VILLAGE OF DEERFIELD LAKE AND COOK COUNTIES, ILLINOIS ORDINANCE NO. 0 -05 -22 AN ORDINANCE APPROVING AN AMENDMENT TO THE SIGNAGE PLAN FOR 1717 DEERFIELD ROAD (PRENTISS PROPERTIES) WHEREAS, Prentiss Properties Acquisition Partners, LP ( "Petitioner "), being the owner of certain property commonly known as 1717 Deerfield Road and legally described on Exhibit A attached hereto (the "Subject Property ") has petitioned the Plan Commission of the Village of Deerfield to approve an amendment to the previously approved signage plan for the Subject Property as an amendment to the I -1 Special Use Planned Unit Development heretofore approved for the Subject Property in the I -1 Office, Research and Restricted Industrial District and certain sign modifications to allow a 87 square foot single -faced ground sign facing the tollway for tenant identification of Warady & Davis LLP; and, WHEREAS, the Plan Commission of the Village of Deerfield held a public hearing on. March 24, 2005 to consider Petitioner's request for an amendment to the approved signage plan for the Subject Property to allow a new 87 square foot (25 ft. by 3.5 ft.) single- faced, non - illuminated ground sign facing the tollway containing " Warady & Davis LLP" in 14.5 -inch high lettering, including a modification to a sign larger than 45 square feet, and a modification to allow the proposed sign to be located 125 feet from the existing business ground sign on the Subject Property; WHEREAS, said public hearing was held pursuant to public notice duly given and published as required by statute and conforming in all respects, in both manner and form, with the requirements of the statutes of the State of Illinois and the Zoning Ordinance of the Village of Deerfield; and, WHEREAS, the Plan Commission of the Village of Deerfield, after considering the proposed amendment to the approved signage plan for the Subject Property and the evidence and supporting materials offered at said hearing, has submitted its written report and recommendation to the President and Board of the Trustees of the Village of Deerfield that said amendment to the approved signage plan, including necessary sign modifications, should be approved as an amendment to the Special Use Planned Unit Development of the Subject Property in the I -1 Office, Research and Restricted Industrial District; and, WHEREAS, the President and Board of Trustees of the Village of Deerfield find the said amendment to the approved signage plan for the Subject Property should be approved as an amendment to the Special Use Planned Unit Development of the Subject Property in the I- IOffice, Research and Restricted Industrial District authorizing and permitting an additional non - illuminated ground sign facing the tollway containing the wording "Warady & Davis LLP" and associated logo, a modification to allow an increase in the size of the sign to 87 square feet, and an additional modification to allow said ground sign to be located 125 feet from the existing business ground sign on the Subject Property, all in accordance with the plans and exhibits presented by the Petitioner and attached hereto as Exhibit B hereof; NOW, THEREFORE, BE IT ORDAINED BY THE PRESIDENT AND BOARD OF TRUSTEES OF THE VILLAGE OF DEERFIELD, LAKE AND COOK COUNTIES, ILLINOIS, in the exercise of its home rule powers, as follows: SECTION 1: That the President and Board of Trustees of the Village of Deerfield do hereby find that the requested amendment to the approved signage plan for the Subject Property fully complies with the requirements and standards set forth in Article 9.02 -C PUD and Article 13.11 of -2- the Zoning Ordinance of the Village of Deerfield and is hereby authorized and approved as an amendment to the previously approved signage plan for the building at 1717 Deerfield Road, and as an amendment to the Special Use Planned Unit Development of the Subject Property in the I- lOffice, Research and Restricted Industrial District, subject to the conditions and restrictions hereinafter set forth. SECTION 2: That an amendment to the approved signage plan for the Subject Property is hereby granted as an amendment to the Special Use Planned Unit Development of the Subject Property in the in the I -1 Office, Research and Restricted Industrial District to authorize and permit a new 87- square foot (25 ft. by 3.5 ft.) single- faced, non - illuminated monument ground sign to be established on the Subject Property containing the wording " Warady & Davis LLP" in 14.5 -inch lettering and the Warady & Davis logo, including modifications to allow an increase in the size of the sign to 87 square feet, and an additional modification to allow said ground sign to be located 125 feet from the existing Dade Behring business ground sign on the Subject Property, all in accordance with the plans, drawings and exhibits listed on Exhibit B attached hereto. The approval and authorization of said amendment to the approved signage plan for the Subject Property is subject to the conditions, regulations and restrictions set forth in Section 3 of this Ordinance. SECTION 3: That the approval and authorization of said amendment to the approved signage plan for the Subject Property is hereby granted subject to the following conditions: (i) that the construction, maintenance and use of the business ground sign hereby approved shall be in accordance with the supporting documents, materials and exhibits comprising the amendment to the signage plan for the Subject Property attached hereto and made a part hereof as Exhibit B; (ii) the property owner shall remove the existing address sign located to the south of the existing Dade BE Behring ground sign; (iii) that no additional ground signs shall be permitted on the Subject Property, including the division of any existing sign faces for identification of multiple tenants, so long as the existing Dade Behring sign and the ground sign authorized by this ordinance are located on the Subject Property; (iv) except as otherwise provided herein, the construction, development, maintenance and use of the Subject Property shall be in accordance with the Final Development Plan heretofore approved as a Special Use Planned Unit Development of the Subject Property in the in the I -1 Office, Research and Restricted Industrial District, including the signage plan as hereby amended; (v) continued compliance by the Petitioner with all other applicable provisions of the Zoning Ordinance of the Village of Deerfield. SECTION 4: That the amendment to the approved signage plan for the Subject Property hereby approved and authorized as an amendment to the Special Use Planned Unit Development of the Subject Property in the I -1 Office, Research and Restricted Industrial District shall be binding upon and inure to the benefit of Petitioner and Petitioner's successors, grantees, transferees and assigns, and any violation of the conditions hereinabove set forth by Petitioner or its successors, grantees, transferees or assigns shall authorize revocation of the Amended Special Use hereby authorized. SECTION 5: That the Village Clerk is hereby authorized and directed to record this Ordinance in the office of the Recorder of Deeds of Lake County, Illinois at Petitioner's expense. SECTION 6: That this Ordinance, and each of its terms, shall be the effective legislative act of a home rule municipality without regard to whether such Ordinance should: (a) contain terms contrary to the provisions of current or subsequent non - preemptive state law; or, (b) legislate in a manner or regarding a matter not delegated to municipalities by state law. It is the intent of the -4- corporate authorities of the Village of Deerfield that to the extent that the terms of this Ordinance should be inconsistent with any non - preemptive state law, this Ordinance shall supersede state law in that regard within its jurisdiction. SECTION 7: That this Ordinance shall be in full force and effect from and after its passage, approval and publication in pamphlet form as provided by law. PASSED this 16th day of May , 2005.
