VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0 -05 -26 AN ORDINANCE APPROVING A PROPOSAL BY WILLIAMS ARCHITECTS AND WILLIAMS DEVELOPMENT FOR DESIGN/BUILD SERVICES FOR THE VILLAGE HALL ADDITION AND REMODELING PROJECT AND APPROVING A DESIGN -BUILD AGREEMENT WITH WILLIAMS DEVELOPMENT, LTD. WHEREAS, the Village of Deerfield is a home rule unit of local government pursuant to the provisions of Article VII, Section 6 of the Illinois Constitution of 1970; and, WHEREAS, as a home rule unit of local government the Village of Deerfield may exercise any power and perform any function pertaining to its government and affairs, except as limited in accordance with Article VII, Section 6 of the Illinois Constitution; and, WHEREAS, the corporate authorities are of the opinion that the current Deerfield Village Hall needs to be expanded and modernized to meet the space needs requirements of the Village of Deerfield; and, WHEREAS, the Village Manager of the Village of Deerfield has recommended that the Village accept the proposal by Williams Development, Ltd. and Williams Architects to provide Design -Build services for a Village Hall addition and remodeling; and, WHEREAS, the Village Manager has further recommended that the corporate authorities of the Village of Deerfield approve and authorize an agreement between the Village of Deerfield and Williams Development, Ltd. dsated as of June 6, 2005 to provide Design -Build services for the Village Hall addition and remodeling project, a copy of which Agreement is attached hereto as Exhibit A; and, WHEREAS, the corporate authorities of the Village of Deerfield have reviewed the terms and conditions contained in said Agreement and find that such terms and conditions are in the best interests of the Village; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: That the corporate authorities of the Village of Deerfield do hereby authorize and approve the execution on behalf of the Village of Deerfield of the Agreement between Owner and Design- Builder dated as of June 6, 2005 between Williams Development, Ltd. and the Village of Deerfield for design -build services in connection with the Village Hall addition and remodeling project, as copy of which is attached hereto as Exhibit A. The Village Manager of the Village of Deerfield is hereby authorized and directed to execute said Agreement for and on behalf of the Village of Deerfield. SECTION 2: That formal bidding and performance bonding requirements, if any, applicable to the Design -Build services as provided in said Agreement, as contained either in the ordinances of the Village of Deerfield or the laws of the State of Illinois, are hereby waived, except to the extent expressly provided in said Agreement. SECTION 3: That this Ordinance, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a -2- manner or regarding a matter not delegated to municipalities by state law. It is the intent of the corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction. SECTION 4: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law. PASSED this 20th day of June , 2005.
