internally illuminated wall signs consisting of the letters "United Stationers" and a logo, said wall signs to be located at the northeast corner of the east wall of Building One and at the northwest corner of the west wall of Building One above the windows on the top floor of the building, all in accordance with the plans and exhibits presented by the Petitioner and attached hereto as Exhibit B hereof, NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: -2- SECTION 1: That the President and Board of Trustees of the Village of Deerfield do hereby find that the proposed amendment to the approved Signage Plan for the Subject Property fully complies with the requirements and standards set forth in Section 9.02 -C PUD entitled "I -1 Office, Research, Restricted Industrial District, Planned Unit Development ", and Section13.11 of the Zoning Ordinance of the Village of Deerfield. SECTION 2: That an amendment to the approved Signage Plan for the Subject Property is hereby authorized and approved as an amendment to the Special Use Planned Unit Development of the Subject Property in the I -1 Office, Research and Restricted Industrial District, to authorize and permit two (2) 94.25 square foot (29 ft. x 3 ft. 3 inches) internally illuminated wall signs consisting of the letters "United Stationers" and a logo, said wall signs to be located at the northeast corner of the east wall of Building One and at the northwest corner of the west wall of Building One above the windows on the top floor of the building, all in accordance with the plans, drawings and exhibits listed on Exhibit B attached hereto. SECTION 3: That the approval and authorization of said amendment to the approved Signage Plan for the Subject Property is hereby granted subject to the following conditions, regulations and restrictions: (i) that the construction, maintenance and use of the wall signs hereby approved shall be in accordance with the supporting documents, materials and exhibits comprising the amendment to the Signage Plan for the Subject Property attached hereto and made a part hereof as Exhibit B; (ii) except as otherwise provided herein, the construction, development, maintenance and use of the Subject Property shall be in accordance with the Final Development Plan heretofore approved as a Special Use Planned Unit Development of the Subject Property in the I -1 Office, -3- Research and Restricted Industrial District, including the Signage Plan as hereby amended; (iii) continued compliance by the Petitioner with all other applicable revisions of the Zoning Ordinance of the Village of Deerfield. SECTION 4: That the amendment to the approved Signage Plan for the Subject Property hereby approved and authorized as an amendment to the Special Use Planned Unit Development of the Subject Property shall be binding upon and inure to the benefit of Petitioner and Petitioner's successors, grantees, transferees and assigns, and any violation of the conditions hereinabove set forth by Petitioner or its successors, grantees, transferees or assigns shall authorize revocation of the amended Special Use hereby authorized. SECTION 5: The Village Clerk is hereby authorized and directed to record this Ordinance in the office of the Recorder of Deeds of Lake County, Illinois, at Petitioner's expense. SECTION 6: That this Ordinance, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction. SECTION 7: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law. -4- PASSED this 4th day of April , 2006.
