R-89-02RESOLUTION NO. 02
WHEREAS, The Village of Deerfield as a party defendant
to a class action suit in the Circuit Court of Lake County
dealing with the disposition of special assessment bonds issued
by the Village of Deerfield prior to 1940 entitled Hardin,
et. al. v. Village of Deerfield, 86 CH 230; and
WHEREAS, a Final Judgment Order was entered in said
suit on December 10, 1986 requiring that the Village set aside
the amount of $99,417.00 in a fund to be held for a period
of two years following the entry of said Order for the benefit
of claimants who were members-of the class in the above - captioned
suit; and
WHEREAS, two years have elapsed since the entry of said
Final Judgment Order and paragraph 5 thereof states:
"All sums not claimed by members of the class after
a period of two years from the date of entry of
Final Judgment are to be paid from the Special
Assessment Fund of the Village of Deerfield to
the General Fund of said Village."
NOW, THEREFORE, BE IT RESOLVED BY THE PRESIDENT AND
BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK
COUNTIES, ILLINOIS, AS FOLLOWS:
SECTION That all funds held by the Village of Deerfield
ONE: remaining in the Special Assessment Fund
pursuant to the Final Judgment Order in case
number 86 CH 230 be and are hereby transferred over to the
General Fund of the Village of Deerfield to be used for any
and all proper municipal purposes.
SECTION That the Finance Director of the Village
TWO: of Deerfield be and is hereby directed to
effectuate such transfer of said funds to
the General Fund forthwith.
