VILLAGE OF.DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0 -05 -43 AN ORDINANCE AMENDING THE CONSTRUCTION MANAGEMENT REGULATIONS CONTAINED IN ARTICLE 11, CHAPTER 6 OF THE DEERFIELD MUNICIPAL CODE TO REQUIRE A 24 -HOUR EMERGENCY PHONE NUMBER WHEREAS, the Village of Deerfield has adopted regulations for the management of construction sites in the Village of Deerfield to require that owners, general contractors and subcontractors establish, maintain and operate construction sites in a clean, safe and orderly manner, with due regard for the protection of trees, streets and public property that may be damaged by construction activities, and to minimize the nuisance and annoyance caused by unreasonable construction traffic and noise; and, WHEREAS, the President and Board of Trustees have determined that it is in the public interest that the general contractors and owners of construction sites subject to the construction management regulations contained in Article 11 of Chapter 6 of the Municipal Code of the Village of Deerfield should provide the Village with a telephone number by which the Village can contact the owner and/or contractor responsible for a construction site on a 24 -hour, 7 -day a week basis, in the event of an emergency, nuisance or ordinance violation affecting the site that causes or creates a risk of imminent damage or injury to the public health, safety or welfare of the Village or its residents; and WHEREAS, the President and Board of Trustees have determined that this ordinance shall take effect immediately upon its passage due to the urgency of implementing an immediate regulation that will allow the Village to make contact with the owners and contractors responsible for construction sites in the Village that cause or create a risk of imminent damage or injury to the public health, safety or welfare of the Village or its residents; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: That Section 6 -70, "General," of Article 11, "Construction Management," of Chapter 6, "Building," of the Deerfield Municipal Code, be and the same is hereby amended to read as follows: 6 -70 General Provisions: (1) The Applicant shall maintain the site and adjoining public ways and public property in a safe and clean condition, including but not limited to compliance with the applicable minimum standards and requirements set forth herein for security fencing, protection of public property and landscaping, sanitation, facilities for the collection and removal of debris, traffic and parking control, loading and storage, until construction of all improvements on the site has been completed and, if applicable, a certificate of occupancy has been issued. (2) Applicant shall provide the Director of Building and Zoning with a telephone number for 24 -hour emergency contact with the Applicant or the general contractor. (3) Upon notice to the Applicant that the site is not in compliance with the requirements of this Article, Applicant shall cause the site to be brought into full compliance with the requirements of this Article within twenty - four (24) hours. (4) As a condition of any building permit issued for a site, Applicant authorizes the Village and its officers, agents and employees, in the event of any emergency, accident or violation of this Article that affects or threatens to affect the site to the detriment of public health, safety and welfare, to enter upon the site and to take such actions as may be 2 H reasonably necessary or appropriate to respond to the emergency, accident or violation of this Article. SECTION 2: That this Ordinance, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions of _current or subsequent non - preemptive state law; or, (b) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction. SECTION 3: That this Ordinance shall be in full force and effect from and after its passage by a two - thirds (2/3's) vote of the corporate authorities and shall be subsequently published in pamphlet form as provided by law.
